About the basic principles of social protection of veterans of work and other citizens of old age in Ukraine

(as amended on 17-01-2019)

This Law determines the basic principles of state policy concerning veterans of work, other citizens of old age and is directed to forming in the company of humane, respect for them and ensuring their active longevity.

The law guarantees to veterans of work and citizens of old age opportunities, equal with other citizens, in economic, social, political spheres, favorable conditions for full-fledged conduct of life.

Section I. General provisions

Article 1. The basic principles of state policy concerning veterans of work and citizens of old age

The state guarantees to each veteran of work and the citizen of old age proper level of living, satisfaction of various vital needs, provision of different types of benefits with way:

realization of right to work according to professional training, labor skills and taking into account the state of health;

providing with pensions and benefits;

provision of housing;

creations of conditions for maintenance of health and active longevity according to modern achievements of science;

ensuring realization of the right to social services, creation of network of the organizations providing social services, ensuring strengthening and development of their material and technical resources;

The Cabinet of Ministers of Ukraine, local executive bodies and local government bodies shall develop and perform the state target and regional programs of social protection of citizens of old age.

Article 2. Bases of legal status of veterans of work and citizens of old age

The legislation of Ukraine on social protection of veterans of work and citizens of old age consists of this Law and other acts of the legislation of Ukraine.

Citizens of old age have all social and economic and personal rights and freedoms set by the Constitution of Ukraine, other legal acts.

Discrimination of citizens of old age in the field of work, health cares, social security, use of housing and in other spheres is forbidden, and the officials breaking these guarantees are made responsible according to the current legislation.

The legislation of Ukraine establishes the necessary level of guarantees of the rights of citizens of old age in all spheres of life of society.

Local councils, local executive bodies and local government bodies, the companies, organizations and the organizations can establish at the expense of own means and charitable receipts additional guarantees on social protection of citizens of old age.

Article 3. Participation of associations of veterans of work and citizens of old age in development and decision making

Associations of veterans of work and citizens of old age according to their charters:

participate in development of decisions of the state governing bodies which are directly concerning them interests;

represent and protect legitimate interests of the members (participants) in the state and public bodies;

perform other powers, stipulated by the legislation Ukraine about associations of citizens.

Veterans of work and citizens of old age have the right to participate in decision making which the interests which are directly concerning them, and to obtain necessary information.

Article 4. Implementation of the legislation and target programs for problems of veterans of work and citizens of old age

Ensuring execution of this Law and target programs for problems of veterans of work and citizens of old age is assigned to the Cabinet of Ministers of Ukraine, local executive bodies and local government bodies and the relevant services which activities are connected with the organization of requirements satisfaction of veterans of work and citizens of old age and realization of their rights.

Article 5. International agreements of Ukraine

If the international treaty or the agreement of Ukraine establish higher requirements concerning guarantees of social protection of veterans of work and citizens of old age, than those which are provided by this Law then are applied rules of the international treaty or the agreement.

Section II. The status of veterans of work and privilege for them

Article 6. Persons who are recognized veterans of work

Veterans of work citizens who worked at the companies, are recognized organizations, the organizations, associations of citizens, physical persons, have length of service of 40 years - for men and 35 years - for women and retired.

Veterans of work are recognized also:

a) citizens who are granted pensions on favorable terms:

according to the list No. 1 of productions, works, professions, positions and indicators at underground works, at works with especially harmful and especially severe conditions of work in which employment full time grants pension entitlement on age on favorable terms - in the presence of length of service at women - 25 years and men have 30 years;

according to the list No. 2 of productions, works, professions, positions and indicators with harmful and severe conditions of work in which employment full time grants pension entitlement on age on favorable terms - in the presence of length of service at women - 30 years and men have 35 years;

according to the Items "in" - "z" Article 13 and article 52 of the Law of Ukraine "About provision of pensions" - in the presence of length of service at women - 30 years and at men are 35 years;

according to part one of article 18 of the Law of Ukraine "About provision of pensions" - in the presence of length of service at women - 25 years and at men are 30 years;

b) the pensioners awarded with the medal "Veteran of Work" by the legislation of the former USSR;

c) persons with disability of I and II groups receiving disability pensions if they have length of service at least 15 years.

Article 7. Privileges to veterans of work

The following privileges are provided to veterans of work:

1) use in case of retirement or change of place of employment polyclinics to which they were attached still to place of employment;

2) first-priority free prosthetic dentistry (except for prosthetics from precious metals) provided that the size of average monthly comprehensive income of family counting on one person for the last six months does not exceed the size of the income which grants the right to tax social benefit according to the procedure, determined by the Cabinet of Ministers of Ukraine;

3) the privilege to providing with sanatorium treatment, and also to compensation of cost of independent sanatorium treatment according to the procedure and the sizes determined by the Cabinet of Ministers of Ukraine;
