About approval of the Instruction about procedure for production, acquisition, storage, accounting, transportation and use of fire, pneumatic, cold and okholoshchenny weapon, and also ammunition to weapon and explosive materials

According to the Law of Ukraine "About militia", the resolution of the Cabinet of Ministers of Ukraine of October 12, 1992 No. 576 "About approval of the Regulations on authorization system", the Regulations on the Ministry of Internal Affairs of Ukraine approved by the Presidential decree of Ukraine of 06.04.2011 No. 383, of the Resolution of the Verkhovna Rada of Ukraine of June 17, 1992. "About the property right to separate types of property" with amendments to it of April 22, 1993 and on January 24, 1995, and also in connection with adoption of other regulations through service of authorization system I ORDER:

1. Approve the Instruction about procedure for production, acquisition, storage, accounting, transportation and use of fire, pneumatic, cold and okholoshchenny weapon, devices of national production for shooting of the cartridges equipped with throwing shells of nonlethal action and cartridges, rubber or similar on the properties, to them and also ammunition to weapon, the main parts of weapon and to explosive materials it (is applied).

2. Structural divisions of the central governing body of National police and the office of the Ministry of Internal Affairs of Ukraine correspond:

2.1. Authorized division on control of traffic in weapons of the central governing body of police (further - TsOUP Unitary Enterprise) on:

ensuring control of observance of procedure on objects of authorization system with fire, pneumatic and cold weapon, and also ammunition to weapon and explosive materials;

implementation of measures concerning their providing the guarding fire alarm with well-tried remedies;

strengthening of control of observance of procedure for production, acquisition, accounting, storage, protection and use of objects and materials to which the authorization system extends;

observance of the rules of the withdrawal, acceptance, accounting and storage withdrawn, which are voluntarily handed over and the found weapon, and also its transfer to control rooms of police agencies;

creation and regular replenishment in each service of card-indexes on duty of owners of fire, pneumatic and cold weapon;

ensuring systematic professional training of workers of authorization system;

coordination of activities of structural divisions of the ministry on this site of work.

2.2. Criminal investigation department, Department of criminal investigation of National police of Ukraine for:

the organization of permanent interaction of field services in work on quick search of weapon, ammunition and explosive materials which are illegally stored, used kidnapped persons earlier;

activity of secret workers, including in places of detention, specialized institutions of militia, on identification of persons who intend to acquire illegally weapon, carrying out concerning them qualified operational and detective actions.

2.3. GSU, atsionalny police of Ukraine for:

timely and high-quality investigation of the criminal cases connected with thefts of weapon, ammunition and explosive materials in their also adverse possession, storage and carrying;

non-admission of cases of the unreasonable termination of such cases and release of the suspected persons from criminal liability.

2.4. GNIEKTs, TsOUP Unitary Enterprise on:

capture on accounting of experimentally shot bullets and sleeves of the withdrawn, voluntarily handed over and found weapon, departmental and office and regular weapon that is stored and used on objects of authorization system, and also cut weapon which stays in property of citizens;

creation of the state pulegilzoteka;

storage of the shot sleeves and bullets.

2.5. Department of property management of National police of Ukraine for:

performance of work concerning accounting, storages, destructions or the realization withdrawn, voluntarily handed over and found weapon; carrying out inventory count of such weapon in warehouses of managements of logistics and material logistics of head departments National polices in the Autonomous Republic of Crimea and the city of Sevastopol, areas and Kiev and in department of special militia;

production of forms of permissions and providing police agencies with them;

2.6. Department of organizational and analytical providing and rapid response of National police of Ukraine for:

ensuring the acceptance, storage and protection by services of the body on duty of National police of Ukraine withdrawn, which is voluntarily handed over and the found weapon; maintaining in each service of card-indexes on duty of owners of fire, pneumatic, cold weapon for the purpose of timely check of the citizens detained for different offenses, and orientation of police squads in case of their departure on the household conflicts and according to statements for crimes.

2.7. Authorized division of National police of Ukraine in the field of safety of traffic for:

control of traffic safety during transportation of dangerous goods, compliance with law in the specified sphere; development and issue in accordance with the established procedure approvals of traffic routes of vehicles during transportation of dangerous goods.

2.8. Department of police of protection of National police of Ukraine for:

providing with means of the guarding alarm system of objects of authorization system, ukomplektovka of divisions of the militarized protection by the staff capable on the business qualities and the state of health to provide reliable protection of these objects.

3.1. 3.2. In a month to organize studying of this Instruction by workers who provide authorization system, staff of classified service of militia, field services, divisions of Public service of protection and state fire protection and investigators. 3.5. Request registration from all workers to whom functions on providing authorization system, high-quality inspection of objects of authorization system, timely identification and withdrawal of hunting fire, pneumatic, cold weapon, and also ammunition to weapon in faces which break procedure for their storage are assigned, uses or systematically allow disorderly conduct, abuse alcoholic drinks or mentally sick.

3.6. 3.7. Take measures to enhancement of operational servicing of objects of authorization system.

3.8. Perform office investigation in each case of theft of firearms, ammunition to it pneumatic and cold weapon of devices of national production for shooting of the cartridges equipped with throwing shells of nonlethal action, explosive materials, rubber or similar on the properties, which stay on the registry of police agencies, and also extraordinary events using the specified under control objects, to establish the reasons and conditions which promoted making of such crimes and events. 3.9. Together with executive bodies and the interested departments to carry out broad work among the population from explanation of regulations which regulate procedure for acquisition, storage, accounting transportation and use, registration (re-registration) of firearms, ammunition to it, pneumatic and cold weapon, explosive materials which fall under action of authorization system of police agencies, and also legislations on responsibility for its violation, using possibilities of the press, radio, television.

3.10. Until the end of 1998 within the extreme number of staff of the Ministry of Internal Affairs, Regional Office of the Ministry of Internal Affairs and available number of divisions of authorization system to create in managements, departments of administrative divisions of militia departments, departments of authorization system and to enter in each territorial subdivision of police of position of inspectors (seniors) of service of authorization system.

3.11. For reception of citizens, representatives of the companies, organizations and the organizations who address concerning authorization system to head departments of National police in the Autonomous Republic of Crimea and the city of Sevastopol, areas and Kiev and territorial authorities of police to allocate separate office offices, to equip them with the guarding fire alarm. 3.12. About results of work on control of traffic in weapons monthly to the 05th following reporting to submit in TsOUP Unitary Enterprise reports in the area of authorization system in the form given in appendix to this order.

4. To the rector of National academy of internal affairs of Ukraine, other higher educational institutions of the Ministry of Internal Affairs of Ukraine to include studying of this Instruction in the training program of cadets and listeners.

5. To impose control of execution of this order on the chief of Head department of classified service of militia of the Ministry of Internal Affairs of Ukraine militia major general Bilokonya M. V.

I. Tasks of police agencies on implementation of authorization system

1. General provisions

1.1. This Instruction determines conditions and procedure for issue and cancellation of permissions to acquisition, storage, accounting, protection, carrying, transportation and use of weapon, devices of national production for shooting of the cartridges equipped with throwing shells of nonlethal action, and cartridges, rubber or similar on the properties, to them, ammunition, other objects, materials and substances on which storage and use special rules, procedure are established and to which action of authorization system, rules of the treatment of them and their application extends.

1.2. The national police of Ukraine will organize work on implementation of authorization system through the structural divisions:

Authorized division on control of traffic in weapons of the central governing body of police (further - TsOUP Unitary Enterprise);

authorized division on control of traffic in weapons and authorization system of head departments of National police in the Autonomous Republic of Crimea and Sevastopol, areas and Kiev (further - GUNP Unitary Enterprise);

the territorial (isolated) subdivisions of police in areas, the cities, areas in the cities (further - territorial subdivisions of police).

It is strictly forbidden to involve workers of authorization system in accomplishment of the tasks which are not provided by their functional obligations.

1.3. The main objectives of police agencies are prevention of violations of procedure for production, acquisition, storage, accounting, protection, transportation and use of firearms, pneumatic weapon of caliber of more 4,5 in mm and speed of flight of bullet more than 100 meters per second (further - pneumatic weapon) and cold weapon (arbalests, onions with effort of tension of bowstring more than 20 kg, hunting knives and so forth (further - cold weapon)), devices of national production for shooting of the cartridges equipped with throwing shells of nonlethal action, rubber or similar on the properties (further - devices), and cartridges to them, the main parts of weapon, and cartridges to them, ammunition to weapon and okholoshchenny weapon, explosive materials and substances, the prevention of cases of their loss, thefts, uses not to destination and with the illegal purpose.

1.4. Police agencies perform control of observance by officials of the ministries and other central executive bodies, the companies, organizations, the organizations and citizens of rules of authorization system by inspection of such objects, approvals of the conclusion of the employment contracts on performance of works connected with production, acquisition, storage, accounting, protection, transportation and use of specially certain objects and materials, holding preventive actions for the prevention and the termination of abuses of regulations of authorization system, and also to involvement of persons who made offense to responsibility according to the procedure, established by the law.

1.5. Reception of citizens, representatives of the companies, organizations and the organizations in police agencies is performed according to established procedure at least three weekly - in the working days and on one of the weekend. Reception of citizens and representatives of the companies, organizations, the organizations is registered in the book of accounting of reception of citizens, representatives of the companies, organizations, the organizations for authorization system (appendix 1).

1.6. All activities of police agencies concerning implementation of authorization system are based on strict observance of the Constitution of Ukraine and other regulatory legal acts.

2. Issue of permissions to acquisition, storage, transportation and use of firearms, ammunition to it, cold weapon, devices and cartridges to them, pneumatic weapon, explosive materials and substances, opening and functioning of objects of authorization system

2.1. Performing authorization system, police agencies according to the legislation of Ukraine issue to the ministries and other central executive bodies, the companies, organizations, the organizations, subjects of managing performing activities for production, repair, trade not in military firearms, ammunition to it, cold and okholoshchenny weapon, pneumatic weapon of caliber over 4,5 in mm and speed of flight of bullet over 100 m/s; to production of the special means loaded with substances tear and irritant action, individual protection, active defense and their sale (further - subjects of managing), permissions to acquisition, storage, transportation (through customs border of Ukraine, on the territories of Ukraine, transit through the territory of Ukraine) and use of firearms, ammunition to it, the main parts of weapon, cold weapon, okholoshchenny weapon, pneumatic weapon; devices and cartridges to them; explosive materials and substances; on opening and functioning of storages, warehouses and bases where they are stored, shooting shooting galleries and shooting ranges, hunting-sports stands, and also the companies and workshops for production and repair of fire and cold weapon, pyrotechnic workshops, Items of studying of equipment of weapon, special means, rules of the treatment of them and to their application, shops in which sale of weapon and ammunition to it is performed of devices and cartridges to them (further - objects of authorization system); to citizens - permissions to acquisition, storage and carrying fire hunting weapon, cold, okholoshchenny, pneumatic weapon, devices.

2.2. Forms of permissions (appendices 2-8, 42) shall be stored in divisions of authorization system in the places excluding access for strangers to them.

The form of permission to the right of storage and carrying weapon is produced according to the forms determined in appendix 5 or appendix 42, at choice of the applicant.

Effective period of permissions:

on production, storage and use of objects, materials and substances, opening and functioning of the companies, workshops and laboratories to which the authorization system which are issued addressed to heads of the companies, organizations and organizations, and also to citizens - 3 years extends;

on acquisition and transportation of these objects, materials and substances - up to 3 months;

on acquisition of explosive materials - up to 6 months.

acquisition in Ukraine and transportation through customs border of Ukraine (in 5 days prior to transportation) firearms, pneumatic, cold, okholoshchenny weapon, ammunition to weapon, the main parts of weapon, devices and cartridges to them foreigners in coordination with foreign diplomatic representations of the countries which citizens they are, transportation them through customs border of Ukraine, transit through the territory of Ukraine of firearms, ammunition to it of the main parts of weapon, cold weapon for participation in competitions are performed according to the petition of the ministries and other central executive bodies of Ukraine, and for the purpose of hunting - for the term which is specifically determined by the representative on it body;

functioning of shooting shooting galleries and shooting ranges, okhotnichesportivny stands, Items of studying of equipment of weapon, special means, rules of the treatment of them and their application;

the transportation right through customs border of Ukraine of award weapon and cartridges to it;

storage, carrying award weapon;

acquisition of cartridges to award weapon.
