About physical culture and sport

This Law determines general legal, organizational, social and economic basis of activities in the field of physical culture and sport and governs the public relations in creation of conditions for development of physical culture and sport.

Section I. General provisions

Article 1. Main terms and their determinations

In this Law the stated below terms are used in the following value:

sport - kind of the competitive activities in sport performed with observance of certain rules. Sports are subdivided into groups: the Olympic sports - the sports included in the program of the Olympic Games; not Olympic types of sportavida of sport which are not included in the program of the Olympic Games; sports of persons with disability - the sports included in programs of Paralympic and Deflimpiysky Games, and the sports which are not included in programs of Paralympic and Deflimpiysky Games in which persons with disability participate;

public association of sports orientation - the consolidation of citizens created for the purpose of requirements satisfaction of his members in the field of physical culture and sport;

The single schedule of sports and improving sporting events and sports competitions - the document in which for the corresponding year organizational and financial matters are determined by ensuring holding the relevant activities and which affirms the central executive body providing forming of state policy in the field of physical culture and sport in the procedure established by it;

organization of physical culture and sport - the legal entity providing development of physical culture and sport by, in particular, provision of services in the field of physical culture and sport. Organizations of physical culture and sport, in particular, are: sports clubs, children's and youth sports schools, organizations of vocational education of sports profile with specific conditions of training, school of the highest sports skill, the centers of the Olympic preparation, the centers of student's sport of institutions of higher education, sports and improving organizations, the centers of physical health of the population, the centers of physical culture and sport of persons with disability;

mass sport (sport for all) - the activities of subjects of the sphere of physical culture and sport aimed at providing physical activity of people during their leisure for strengthening of health;

philanthropic activities in the field of physical culture and sport - voluntary non-paid provision by physical persons and legal entities (patrons of physical culture and sport) of material, cash or other support of physical culture and sport to receivers of the philanthropic help;

the philanthropic help - support or development assistance of physical culture and sport which are provided by the patron of physical culture and sport physical and/or legal persons in types and in the directions determined by the law;

educational training camps - the sporting events performed by organizers of sporting events for training of athletes for participation in sports competitions;

national sports - the sports based on national and cultural traditions of Ukraine;

not Olympic sport - the direction of sport connected with the organization and holding sports competitions in not Olympic sports and training of athletes for these competitions;

the Olympic sport - the direction of sport connected with the organization and holding sports competitions in the Olympic sports and training of athletes for these competitions;

the organizer of sports and improving or sporting events - legal entity or physical person which holds sports and improving or sporting event also performs organizational, financial and other support of preparation and holding this action;

the organizer of sports competitions - legal (legal) or physical (physical) also performs person (persons) who (which) initiated (initiated) holding sports competitions (perform) organizational and methodical ensuring their preparation and carrying out;

sport - the activities of subjects of the sphere of physical culture and sport directed to identification and the unified comparison of achievements of people in physical, intellectual and other podgotovlennost by holding sports competitions and preparation for them. The sport has such directions: children's sport, sport for children and young people, reserve sport, elite sport, professional sport, sport of veterans of physical culture and sport, veterans of war, the Olympic sport, not Olympic sport, office and applied and military and applied sport, sport of persons with disability and so forth;

sport of persons with disability - the direction of sport connected with the organization and holding sports competitions in sports of persons to disability and training of athletes for these competitions;

sports activities - the actions performed by subjects of the sphere of physical culture and sport for development of sport;

sporting events - educational training camps, and also action (actions) held by the organizer (organizers) of sporting events within the sports competitions or as independent action;

sports weapon - certified in the procedure established by the legislation fire (except fighting) or the pneumatic, shooting, emasculated (okholoshchenny) and cold weapon intended only for defeat of the purposes during sporting events which parameters and characteristics are fixed in rules of sports competitions in the sports recognized in Ukraine;

sports competition - sporting event or complex of sporting events which are held by the organizer of sports competitions to the purpose of comparison of achievements of athletes and determination of winners according to rules of sports competitions in sports and the regulations (regulations) on these competitions approved by the organizer of sports competitions which answers with the certain central executive body providing forming of state policy in the field of physical culture and sport, to requirements and the Law;

sports construction - the real estate intended for occupations by physical culture and sport;

the athlete - the physical person who is systematically engaged in certain type (types) of sport and participating in sports competitions;

subjects of the sphere of physical culture and sport - the physical persons or legal entities performing the activities for the purpose of development of physical culture and sport. Subjects of the sphere of physical culture and sport are: the physical persons playing physical culture and sport including athletes; specialists of the sphere of physical culture and sport; organizations of physical culture and sport; appropriate authorities;

sports and improving activities - the actions performed by subjects of the sphere of physical culture and sport for development of physical culture;

sports and improving actions - the actions performed by organizers of sports and improving actions for attraction of different national groups to occupations physical culture;

services in the field of physical culture and sport - the organization and carrying out by subjects of the sphere of physical culture and sport of sports and improving activities and/or sports rehabilitation of persons with disability or training of athletes for competitions in the sports recognized in Ukraine;

physical culture - the activities of subjects of the sphere of physical culture and sport aimed at providing physical activity of people for the purpose of their harmonious, first of all physical, development and maintaining healthy lifestyle. The physical culture has the following directions: physical training of different national groups, mass sport, sports rehabilitation;

physical training of different national groups - the direction of physical culture connected with process of education of person, acquisition by it of the corresponding knowledge and abilities and use of physical activity for all-round development, improvement and ensuring readiness for professional activity and active participation in public life;

physical training - the component of physical training of different national groups consisting in forming of motive skills of the person, development of its physical qualities and capabilities taking into account professional activity peculiarities;

sports rehabilitation - system of the actions developed using physical exercises for recovery of health of the person and directed to recovery and compensation by means of occupations by physical culture and sport of functionality of its organism for improvement of physical and psychological state.

Article 2. Legislation of Ukraine on physical culture and sport

The legislation of Ukraine on physical culture and sport is based on the Constitution of Ukraine and consists of this Law, the corresponding international treaties of Ukraine and other regulatory legal acts regulating legal relationship in this sphere.

Article 3. The rights of citizens in the field of physical culture and sport

Citizens have the right to play physical culture and sport irrespective of signs of race, skin color, political, religious and other convictions, floor, ethnic and social origin, property condition, the residence, language or other signs.

This right is provided in the way:

the free choice of sports and services in the field of physical culture and sport;

availability and safety of occupations physical culture and sport;

protection of the rights and legitimate interests of citizens;

creations of organizations of physical culture and sport;

associations of citizens in public associations of sports orientation;

receipts of vocational education and implementation of the related professional activity.

Article 4. Bases of state policy in the field of physical culture and sport

State policy in the field of physical culture and sport is based on the beginnings:

recognitions of physical culture and sport as priority direction of humanitarian policy of the state;

recognitions of physical culture as important factor of all-round development of the personality and forming of healthy lifestyle;

recognitions of sport as important factor of achievement of physical and spiritual perfection of the person, forming of patriotic feelings at citizens and positive international image of the state;

providing humanistic orientation and priority of universal values, justice, mutual respect and tender equality;

prevention of violence and child abuse, its discrimination on any signs, humiliation of his honor and advantage;

guaranteeing the equal rights and opportunities of citizens in the field of physical culture and sport;

safety of life and health of persons playing physical culture and sport, participants and the audience of sporting and sports and improving events;

assistance of continuity and sequence of occupations physical culture and sport of citizens of different age groupes;

approvals of ethical and moral values of physical culture and sport;

creations of conditions for social and legal protection of citizens in the field of physical culture and sport;

ensuring support of public associations of sports orientation;

ensuring variety, high quality and availability of sports services to citizens;

providing conditions for support of the directions of physical culture and sport;

ensuring access of persons with disability to sports constructions;

encouragement of charity in the field of physical culture and sport;

orientations on modern international standards in the field of physical culture and sport, combinations of domestic traditions and achievements with international experience in this sphere;

ensuring compliance with the state social standards in the field of physical culture and sport.

Article 4-1. Language of sporting events

Application of languages during the sporting events determines the Law of Ukraine "About ensuring functioning of Ukrainian as state".
