Chapter 1. General provisions

Article 1. Basic concepts

For the purposes of this Federal Law the following basic concepts are used:

the government public assistance - provision to needy families, needy living alone citizens, and also other categories of citizens specified in this Federal Law, social benefits, social pension supplements, subsidies, social services and vital goods;

social benefit - non-paid provision to citizens of certain sum of money at the expense of means of the relevant budgets of the budget system of the Russian Federation;

set of social services - the list of the social services provided to separate categories of citizens according to this Federal Law;

difficult life situation - circumstance or circumstances which worsen conditions of activity of the citizen and which consequence he cannot independently overcome.

Article 2. Legislation on the government public assistance

The legislation on the government public assistance consists of the Federal Law "About Subsistence Minimum in the Russian Federation", this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation.

Article 3. Purposes of rendering the government public assistance

The government public assistance is given for the purpose of:

maintenance of level of living of needy families, and also needy living alone citizens whose average per capita income is lower than the size of the subsistence minimum per capita established in appropriate subject of the Russian Federation according to the Federal Law "About Subsistence Minimum in the Russian Federation";

address use of budgetary funds.

strengthenings of targeting of social support of the needing citizens;

creations of necessary conditions for ensuring general availability and socially acceptable quality of social services;

decrease in level of social inequality;

increases in the income of the population.

Article 4. Powers of the Russian Federation in the field of rendering the government public assistance

In the field of rendering the government public assistance treat maintaining the Russian Federation:

adoption of the Federal Laws and other regulatory legal acts of the Russian Federation concerning establishment of bases of legal regulation in the field of rendering the government public assistance;

development and implementation of federal programs of rendering to citizens in the territory of the Russian Federation the government public assistance by provision of subsidies for payment of the social services rendered to citizens;

establishment of types of the government public assistance which rendering is obligatory in the territory of the Russian Federation, including establishment of federal social pension supplement according to this Federal Law;

establishment of procedure for rendering by subjects of the Russian Federation on the terms of joint financing from the federal budget of the government public assistance based on the social contract in the part which is not determined by this Federal Law.

Article 4.1. The powers of the Russian Federation in the field of rendering the government public assistance in type of set of social services delegated for implementation to public authorities of subjects of the Russian Federation

1. The following powers on the organization of providing the citizens included in the Federal register of the persons having the right to the government public assistance, and who did not refuse receipt of social service, stipulated in Item 1 part 1 of article 6.2 of this Federal Law, medicines for medical application, medical products, and also specialized products of clinical nutrition for handicapped children belong to the powers of the Russian Federation in the field of rendering the government public assistance in type of set of social services delegated for implementation to public authorities of subjects of the Russian Federation:

1) implementation of purchases (including the organization of determination of suppliers) medicines for medical application, medical products, and also specialized products of clinical nutrition for handicapped children;

2) voided according to the Federal Law of the Russian Federation of 28.12.2013 No. 396-FZ

3) the organization of providing the population with medicines for medical application, medical products, and also the specialized products of clinical nutrition for handicapped children bought according to public contracts.

2. Funds for implementation of 1 this Article of powers transferred according to part are provided in type of subventions from the federal budget.

3. The total amount of the means provided in the federal budget in the form of subventions to budgets of subjects of the Russian Federation on implementation of 1 this Article of powers transferred according to part is determined based on the technique approved by the Government of the Russian Federation proceeding from:

1) the number of the citizens included in the Federal register of the persons having the right to the government public assistance, and who did not refuse receipt of social service in the form of providing with medicines for medical application, medical products, and also specialized products of clinical nutrition for handicapped children;

2) the standard rate of finance costs in month on one citizen receiving the government public assistance in type of social service in providing according to standards of medical care according to recipes of the doctor (paramedic) with medicines for medical application, medical products, and also specialized products of the clinical nutrition for handicapped children established annually by the Government of the Russian Federation.

4. Subventions are enlisted in the procedure established for execution of the federal budget into accounts of budgets of subjects of the Russian Federation.

5. Funds for implementation of the powers specified regarding 1 this Article have special-purpose character and cannot be used on other purposes.

6. In case of use of means not on purpose the federal executive body performing functions on control and supervision in the financial and budget sphere, having the right to perform collection of the specified means according to the procedure, established by the legislation of the Russian Federation.
