About mobilization preparation and mobilization

This Law establishes the legal basis of mobilization preparation and mobilization in Ukraine, determines the principles of the organization of this work, power of public authorities, other state bodies, local government bodies, and also obligations of the companies, organizations and organizations irrespective of pattern of ownership (further - the companies, organizations and the organizations), powers and responsibility of officials and obligation of citizens by implementation of mobilization actions.

Section I. General provisions

Article 1. Determination of the main terms

In this Law the stated below terms are used in the following value:

mobilization preparation - complex of the organizational, political, economic, financial, social, legal and other actions performed in peace time for the purpose of the preparation of national economy, public authorities, other state bodies, local government bodies, the Armed Forces of Ukraine formed according to the laws of Ukraine of other military forming, and also law enforcement agencies of special purpose, Public service of special communication and information security of Ukraine and the Public special service of transport (further the Armed Forces of Ukraine, other military forming), forces of civil protection, the companies, organizations and the organizations to timely and organized carrying out mobilization and requirements satisfaction of defense of the state and protection of its territory against possible aggression, ensuring life activity of the population during the special period;

management system mobilization preparation - the component of general management system the state directing activities of public authorities, other state bodies, local government bodies, single state system of civil protection to preparation of management systems, means of communication, information support, and also financial and material resources, the companies, organizations and organizations for carrying out mobilization;

mobilization complex of the actions performed for the purpose of systematic transfer of national economy, activities of public authorities, other state bodies, local government bodies, the companies, organizations and the organizations into functioning in the conditions of the special period, and the Armed Forces of Ukraine, other military forming, forces of civil protection - on the organization and the States of wartime. Mobilization can be general or partial and is carried out openly or is hidden;

the special period - the period of functioning of national economy, public authorities, other state bodies, local government bodies, forces of defense and security forces, companies, organizations and organizations, and also accomplishment by citizens of Ukraine of the constitutional debt on protection of the Fatherland, independence and territorial integrity of Ukraine which comes from the moment of the announcement of the decision on mobilization (except target) or finishing it to contractors of rather hidden mobilization or from the moment of introduction of warlike situation in Ukraine or in its certain areas and covers mobilization time, wartime and time of demobilization after the end of military operations;

demobilization - complex of actions, the decision on procedure and which terms of carrying out the President of Ukraine accepts, directed to systematic transfer of national economy, public authorities, other state bodies, local government bodies, companies, organizations and organizations into work and functioning in the conditions of peace time, and the Armed Forces of Ukraine, other military forming, forces of civil protection - on the organization and the States of peace time;

the mobilization plan set of the documents determining content, amounts, contractors, procedure and terms of implementation of actions for mobilization expansion of the Armed Forces of Ukraine, other military forming, forces of civil protection, transfer of national economy, activities of public authorities, other state bodies, local government bodies, the companies, organizations and the organizations, systems of ensuring life activity of the population on functioning in the conditions of the special period;

mobilization tasks (orders) - separate requirements of the mobilization plan for the nomenclature, production volumes of necessary products, education and preparation for expansion of special forming, and also priority actions of mobilization preparation approved in accordance with the established procedure which are led up for accomplishment to central and local executive bodies, other state bodies, Council of Ministers of the Autonomous Republic of Crimea, local government bodies. To the companies, organizations and the organizations which are involved in accomplishment of mobilization tasks (orders) mobilization tasks (orders) are led up based on the approved main indicators of the mobilization plan and agreements (contracts) which are signed according to the procedure, stipulated by the legislation;

special forming - formed in peace time according to the procedure, established by the Cabinet of Ministers of Ukraine, the companies, organizations and the organizations according to states and sheets to states automobile, aviation, water, railway, medical and other forming which after the corresponding preparation are transferred in case of mobilization in accordance with the established procedure to the Armed Forces of Ukraine, other military forming for satisfaction of their requirements and also formed by the relevant central executive bodies - for ensuring requirements of industries of national economy;

the main indicators of the mobilization plan - the settlement needs of the state for the special period created in natural and cost calculation for requirements satisfaction of the Armed Forces of Ukraine, other military forming, forces of civil protection, ensuring functioning of national economy and system of ensuring life activity of the population;

mobilization capacities - production capacities of the companies, organizations and organizations which are created in peace time for production and satisfaction of other needs of the state during the special period. Mobilization capacities are not subject to privatization, including in case of liquidation of the companies, organizations, organizations. Decisions on transfer of mobilization capacities to other companies, organizations and organizations are accepted by executive bodies, other state bodies according to the procedure, determined by the Cabinet of Ministers of Ukraine;

the notification finishing of signals and messages (directives, orders) to bodies of military management, central and local executive bodies, local government bodies, the companies, organizations, the organizations and the population about the announcement of mobilization, challenge of citizens in the territorial centers of completing and social support, and also delivery (sending) of the agenda to citizens;

system of military accounting set of systems of military accounting of the public authorities, other state bodies, local government bodies, Armed Forces of Ukraine, other military forming, forces of civil protection, the companies, organizations and organizations which are structurally consisting of heads as organizers of conducting military accounting, services of personnel (officials) who are directly keeping military account, objects of military accounting - recruits, persons liable for call-up, reservists and the automation equipment of processes of conducting military accounting with use of necessary databases (registers) determined by this Law and other laws of Ukraine;

the partial job specification - the administrative document of the chairman of local public administration in which are established during mobilization for heads of the companies, organizations and the organizations of all patterns of ownership, and also subjects of managing of any form of business and pattern of ownership of task on transfer to the Armed Forces of Ukraine, other military forming of certain vehicles and the special equipment, collection points and terms of transfer.

Article 2. Legal basis of mobilization preparation and mobilization

The legal basis of mobilization preparation and mobilization is the Constitution of Ukraine, the Law of Ukraine "About defense of Ukraine", this and other laws of Ukraine, and also regulatory legal acts published according to them.

Article 3. Basic principles and content of mobilization preparation and mobilization

1. Mobilization preparation and mobilization are components of complex of the actions performed for the purpose of ensuring defense of the state, except for target mobilization.

2. Mobilization preparation and mobilization are performed on the basis of the following principles:

centralized management;

advance time;

planned character;

complexity and coordination;

the personal responsibility for accomplishment of actions for mobilization preparation and mobilization;

observance of the rights of the companies, organizations and organizations and citizens;

the guaranteed sufficiency;

scientific justification;

financial security.

3. Content of mobilization preparation constitutes:

legal regulation in the field of mobilization preparation and mobilization;

scientific and methodical ensuring mobilization preparation and mobilization;

determination of conditions of activities and preparation of public authorities, other state bodies, local government bodies of the companies, organizations and organizations for work in the conditions of the special period;

development of mobilization plans, long-term and annual programs of mobilization preparation;

preparation of the Armed Forces of Ukraine, other military forming for carrying out mobilization;

preparation of national economy and its industries for transfer and functioning in the conditions of the special period;

preparation of single state system of civil protection for functioning in the conditions of the special period;

creation, development and content of mobilization capacities for requirements satisfaction of the state during the special period;

education and preparation for expansion of special forming;

creation of mobilization reserve;

creation and content of insurance fund of project, design and technological documentation on products of mobilization and defense appointment;

preparation and content in proper condition the equipment and objects intended for transfer in case of mobilization to the Armed Forces of Ukraine, other military forming;
