About approval of the Procedure for distribution of the woods to categories and allocations of especially protective timberland

According to Articles 39 and 41 of the Forest code of Ukraine the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for division of the woods into categories and allocations of especially protective timberland which is applied.

2. Declare invalid, the resolution of the Cabinet of Ministers of Ukraine of July 27, 1995 No. 557 "About approval of the Procedure for division of the woods into groups, their references to categories of zashchitnost and allocation of especially protective parcels of land of forest fund" (the joint venture of Ukraine, 1995, No. 10, the Art. 254).

Procedure for division of the woods into categories and allocations of especially protective timberland

General part

1. This Procedure establishes single requirements to division of the woods into categories, conditions and signs of their reference to such categories, and also allocation of especially protective timberland with the mode of limited forest utilization.

2. The woods depending on the main functions which are carried out by them are divided into such categories:

1) woods of nature protection, scientific, historical and cultural appointment;

2) recreational and improving woods;

3) protective woods;

4) operational woods.

3. The woods which grow in one territory and answer conditions and signs of reference to different categories, concern to that from them for which in the procedure determined by the legislation the mode of more limited forest utilization is set.

4. Timberlines, determined for reference to one of categories, are carried out along natural borders, quarter glades, communication lines and power supply networks and other differentiating lines which are accurately determined on the area - the railroads and highways, ditches, channels, gazo-and oil pipelines, viewfinders, fire-proof gaps and water separate lines.

Woods of nature protection, scientific, historical and cultural appointment

5. The timberland which performs nature protection, esthetic function belong to the woods of nature protection, scientific, historical and cultural appointment, are objects of research works on long-term perspective, promote ensuring protection of unique and other especially valuable natural complexes and historical and cultural objects, in particular:

1) located within the territories and objects of natural and reserved fund, and also within prales, kvaziprales and the natural woods located outside the territories and objects of natural and reserved fund;

2) located within historical and cultural reserves, memorial complexes, places connected with important historical events, conservation zones of monuments of history, archeology, town-planning and architecture, monumental art.

The timberland, also unique behind pedigree structure, performance and genetic properties, on which relic, local types of trees which have great scientific value grow belong to the woods of nature protection, scientific, historical and cultural appointment.

Recreational and improving woods

6. The timberland which performs recreational, sanitary and hygienic and improving function belong to the recreational and improving woods, are used for tourism, sports activities, sanatorium treatment and rest of the population and are located:

1) within the cities, settlements and other settlements;

2) within districts of sanitary protection of the medical and improving territories and resorts;

3) within belts of zones of sanitary protection of water objects;

4) in the woods of green zones around settlements. The area of such timberland is determined by standard rates according to appendix 1;

5) out of timberlines of green zones which are allocated according to standard rates according to appendix 2.

Protective woods

7. The timberland which performs function of protection of the surrounding environment and engineering objects from negative impact of natural and anthropogenous factors, in particular belong to the category of the protective woods:

1) forest plantings of linear type (windbreak forest fields, the state protective forest strips, forest strips along the built-up territories of settlements);

2) the timberland (strip of the woods) located in strips of assignment of channels, railroads and highways;

3) the timberland (strip of the woods) in ravines, on the easily vanishing sands, the recultivated lands, stony scatterings, low-power stony soils, in mountain zones, on prompt hillsides, in mudflow pools and on slopes of avalanche pools (the erosion-preventive woods) which are allocated according to standard rates according to appendix 3. The area of the antierosion woods in the Carpathian region is not subject to revision towards reduction;

4) the timberland (strip of the woods) which adjoins to strips of assignment of the railroads and are allocated from category of the operational woods for 500 meters from each party. In mountainous areas width of strips of the woods can be in case of need increased taking into account results of special inspections to the sizes which provide protection of the railroads and traffic safety;

5) the timberland (strip of the woods) which adjoins to strips of assignment of highways of the state value and are allocated from category of the operational woods 250 meters wide from each side of the road. For ensuring protection of noted roads and traffic safety in mountainous areas width of strips of the woods can be in case of need increased taking into account results of special inspections;

6) the timberland (strip of the woods) along coast of the rivers, around lakes, and other reservoirs which are allocated from category of the operational woods according to standard rates according to appendix 4. Width of the available strips of the woods which exceeds standard rates is not subject to revision;

7) other timberland (strip of the woods) which has no the reference signs noted in subitems 1-6 of this Item to category of the protective woods, located:

on slopes of beams and river valleys with the steepness of slopes to 25 degrees (the buyerachny woods);

among the bezlesy area also have the area to 100 hectares.

Operational woods

8. The timberland which is not occupied with the woods of nature protection, scientific, historical and cultural appointment, the recreational and improving and protective woods belong to the category of the operational woods (category of the woods with specific mode of forest utilization). The operational woods are intended for requirements satisfaction of national economy in wood.
