1. Approve provision, structure of Central office, the scheme of management and the list of the companies of Public service for supervision in the sphere of construction and architecture (appendices 1, 2, 3, 4).

2. Approve the extreme number of employees of Public service on supervision in the sphere of construction and architecture in number of 37 units (without service personnel), including Central office in number of 11 units.

3. Payment of 25 established posts of Public service on supervision in the sphere of construction and architecture to provide at the expense of the republican budget, and 12 established posts at the expense of special means.

4. Permit Public service on supervision in the sphere of construction and architecture to have one deputy chief.

5. Set limit of automobile office cars of Public service of supervision in the sphere of construction and architecture in number of one unit.

6. Create under Public service on supervision in the sphere of construction and architecture the State unitary enterprise "Manzili Sokhtmonchiyen".

7. Declare invalid the order of the Government of the Republic of Tajikistan No. 554 of December 25, 1997 regarding approval of "Regulations on the State construction inspection of Committee on cases of architecture and construction under the Government of the Republic of Tajikistan".

Regulations on Public service on supervision in the sphere of construction and architecture

I. General provisions

1. Public service on supervision in the sphere of construction and architecture (further Service) is executive body, performing functions on control and supervision in the sphere of construction and architecture in the territory of the republic. Also has power on control of the organizations in the sphere of construction founded according to international treaties.

2. The service is in the scheme of management of the Agency on construction and architecture under the Government of the Republic of Tajikistan.

II. Functions

5. The service performs the following functions:

a) the state control in the territory of the Republic of Tajikistan:

- on observance of regulatory legal acts in the sphere of construction and architecture;

- on observance by the companies for production of construction materials, designs, the construction organizations and physical persons of construction regulations and rules, standards and certificates;

- on observance behind quality of accomplishment of installation and construction works when constructing facilities construction engineering, industrial, energy, agricultural, road, reconstruction the building of constructions of production and non-productive nature;

- on observance of other types of construction irrespective of their departmental accessory and patterns of ownership;

- behind activities of designer's and technical service of the project organizations and customers, irrespective of their departmental accessory;

- behind timely and high-quality carrying out by participants of construction of the engineering researches, testing, shootings, measurements and registration by their results of necessary technological and executive documentation provided normative and technical and the project documentation;

- behind implementation of the approved projects and observance of normative and technical requirements regarding architectural and town-planning decisions;

b) carrying out selective check on observance of acceptance procedures of objects in operation from the state inspections and adoption of relevant decisions;

c) preparation of offers on modification and amendments in the existing and developing new regulating and methodical documents providing quality to installation and construction works, production of construction materials, designs and products in organization-legal procedure for construction;

d) coordination of activities of state bodies of supervision in the sphere of construction and architecture of the republican ministries and departments, the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, the cities and areas of republican subordination and other construction, project organizations and customers irrespective of their departmental accessory and patterns of ownership on observance of regulatory legal acts, qualities of installation and construction works during construction of facilities;

e) participation in the State inspections on acceptance of objects in operation;

e) carrying out selective checks of construction cost of the objects financed by means of the government budget or in case of equity of the Government of the Republic of Tajikistan;

e) the analysis and generalization of the materials received as a result of performed, and preparation of suggestions for improvement of project decisions, regulatory legal acts, in improvement of quality of installation and construction works and production of construction materials, designs and products;

l) interaction with other state supervision bodies, research, project and public organizations concerning quality assurance of construction products, observance of the construction legislation, protection of the rights of citizens to full living environment.

6. The service has the right:

- to freely visit construction objects, the companies for production of construction materials, designs and products, material and technical resources of organizations and the organizations for construction or engaged in services in construction, irrespective of departmental accessory and patterns of ownership;
