This Federal Law establishes the principles of implementation of state policy, the legal basis of activities of public authorities of the Russian Federation in the field of export control, and also determines the rights, obligations and responsibility of participants of foreign economic activity.

Chapter I. General provisions

Article 1. Basic concepts

For the purposes of this Federal Law the following basic concepts are used:

foreign economic activity - the foreign, investing and other trade activity, including production cooperation, in the field of the international exchange of goods, information, works, services, results of intellectual activities (the rights to them);

export control - package of measures, providing realization established by this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation of procedure of foreign economic activity concerning goods, information, works, services, results of intellectual activities (the rights to them) which can be used during creation of weapons of mass destruction, means of its delivery, other types of arms and military equipment or by preparation and (or) making of acts of terrorism;

the internal program of export control - the actions of organizational, administrative, information and other nature performed by the Russian participants of foreign economic activity for the purpose of observance of rules of export control;

weapons of mass destruction - nuclear, chemical, bacteriological (biological) and toxin weapon;

delivery systems - the rockets and unmanned aerial vehicles capable to deliver weapons of mass destruction;

products which are especially dangerous regarding preparation and (or) making of acts of terrorism - technical devices or the poisonous, poisoning, explosive, radioactive or other materials which in case of their use by preparation and (or) making of acts of terrorism create real threat of life or to human health, causings significant property damage or approach of other heavy effects the, including heavy effects comparable to effects of use of weapons of mass defeat. Only objects of the civil laws which are in accordance with the legislation of the Russian Federation limited in turnover can belong to the specified products or are received as a result of scientific and technical, productive or other economic activity which implementation requires special permission (license);

controlled goods and technologies - raw materials, materials, the equipment, scientific and technical information, works, services, results of intellectual activities (the right to them) which owing to the features and properties can make essential contribution to creation of weapons of mass destruction, means of its delivery, other types of arms and military equipment, and also products which are especially dangerous regarding preparation and (or) making of acts of terrorism;

the Russian participants of foreign economic activity (Russian persons) - performing foreign economic activity or performing import to the Russian Federation and export from the Russian Federation of goods, information, results of intellectual activities (the rights to them) the legal entities created in accordance with the legislation of the Russian Federation and the physical persons who are citizens of the Russian Federation or foreign citizens who received the residence permit in the Russian Federation including the physical persons registered as individual entrepreneurs in accordance with the legislation of the Russian Federation;

foreign persons are legal entities and the organizations in other form of business which civil legal capacity is determined by the right of foreign state in which they are founded; physical persons which civil legal capacity and civil capacity to act are determined by the right of foreign state which citizens they are, and stateless persons which civil capacity to act is determined by the right of foreign state in which these persons have the permanent residence;

the mode of license-free export of separate types of controlled goods - form of implementation of foreign economic activity in case of which export from the Russian Federation of certain group or the nomenclature of controlled goods of the Russian origin does not require receipt of the licenses provided by this Federal Law.

Article 2. Scope of this Federal Law

This Federal Law governs the relations of public authorities of the Russian Federation and the Russian participants of foreign economic activity when implementing export control.

Operation of this Federal Law extends to foreign economic activity concerning goods, information, works, services, results of intellectual activities (the rights to them) which can be used during creation of weapons of mass destruction, means of its delivery, other types of arms and military equipment or by preparation and (or) making of acts of terrorism, regarding implementation of export control for the purpose of, established by this Federal Law.

Export control concerning arms and military equipment, and also information, works, services, results of intellectual activities (the rights to them) who are military products is performed in accordance with the legislation of the Russian Federation in the field of military and technical cooperation.

Article 3. The legislation of the Russian Federation in the field of export control

The legislation of the Russian Federation in the field of export control is based on the Constitution of the Russian Federation and consists of this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation accepted according to them.

Questions of ensuring export control are under exclusive authority of the Russian Federation.

Article 4. Purposes of export control

Main objectives of export control are:

protection of interests of the Russian Federation;

implementation of requirements of international treaties of the Russian Federation in the field of nonproliferation, means of its delivery, and also in the field of export control of products of military and dual purpose;

creation of conditions for integration of economy of the Russian Federation into world economy;
