About legal regime of the territory which underwent to radioactive pollution as a result of the Chernobyl catastrophic crash
The Chernobyl catastrophic crash created radiation situation extremely hazardous to health of people and the surrounding environment in the considerable territory of Ukraine. Ukraine is announced by zone of environmental disaster. Elimination of effects of this catastrophic crash depends on legislative determination of legal regime of the territories, different on extent of radioactive pollution, and measures for its providing. The law regulates question of separation of the territory into the corresponding zones, the mode of their use and protection, condition of accommodation and work of the population, economic, research and other activity in these zones. The law fixes and guarantees providing the mode of use and protection of the specified territories for the purpose of reduction of action of radiation exposure by health of the person and by ecological systems.
The territories in which there was permanent environmental pollution radioactive materials over doavariyny level that taking into account the climatic and complex ecological characteristic of the specific territories can lead to radiation of the population over 1,0 mzv (O,1 of rem) in year and which requires taking measures to radiation protection of the population and other special interventions directed to need of restriction of additional radiation of the population caused by the Chernobyl catastrophic crash and ensuring its normal economic activity belong to the territories which underwent to radioactive pollution as a result of the Chernobyl catastrophic crash within Ukraine.
Depending on landscape and geochemical features of soils, sizes of exceeding of natural doavariyny level of accumulating of radionuclides in the environment, the related degrees of possible negative impact on health of the population, requirements for implementation of radiation protection of the population and other special measures, taking into account the general production and social relations the territory which underwent to radioactive pollution as a result of the Chernobyl catastrophic crash are divided into zones.
Such zones are:
1) exclusion zone is the territory with which evacuation of the population in 1986 is carried out;
2) the zone of unconditional (obligatory) settling out is the territory which underwent intensive pollution by long-living radionuclides with density of pollution of the soil over doavariyny level caesium isotopes from Ki/sq.km 15,0 above, or strontium from Ki/sq.km 3,0 above, or plutonium from Ki/sq.km 0,1 above where the settlement effective equivalent dose of radiation of the person taking into account coefficients of migration of radionuclides in plants and other factors can exceed 5,0 mzv (0,5 of rem) in year over dose which he received during the doavariyny period;
3) the zone of the guaranteed voluntary settling out is the territory with density of pollution of the soil over doavariyny level caesium isotopes from 5,0 to Ki/km 15,0 2, or strontium from 0,15 to Ki/km 3,0 2, or plutonium from 0,01 to Ki/km 0,1 2, where settlement effective equivalent dose of radiation of the person taking into account coefficients of migration of radionuclides in plants and other factors can exceed 1,0 mzv (0,1 of rem) in year over dose which he received during the doavariyny period;
4) ceased to be valid according to the Law of Ukraine of 28.12.2014 No. 76-VIII.

Borders of these zones are established and reviewed by the Cabinet of Ministers of Ukraine on representation of the central executive body on forming and ensuring realization of state policy in the field of protection of the surrounding environment in coordination with National academy of Sciences, the central executive bodies, agricultural industry and concerning food security of the state, safety of use of nuclear energy, to management of exclusion zone and zone of unconditional (obligatory) settling out, on the basis of expert conclusions.
The list of the settlements carried to zones of radioactive pollution, and this annual dosimetric pasportization with indication of the expected doses of radiation of the population will be promulgated by the Cabinet of Ministers of Ukraine once in three years, since 2009.
Cards of the specified zones, the list of the settlements carried to these zones and data of annual dosimetric pasportization with indication of the expected doses of radiation of the population once in three years are published in nation-wide and regional printing mass media and stored in corresponding central and local executive bodies. and also are provided on demand according to the Law of Ukraine "About access to public information".
Radiation dangerous lands are lands on which further accommodation of the population, receipt of agricultural and other products, the food answering to republican and international admissible levels of content of radioactive materials or which it is inexpedient to use on ecological conditions is impossible.
The territories specified in Items 1 and 2 of article 2 of this Law belong to the lands specified in this Article.
It is radioactive contaminated land - it is the lands requiring carrying out measures of radiation protection and other special interventions directed to restriction of the additional radiation caused by the Chernobyl catastrophic crash and ensuring normal economic activity.
The territories specified in Item 3 parts two of article 2 of this Law belong to the lands specified in this Article.
Ukraine determines legal regime of the zones which underwent to radioactive pollution as a result of the Chernobyl catastrophic crash, signs agreements on work with other states, the international organizations.
The Cabinet of Ministers of Ukraine determines all economic international activity in exclusion zone. Coordination of works in zones is performed by the central executive body realizing state policy in the field of management of exclusion zone and zone of unconditional (obligatory) settling out.
