About providing the equal rights and opportunities of women and men

The purpose of this Law is achievement of parity provision of women and men in all spheres of activity of society by legal support of the equal rights and opportunities of women and men, liquidation of discrimination on bases of sex and application of the special temporary measures directed to elimination of imbalance between opportunities of women and men to exercise the equal rights granted to them by the Constitution and the laws of Ukraine.

Section I. General provisions

Article 1. Determination of terms

In this Law the stated below terms are used in the following value:

the equal rights of women and men - lack of restrictions or privileges on the bases of sex;

equal opportunities of women and men - equal conditions for realization of the equal rights of women and men;

discrimination on the basis of floor - situation in case of which person and/or group of persons on the bases of sex which were is and can be valid or presumable, experiences restrictions in recognition, realization or use of the rights and freedoms or privileges in any form established by the Law of Ukraine "About bases of prevention and counteraction of discrimination in Ukraine" except cases when such restrictions or privileges have lawful, objectively reasonable purpose which methods of achievement are proper and necessary;

positive actions - special temporary measures which have the lawful, objectively reasonable purpose directed to elimination of legal or actual inequality in opportunities for women and men on realization of the rights and freedoms established by the Constitution and the laws of Ukraine;

sexual harassments - the actions of sexual nature expressed verbally (threats, intimidations, indecent notes) or physically (touches, pats), degrading or offending the faces consisting in the relations of labor, office, material or other subordination;

violence on the basis of sex - the actions directed against persons through their floor, or customs or traditions, widespread in society (stereotypic ideas of social functions (provision, obligations, etc.) of women and men), or acts which touch mainly faces of the defined sex or affect them disproportionately which put physical, sexual, psychological or economic damage or sufferings, including threats of such actions, in public or private life;

person which was affected by violence on the basis of sex (further - injured person) - person who underwent to violence on the basis of sex;

the child who was affected by violence on the basis of sex - person who did not reach eighteen-year age and underwent to violence on the basis of sex or became the witness (eyewitness) of such violence;

the offender - person who committed violence on the basis of sex;

the child offender - the person who did not reach eighteen-year age and committed violence on the basis of sex;

prevention of violence on the basis of sex - system of the measures performed by executive bodies, local government bodies, the companies, organizations and the organizations, and also the citizens of Ukraine, foreigners and stateless persons which are in Ukraine on the legal causes directed to increase in level of awareness of society on violence on the basis of sex, its reasons and consequences on forming of the intolerant relation to violence on the basis of sex, eradication of discrimination ideas of social roles and obligation of women and men, and also any customs and traditions which are based on them;

counteraction to violence on the basis of sex - system of the measures performed by executive bodies, local government bodies, the companies, organizations and the organizations, and also the citizens of Ukraine, foreigners and stateless persons which are in Ukraine on the legal causes directed to the termination of violence on the basis of sex, assistance and ensuring protection of injured person and receipt of compensation of damage by it and also on proper investigation of cases of violence on the basis of sex, accountability of offenders and change of their behavior;

risks assessment - assessment of reliability of continuation or repeated making of violence on the basis of sex, approach of heavy or especially heavy consequences of its making, and also the death of injured person;

the program for injured person - package of measures, directed to deprivation of emotional dependence, uncertainty in themselves and on forming at injured person of capability to defend own advantage and to protect the rights, including by means of authorized bodies of the government, local government bodies;

the program for the offender - package of measures, the new, not aggressive psychological behavior model constituted on the basis of risks assessment and directed to change of violent behavior of the offender and forming at it, responsible attitude to the acts and their consequences, on eradication of discrimination ideas of social roles and obligation of women and men;
