About obligatory copy of documents

This Law determines the legal beginnings of functioning of system of obligatory copy of documents and governs the information relations connected with replenishment of national information fund of Ukraine.

Section I. General provisions

Article 1. Determination of terms and concepts

In this Law the terms below and concepts are used in the following value:

obligatory copy of documents - copy of different types of the replicated documents which is transferred it by the manufacturer on free or paid basis to the legal entities determined by this Law;

system of obligatory copy of documents - set of types of obligatory copies of documents, and also procedure for their delivery, storage and use;

the document - material form of obtaining, storage, use and distribution of information fixed on paper magnetic, film, film, optical disk or other carrier;

the replicated document - the document made by certain circulation;

patent documents - descriptions to patents for inventions (useful models) and methodical documents to them;

the manufacturer of documents - the legal entity irrespective of pattern of ownership or physical person which produces (including publishes) different types of the replicated documents;

the receiver of obligatory copy of documents (further - the receiver of documents) - the legal entity of Ukraine who receives obligatory copy of documents on free or paid basis also provides its storage and use;

national information fund of Ukraine - set of information funds (information resources) of the state: archive, library, standards, archive of seal, fund of movies, patent and other funds.

Article 2. Main objectives of the Law

The main objectives of this Law are:

determination of the general principles of state policy in the field of replenishment of national information fund of Ukraine obligatory copy of documents;

regulation of the information relations connected with functioning of system of obligatory copy of documents;

establishment of obligations and rights of manufacturers of documents and receivers of documents.

Article 3. Law coverage

Operation of this Law extends to the relations arising in case of:

production (including publishing) legal entities and physical persons of Ukraine of different types of the replicated documents in Ukraine and beyond its limits;

production of different types of the replicated documents in Ukraine legal entities and physical persons of other states;

receipt of obligatory copy of documents by legal entities of Ukraine. This Law does not extend to the relations arising in case of production of documents with limited access, documents of managerial and personal nature, documents in single execution.

Article 4. Legislation of Ukraine on obligatory copy of documents

The legislation of Ukraine on obligatory copy of documents consists of this Law and other regulatory legal acts of Ukraine.

Article 5. Subjects and objects of the relations arising in the course of functioning of system of obligatory copy of documents

Subjects of the relations arising in the course of functioning of system of obligatory copy of documents are legal entities of all patterns of ownership and physical persons who produce, publish and deliver obligatory copy of documents, and legal entities who receive store and use obligatory copy of documents.

Object of the relations arising in the course of functioning of system of obligatory copy of documents is the obligatory copy of documents which is subject to delivery of documents by manufacturers to receivers of the documents determined by this Law.

Article 6. Document types, carried to obligatory copy

Their following types belong to obligatory copy of documents:

editions are text, musical, cartographic, graphic; editions electronic;

editions, audioproducts and other documents for blind people;

audio-, visual, audiovisual products (film, video, photo, phonodocuments);

regulatory legal acts in the field of standardization, metrology and certification;

the paragraph of the sixth is excluded according to the Law of Ukraine of 20.09.2019 No. 124-IX

Article 7. Procedure for delivery of obligatory copy of documents

The procedure for delivery of obligatory copy of documents establishes the Cabinet of Ministers of Ukraine.

Section II. Obligations and rights of manufacturers of documents and receivers of documents

Article 8. Obligations of manufacturers of documents

Manufacturers of documents deliver all or separate on their profile or/and type:

1) obligatory complimentary copy of editions - To book chamber of Ukraine, national, including specialized, All-Ukrainian libraries, the Verkhovna Rada of Ukraine, the President of Ukraine, the Cabinet of Ministers of Ukraine, the central executive body which realizes state policy in the field of state registration of printing media, and to the central executive body which realizes state policy in the field of publishing;

2) the obligatory complimentary copy of editions which are produced (including are published) in the corresponding territory, - to universal libraries (The Autonomous Republic of Crimea and regional);

3) the obligatory complimentary copy of patent documents - to the state centers of scientific and technical and economic information, All-Ukrainian industry libraries;

4) obligatory complimentary copy of audio-, visual, audiovisual products:

to the state fund of movies under the central executive body which realizes state policy in the field of cinematography - film copies and initial materials film and the videos created fully or partially at the expense of the Government budget of Ukraine, and the film copy film and the videos created in Ukraine at the expense of legal entities with private pattern of ownership or physical persons (except movies of documentary nature, the film periodical press, works of the film and video chronicle);

To the central state film photophonoarchive of Ukraine - film copies and initial materials film and videos of documentary nature, the film periodical press, works of the film and video chronicle, photo, the phonodocuments created fully or partially at the expense of the Government budget of Ukraine, and also the film copy of documentary nature, the film periodical press, works of the film and video chronicle photo, the phonodocuments created at the expense of legal entities with private pattern of ownership or physical persons;

to national, including specialized, All-Ukrainian libraries - audioproducts of help, educational, scientific and educational, production and professional, entertaining nature;

to universal libraries (The Autonomous Republic of Crimea and regional) - audioproducts of local history nature made in the corresponding territory;
