About quality and safety of foodstuff

This Federal Law governs the relations in the field of catering services, quality assurances of foodstuff and their safety for health of the person and future generations.

Chapter I. General provisions

Article 1. Basic concepts

For the purpose of this Federal Law the following basic concepts are used:

foodstuff (food products, food products, food) (further - foodstuff) - products of animal, vegetable, microbiological, mineral, artificial or biotechnological origin in the natural, processed or processed type which are intended for the use by the person in food, including specialized food products, the drinking water which is packed up in reservoir, drinking mineral water, alcoholic products (including beer and drinks on the basis of beer), soft drinks, dietary supplements to food, chewing gum, ferments and starting cultures of microorganisms, yeast, nutritional supplements and fragrances, and also food staples;

healthy food - food which daily diet is based on the principles established by this Federal Law meets safety requirements and creates conditions for physical and intellectual development, activity of the person and future generations;

hot meals - healthy food which provides availability of hot first and second dishes or second course depending on meal, according to sanitary and epidemiologic requirements;

quality of foodstuff - set of characteristics of the safe foodstuff meeting the requirements established in accordance with the legislation of the Russian Federation, to terms of the contract, sample, documents on standardization, the technical documentation determining their consumer properties, nutrition value, authenticity, grade (caliber, category and other), and satisfying physiological needs of the person;

the materials and products contacting to foodstuff (further - materials and products), - the materials and products applied to production, packaging, storage, transportations, realization and use of foodstuff including processing equipment, devices and devices, container, ware, dining facilities;

the address of foodstuff, materials and products - production (production), packaging, realization, storage, transportations and use of foodstuff in the territory of the Russian Federation;

nutrition value of foodstuff - the consumer property of foodstuff characterizing availability and amount of physiological needs of the person, necessary for satisfaction, of the feedstuffs (nutrients) constituting them and energy value;

consumer properties of foodstuff - set of physical and chemical indicators (the normalized physical and chemical characteristics of specific types of foodstuff), organoleptic indicators (the characteristics determined by means of visual, flavoring, olfactory, touch, somatosensorny systems), microbiological indicators (the characteristics determining content of pro-biotic and (or) technological microorganisms in manifest quantities);

grade (caliber, category and other) - consumer properties of separate types of foodstuff which allow to classify (to calibrate, establish category and other) foodstuff on the physical and chemical, organoleptic, microbiological indicators containing in technical documentation;

shipping documents - the documents providing opportunity documentary to establish the previous and subsequent owners of foodstuff, except for consumers, and also the foodstuff accompanied with these documents allowing to identify;

counterfeited foodstuff, materials and products - foodstuff, materials and products which are intentionally changed (counterfeit) and (or) have the hidden properties and quality and (or) information on which is obviously incomplete and (or) doubtful;

the physiological need for foodstuff - evidence-based regulations of consumption of foodstuff in case of which consumption physiological needs of the person for necessary substances are completely satisfied.

Article 2. Legal regulation of the relations in the field of quality assurance and safety of foodstuff

Legal regulation of the relations in the field of quality assurance and safety of foodstuff is performed by this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation accepted according to them, and also the laws and other regulatory legal acts of subjects of the Russian Federation.

The principles of healthy food are the basic rules and provisions promoting strengthening of health of the person and future generations, decrease in risk of development of diseases and including:

ensuring priority of protection of life and health of consumers of foodstuff in relation to economic interests of the individual entrepreneurs and legal entities performing the activities connected with the address of foodstuff;
