About approval of the Instruction about maintaining the State register of transactions
1. Approve the Instruction about maintaining the State register of transactions which is attached.
2. Determine that statements from the State register of transactions are issued with use of special forms of documents of registers of information system of the Ministry of Justice of Ukraine.
3. Determine that the expenses connected with the organization of production and delivery of forms are performed at the expense of the state company "Information center" of the Ministry of Justice of Ukraine.
4. To department for civil status of citizens and notariate (Pavlova L. M.), to the state company "Information center" of the Ministry of Justice of Ukraine (Dobzhansky V. B.):
submit this order on state registration according to the Presidential decree of Ukraine of 03.10.92 of N493/92 "About State Registration of Regulatory Legal Acts of the Ministries and Other Executive Bodies" (with changes);
bring the order to permission of chiefs of Head department of justice of the Ministry of Justice of Ukraine in the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city justice departments, regional branches of the state company "Information center" of the Ministry of Justice of Ukraine and provide its proper application in work.
5. To chiefs of Head department of justice of the Ministry of Justice of Ukraine in the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city justice departments to bring this order to permission district, district in the cities, city (the cities of regional value) justice departments and notaries and to provide control of its proper application.

1.2. State registration of the transaction is carried out by the registrar by entering of the relevant information into the State register of transactions along with its notarial certificate. About entering of record into the State register of transactions the registrar issues to each person who received copy of the transaction or to persons authorized by them, the statement from the State register. In the case of the notary who certified the transaction there is statement about registration which is made by the registrar free of charge with use of the special form of documents of registers of information system of the Ministry of Justice of Ukraine.
1.3. In this Instruction the terms below are used in such value:
The state register of transactions (further - the Register) - the single computer database which contains information on the transactions which are subject to state registration provides its storage, issue and protection against unauthorized access;
the request is document the established holder Reestra of form which the party of the transaction or person authorized by it files the registrar and based on which the statement is created of Reestr;
registration number of real estate object - number provided during registration to real estate object in the corresponding State register;
the sequence number is unique identifier of record about the transaction (registration number) provided during registration in the Register.
2.1. The notaries who do not have access to the single computer database of the Register send copy of the transaction and its copy to registrar which in day of receipt of documents enters the corresponding record in the Register.
About entering of record into the Register the registrar sends to the notary the statement about registration and copy of the transaction. The copy of the transaction remains in cases of the registrar.
3.1. If the real estate object concerning which the transaction is made has registration number or the address, these data are entered in the Register in the Section "Real estate".
If the real estate object has no registration number or the address, data concerning such object are entered in the Section "Uncertain Property".
3.2. The Section "Real estate" contains:
subsection "Parcels of land";
subsection "Other Property";
Object Address block.
Filling of one subsection excludes possibility of filling of another.
3.3. The subsection "Constructions" contains such fields:
"Number on RPVN";
"Amendments to property type".
3.3.1. The field "Number on RPVN" is filled in the presence of information. If such number exists and it is known to the registrar, in case of its input data on this object are automatically displayed.
3.3.2. The field "Property Type" contains such fields: "House", "The garden house", "Non-residential premise", "Household", "Room", "The non-residential building", "Apartment", "Garage", "Complex", "Another". It is possible to choose only one type of object from this list.
3.3.3. In the field "Amendments to Property Type" are specified the data specifying object type. For example, if subject of the transaction is the Silpo shop located in the apartment house, then in the Object Type qualifier "Non-residential premise" is specified, and in the field "Additional Data concerning Object Type" the Silpo Shop is specified ".
3.4. The subsection "Parcels of land" contains such fields:
"Registration number of the parcel of land";
"Type of the parcel of land" (contains fields: "Parcel of land" and "Parcel of land of agricultural purpose");
"Amendments to type of the parcel of land".
The subsection is filled only concerning the parcels of land.
3.5. In the Section "Uncertain Property" information on object is specified (in any form). For example, if subject of the transaction is object of construction in progress, in the subsection "Uncertain Property" information on the number of rooms, the planned area, the floor, number (or the name) the building site, the name of the construction organization, the developed land and so forth is brought.
3.6. In the field "Additional Data" information on the technical description on property and other characteristics of object, for example the number of rooms, the square, depreciation degree and so forth is entered.
Search of object in the signs specified in the subsection "Uncertain Property" is not provided.
4.1. Issue of the duplicate of the transaction which is stored in cases of office of notary public or the private notary is the basis of entering of record into the Register.
