About allowance payment to needy families, the having children studying at comprehensive schools of the Republic of Tajikistan

According to article 16 of the Constitutional law of the Republic of Tajikistan "About the Government of the Republic of Tajikistan" and for the purpose of social, needy family and stimulations of children and teenagers to educational process the Government of the Republic of Tajikistan decides supports:

1. Establish benefits to needy families, the having children studying at comprehensive schools of the Republic of Tajikistan in the amount of 20 (twenty) somoni and to make payment two times within year.

2. Approve Rules of appointment and the allowance payments to needy families having the children studying at comprehensive schools of the Republic of Tajikistan it (is applied).

3. To chairmen of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, the cities and the regions of the Republic of Tajikistan to provide timely allowance payment to pupils through financial structures of local executive bodies of the government at the expense of means of the local budgets intended for these purposes.

4. Declare invalid the order of the Government of the Republic of Tajikistan of December 30, 2001 No. 585 "About payment of money allowances (compensations) to needy families having the children studying at comprehensive schools of the Republic of Tajikistan".

Rules of appointment and the allowance payment to needy families having the children studying at comprehensive schools of the Republic of Tajikistan

I. General provisions

1. For the purpose of the organization of activities to destination and allowance payment to needy families, the having children who study at comprehensive schools (initial, general main, general average) the Republic of Tajikistan (further - needy families) under each district (city) local executive body of the government the district (city) commissions are created of number of representatives of educational bodies, work, social protection of the population and finance. The commission is headed by the vice-chairman of the area (city) supervising the social sphere.

2. Besides, at each school the school commissions to destination and allowance payment are created. The structure of the school commission affirms by open voting on general meeting of parents and teachers, with involvement of representatives of self-government institutions of the settlement and village, makhalinsky council and management of housing and communal services (as the cities) depending on the number of pupils numbering at least 7 people with creation of the protocol of meeting.

3. The school commission is headed by the deputy principal, and one of members of the commission is elected as the secretary of the commission.

4. The school commission determines the needing pupils, after coordination with self-government institutions of the settlement and the village, makhalinsky council and management of housing and communal services (in the cities) represents for approval to the district (city) commission.

5. The Ministry of Education and Science of the Republic of Tajikistan annually at the beginning of academic year provides information on the number of pupils of comprehensive schools (initial, general main, general average) in the Ministry of Labour, migrations and employment of the population of the Republic of Tajikistan and in the Ministry of Finance of the Republic of Tajikistan.

6. The Ministry of Labour, migrations and employment of the population of the Republic of Tajikistan at the beginning of each academic year after determination of number of the needy families having the children studying at comprehensive schools (initial, general main, general average) submits to the Ministry of Finance of the Republic of Tajikistan the request about the annual size of benefits.

7. Constant control over activities of the commissions created according to this Provision performs the Ministry of Labour, migrations and employment of the population of the Republic of Tajikistan together with local executive bodies of the government.

II. Procedure for appointment and allowance payment

8. Benefits for the needy families having children who study at comprehensive schools (the initial and general main to stage) of the Republic of Tajikistan are appointed to families which average monthly income on each family member constitutes lower than 50 percent of the established minimum wage.

9. The school commissions in coordination with self-government institutions of the settlement and village, makhalinsky councils and managements of housing and communal services (in the cities) and district (city) departments of social protection of the population constitute lists of families of pupils (no more than 15 percent) from among pupils of 1 and 9 classes on F-1 (is applied) according to requirements of Item 5 of this provision which are submitted for approval in the district (city) commission.

10. Benefits for pupils of 1 and 9 classes are appointed to members of needy families which study at school or because of needs do not attend school, according to lists taking into account the established requirements from the school commission after coordination with self-government institutions of the settlement and the village, makhalinsky councils and management of housing and communal services (in the cities).

11. Allowance payment annually covers 15 percent of pupils of comprehensive schools (initial, general main, general average) where the amount in the amount of 20 (twenty) somoni is paid to everyone in every half-year.

12. Allowance payment to the needing pupils of the area (city) shall cover no more than 15 percent from the total number of pupils of comprehensive schools (pupils of 1 and 9 classes).

13. Non-state educational institutions, and also schools boarding schools, lyceums, gymnasiums and other educational institutions which pupils are on the state providing cannot enter this category and are covered by benefits.

14. From each needy family, the having more than 5 pupils, no more than 3 pupils have the right of receipt of benefit.

15. Benefits according to the approved sheets of the district (city) commission it is paid at the beginning of every half-year.

16. Sheets of allowance payment are filled in in duplicate after allowance payment, the school commission to the 20th day of the second month of half-year hands over one copy of the sheet in financial body, and the second copy remains at school.
