Electrical power Council of the Commonwealth of Independent States solved:

1. Approve Regulations on the status of the Observer at Electrical power Council of the Commonwealth of Independent States it (is applied).

2. Declare invalid the Regulations on the status of the Observer in Electrical power Council of the Commonwealth of Independent States approved by the Decision of Electrical power Council of the CIS of December 20, 2000, the Protocol No. 18.

It is made in the city of St. Petersburg on May 19, 2006 in one authentic copy in Russian. The authentic copy is stored in Executive committee of Electrical power Council of the CIS which will send its verified copy to each state member of Electrical power Council of the CIS.

Regulations on the status of the Observer at Electrical power Council of the Commonwealth of Independent States

This Regulations on the status of the Observer at Electrical power Council of the Commonwealth of Independent States (further - this Provision) are developed based on the Agreement on coordination of the interstate relations in the field of power industry of the Commonwealth of Independent States of February 14, 1992 (daleesoglasheniye) and according to Regulations on Electrical power Council of the Commonwealth of Independent States (further - the Provision).

1. For the purpose of exchange of information, to the international and other organizations (daleeorganization) the status of the Observer at Electrical power Council of the CIS can be provided to the organization of cooperation and coordination of activities (further - the status of the Observer).

2. The organization which showed willingness to receive the status of the Observer files the corresponding petition in Electrical power Council of the CIS (further - Electrical power Council) through Executive committee of Electrical power Council (further - Executive committee).

The executive committee submits in accordance with the established procedure the statement of the organization for consideration of Electrical power Council.

The executive committee has the right to request from the organization which showed willingness to receive the status of the Observer, information on constituent documents, the list of participants (including founders, members), governing bodies, and also the open (published) data of the financial reporting. As required the organization represents data on changes of earlier provided information.

3. The decision on provision of the status of the Observer is made on the basis of consensus.

The consensus is determined as lack of official objection at least one member of the Electrical power Council pushed by it as the representing obstacle for decision making.

Any member of Electrical power Council can declare the disinterest by consideration of question of provision of the status of the Observer that he is not obstacle for decision making.

At consideration of the application about provision of the status of the Observer at meeting of Electrical power Council there can be with the consent of his members representatives of the organization which submitted the application.

The made decision on provision of the status of the Observer together with the agreement signed at the request of Electrical power Council between Executive committee and the Observer at Electrical power Council goes Executive committee of the relevant organization in a month.

The decision on provision of the status of the Observer becomes effective from signature date of the Contract between Executive committee of Electrical power Council and the Observer at Electrical power Council both parties.

4. The status of the Observer does not grant voting power in case of decision making at meetings of Electrical power Council and right to sign of documents. The organization which received the status of the Observer does not bear responsibility for the decisions made by Electrical power Council.

The rights and obligations of the Observer at Electrical power Council are determined by this Provision and the Agreement signed by Executive committee with the Observer at the request of Electrical power Council.

The standard agreement between Executive committee of Electrical power Council and the Observer at Electrical power Council is appendix of this provision.

5. The observer has the right:

- be present at open sessions of Electrical power Council;

- participate in discussion of the questions which are of mutual interest and also in case of discussion of the profit and loss budget on financing of activities of Executive committee for the next year regarding determination of the size of fee of the Observer;

- participate in project development of the documents of Electrical power Council which are of mutual interest;

- act in debate and make offers with the consent of the chairman;

- receive copies of protocols and the decisions made at meeting of Electrical power Council, and also other documents and materials on the questions discussed with participation of the Observer;

- represent to Executive committee initiative offers on cooperation in the field of power industry for the subsequent consideration on Electrical power Council;

- participate in meetings of working groups and other bodies of Electrical power Council, and also in seminars, conferences and other events held by Electrical power Council;

- bring annual fees on financing of the expenses connected with participation of the Observer in meetings and other actions of Electrical power Council;

- support permanent contacts with Executive committee.

6. The observer assumes liabilities:

- respect the principles stated in the Agreement and the Provision;

- observe this Provision;
