About bodies of self-organization of the population

Section I. General provisions

Article 1. Law purpose

This Law determines legal status, procedure for the organization and activities of bodies of self-organization of the population.

Article 2. The main terms used in this Law

The main terms used in this Law have the following value:

bodies of self-organization of the population - the representative bodies created by inhabitants who on legal causes live in the territory of the village, the settlement, the city or their parts, for the solution of the tasks provided by this Law;

Article 3. Concept of body of self-organization of the population

1. The body of self-organization of the population is one of forms of participation of members of territorial bulks of villages, settlements, cities, areas in the cities in the solution of single questions of local value.

2. Bodies of self-organization of the population are house, street, quarter committees, committees of residential districts, committees of areas in the cities, rural, settlement committees.

3. The main objectives of bodies of self-organization of the population are:

1) creation of conditions for participation of inhabitants in the solution of questions of local value within the Constitution and the laws of Ukraine;

2) satisfaction of social, cultural, household and other needs of inhabitants by assistance in rendering the corresponding services to them;

3) participation in realization of social and economic, cultural development of the corresponding territory, other local programs.

Article 4. Legislation on bodies of self-organization of the population

1. Bodies of self-organization of the population act on the basis of the Constitutions of Ukraine, the present and other laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, central and local executive bodies (and in the Autonomous Republic of Crimea - also regulatory legal acts of the Verkhovna Rada of the Autonomous Republic of Crimea and decisions of Council of Ministers of the Autonomous Republic of Crimea), decisions of relevant organs of local self-government, decisions of local referendum, charters of territorial bulks, orders rural, settlement, the mayor, the chairman district in the city (in case of its creation) council, published within the powers, regulations on bodies of self-organization of the population, decisions of meeting (conference) of inhabitants at the place of residence, them chosen.

2. The body of self-organization of the population formed with the permission of district council in the city is guided in the activities also by decisions of city council and its executive body.

Article 5. Principles of the organization and activities of body of self-organization of the population

The organization and activities of body of self-organization of the population are based on the principles:

1) legality;

2) publicity;

3) voluntariness concerning capture of separate powers rural, settlement, city, district in the city (in case of its creation) council;

4) territorialities;

5) selectivities;

6) accountabilities, submission to control and responsibility to the relevant councils;

7) accountabilities, submission to control and responsibility to the inhabitants who elected body of self-organization of the population;

8) financial and organizational independence.

Article 6. The right of inhabitants to choose and be elected to body of self-organization of the population

1. Choose and be elected to body of self-organization of the population according to the procedure, determined by this Law, the inhabitants on legal causes living in the corresponding territory can.

2. Any restrictions of the right of the inhabitants living in the corresponding territory for participation in relevant organ of self-organization of the population depending on their race, skin color, political, religious and other convictions, floor, ethnic and social origin, property condition, language or other signs are forbidden.

Article 7. The territory within which the body of self-organization of the population is effective

1. The body of self-organization of the population is created on territorial sign.

2. Part of the territory of the village, settlement, city, area in the city within which the inhabitants who elected this body live can be the territory within which the body of self-organization of the population is effective.

3. The territory within which the body of self-organization of the population is effective is determined by the decision of council which granted permission for creation:

a) rural, settlement committee - within the territory of the village, the settlement if its limits do not match limits of activities of village, settlement council;

b) street, quarter committee - within the territory of quarter, several, one or part of the street with adjacent lanes in places of individual building;

c) committee of the residential district - within the territory of the certain residential district, the housing and operational organization in the cities;

d) house committee - within the house (several houses) in the state and public housing stock and fund of housing co-operatives;

d) committee of the area in the city - within one or several areas in the city if its borders do not match borders of activities of district council in the city.

Section II. Procedure for creation of bodies of self-organization of the population

Article 8. Procedure for initiation of creation of body of self-organization of the population

1. With initiative about creation of body of self-organization of the population in rural, settlement, city, district in the city (in case of its creation) council can address meeting (conference) of inhabitants at the place of residence under condition if participated in it at least a half of the inhabitants of the corresponding territory having the right to vote (was provided).

At meeting (conference) of inhabitants at the place of residence also initiative group which members will represent the interests of inhabitants - participants of the meeting (conference) in the relevant local council is chosen.

2. The decision of meeting (conference) is made by a majority vote his participants.
