About improvement of settlements

 This Law determines legal, economic, ecological, social and organizational basis of improvement of settlements and is directed to creation of the conditions favorable for life activity of the person.

Section I General provisions

Article 1. Determination of terms

1. In this Law the stated below terms are used in the following value:

improvement of settlements - complex of works on engineering protection, clearing, drainage and gardening of the territory, and also social and economic, organization-legal and ecological actions for improvement of microclimate, sanitary cleaning, decrease in noise level and another, performed in the territory of the settlement for the purpose of its rational use, proper maintenance and protection, creation of conditions on protection and recovery of the environment, favorable for life activity of the person;

the territory - set of the parcels of land used for placement of subjects to improvement of settlements: parks, squares, boulevards, streets, lanes, descents, drives, roads, squares, maidans, embankments, the house adjoining territories, beaches, cemeteries, recreational, improving, educational, sporting, historical and cultural facilities, objects of the industry, utility and warehouse and other objects within the settlement;

content in proper condition the territories - its use to destination according to the master plan of the settlement, other town-planning documentation, rules of improvement of the territory of the settlement, and also sanitary cleaning of the territory, its gardening, preserving and recovery of subjects to improvement;

street road net - the network of streets, roads intended for movement of vehicles and pedestrians, intra quarter and other drives, sidewalks, walking and bicycle paths, embankments, the areas, and also parkings and platforms for the parking, vehicles with engineering and auxiliary constructions, technical means of the organization of traffic;

actions for improvement of settlements - works on recovery, proper maintenance and rational use of the territories, protection and the organization of streamlining of subjects to improvement taking into account features of their use.

green plantings - wood, shrubby, flower and grass vegetation of natural and artificial origin in certain territory of the settlement.

Article 2. Purpose of improvement of settlements

1. Improvement of settlements provides:

1) development and implementation of effective and complex actions for content of the territories of settlements in proper condition, to their sanitary cleaning, preserving common use facilities, and also natural landscapes, other natural complexes and objects;

2) organization of proper maintenance and rational use of the territories, buildings, engineering constructions and subjects to recreational, nature protection, improving, historical and cultural and other appointment;

3) creation of conditions for realization of the rights and accomplishment of obligations by subjects in the field of improvement of settlements.

Article 3. System of improvement of settlements

1. The system of improvement of settlements includes:

1) management in the field of improvement of settlements;

2) determination of subjects and objects in the field of improvement of settlements;

3) organization of improvement of settlements;

4) regulation in the field of improvement of settlements;

5) financial provision of improvement of settlements;

6) implementation of the state, self-controlled and public control in the field of improvement of settlements;

7) establishment of responsibility for violation of the legislation in the field of improvement of settlements.

Article 4. The legislation concerning improvement of settlements

1. The legislation concerning improvement of settlements consists of this Law, other laws and regulatory legal acts governing the relations in this sphere.

2. Operation of this Law extends to the relations arising in the field of improvement of settlements and goes for creation of the environment, favorable for life activity of the person, preserving and protection of the surrounding environment, ensuring sanitary and epidemic wellbeing of the population.

The Section II Management in the field of improvement of settlements

Article 5. Governing bodies in the field of improvement of settlements

1. Control in the field of improvement of settlements is exercised by the Cabinet of Ministers of Ukraine, the central executive body providing forming of state policy in the field of housing and communal services, Council of Ministers of the Autonomous Republic of Crimea, local public administrations, local government bodies and other authorities within their powers.

Article 6. Powers of the Cabinet of Ministers of Ukraine in the field of improvement of settlements

1. In the field of improvement of settlements treats powers of the Cabinet of Ministers of Ukraine:

1) ensuring realization of state policy in this sphere;

2) development and ensuring accomplishment of nation-wide programs of improvement of settlements;

3) coordination of activities of the central executive bodies in the field of improvement.
