1. Approve the enclosed Rules of subsidizing of part of the expenses incurred by agricultural producer in case of the investment investments directed to implementation of water saving technologies of irrigation.

2. Declare invalid the order of the acting minister of water resources and irrigation of the Republic of Kazakhstan of May 28, 2025 No. 100-HK "About approval of Rules of subsidizing on compensation of part of the expenses incurred by agricultural producer in case of the investment investments directed to implementation of water saving technologies of irrigation" (it is registered in the Register of state registration of regulatory legal acts No. 36209).

3. To provide to development department of water saving technologies of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan after its official publication.

4. To impose control of execution of this order on the supervising vice-Minister of Water Resources and Irrigation of the Republic of Kazakhstan.

5. This order becomes effective from the date of its first official publication.

Rules of subsidizing of part of the expenses incurred by agricultural producer in case of the investment investments directed to implementation of water saving technologies of irrigation

Chapter 1. General provisions

1. These rules of subsidizing of part of the expenses incurred by agricultural producer (further - SHTP) in case of the investment investments directed to implementation of water saving technologies of irrigation (further - Rules) are developed according to the paragraph third the subitem 35) of Item 1 of article 23 of the Water code of the Republic of Kazakhstan (further - the Code), the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" (further - the Law on the state and socially responsible services) and determine procedure for rendering the state service "Subsidizing of Part of the Expenses Incurred by SHTP in case of the Investment Investments Directed to Implementation of Water Saving Technologies of Irrigation".

2. Main objective of subsidizing of part of the expenses incurred by SHTP in case of investment investments on implementation of water saving technologies of irrigation is increase in goods availability, works and services within implementation of investment projects by decrease in capital intensity and increase in payback of the enclosed investments.

3. In these rules the following terms and determinations are used:

1) the investment project in agro-industrial complex in part implementation of water saving technologies (further – investment the project) – the complex of actions providing investment investments on creation new, expansion of infrastructure for fence and water supply, acquisitions of the equipment according to the passport of the project for the purpose of rational effective use of water resources;

2) the investor in agro-industrial complex (further – the investor (uslugopoluchatel) – the SHTP performing investment investments and which is engaged in production of agricultural products which main or secondary type of activity belongs to Sections of the general qualifier of types of economic activity (further – OKED) according to the list of the main or secondary type of activity for the subject of the entrepreneurship performing investment investments and engaged in production of agricultural products provided by appendix 1 to these rules;

3) the special account – the account of financial institution in bank of the second level on which the amount of investment subsidies in accordance with the terms of Chapter 4 of these rules is credited;

4) the agricultural equipment (further – the equipment) – the equipment intended for mechanization, to electrification and automation of agricultural works of which owing to specifics of its operation the immovability of Basic and case Elements of design, rather bearing area, during execution of engineering procedures is characteristic;

5) the administrator of the budget program (further – the administrator) – local executive bodies of the capital, areas and cities of republican value;

6) personal account – set of the records containing in the register, allowing to identify the registered person for the purpose of registration of requests for subsidizing and accounting of transactions on them;

7) the passport of the project – the name of the equipment and share of compensation of investment investments on creation new, expansions of infrastructure for fence and water supply, the acquisitions of new, earlier unused equipment and other fixed assets, works and services which are subject to investment subsidizing, specified in appendices 2 to these rules;

8) investment investments – the costs directed to creation new or expansion of the operating infrastructure for fence and water supply;

9) investment subsidizing - compensation of part of the expenses incurred by the investor (uslugopoluchatel) in case of the investment investments directed to implementation of water saving technologies of irrigation;

10) working body for questions of investment subsidizing (further – working body (service provider) – the local executive body of the capital, areas and cities of republican value in the field of agricultural industry authorized for consideration of requests of investors (uslugopoluchatel) and decision making about payment/refusal in provision of investment subsidies;

11) the agreement of investment subsidizing – the agreement signed between working body (service provider) and the investor (uslugopoluchatel), providing procedure and conditions of money transfer of investment subsidies, the course of monitoring, responsibility of the parties and other conditions;

12) financial institutions – the banks of the second level, the microfinancial organizations, social business corporations, credit institutions having the corresponding license for the right of banking operations, the leasing companies, credit partnerships, the confided (agents) determined according to the budget legislation;

13) the request – the electronic request for receipt of investment subsidies by investors (uslugopoluchatel) in case of investment investments in form according to appendices 3 and 4 to these rules;

14) expansion of infrastructure for fence and water supply – the actions providing construction of additional production capacities on the operating object, equipment of the operating production capacities missing or necessary new, earlier unused oborudovaniye of irrigation according to appendix 2 to these rules;

15) the digital register of requests for subsidizing (further - the register) - set of data on the applications for subsidizing submitted SHTP and also about borrowers, financial institutions, and other data reflected in the state digital system of subsidizing;

16) the state digital system of subsidizing (further – GTsSS) – the organizational arranged set of digital technologies, service personnel and technical documentation intended for rendering services in accomplishment of processes of subsidizing giving opportunity of registration of the request for receipt of subsidies and also its processings by means of automatic verification of the request for compliance to subsidizing conditions;

17) the web portal of the state digital system of subsidizing (further – the web portal) – the Internet resource placed on the Internet, providing access to the state digital system of subsidizing;

17-1) registratorsky digital system (further – system of the first level) – the monitoring system of measures of the state support and their receivers integrated with GTsSS, containing the reference electronic register of requests of applicants;

17-2) registrar – the legal entity whose single shareholder is the state determined by the central authorized body by budget implementation, performing technical maintenance of maintaining the register;

18) the digital signature (further – the EDS) – the digital record (set of digital data) created with use of the closed key of the digital signature and means of the digital signature, confirmatory reliability of the electronic document, its accessory and invariance of content.

4. Subsidizing of costs for creations new or expansions of infrastructure for fence and water supply is allowed according to the passport of the project specified in appendix 2 to these rules.

If the investment project provides only acquisition and installation of separate types of the equipment without development of the design estimates, the acquired equipment in the limits set the maximum allowable cost for calculation of subsidies for expansion of infrastructure for giving and intake of water per unit of measurement and share of compensation of investment investments from equipment cost according to purchase and sale agreements (leasing), delivery agreements and (or) installation of equipment, and also to related documents (the customs declaration, invoices, documents confirming payment) is subject to subsidizing.

4-1. Subsidizing is performed within two-level system of the state support including:

1) the first level – the registratorsky digital system integrated with systems of the second level, containing the reference digital register of requests of receivers of measures of the state support where by means of final postformatno-logical control compliance of the receiver of measures of the state support to requirements of these rules is determined;

2) the second level – industry state or non-state digital systems by means of which order taking from receivers of measures of the state support, their processing using formatno-logical control and transfer of the processed requests for the first level is performed.

Digital systems of the second level provide consent from receivers of measures of the state support to use of the data which are the secret protected by the law and also on collection, processing, storage, unloading and use of personal data by the registrar.

5. Annually till February 1 of the corresponding year the working body (service provider) creates and registers in GTsSS group of specialists (further – group of specialists) from number of persons employed of working body (service provider), local executive bodies (including district/city) and other organizations, being representatives of the public and non-governmental industry organizations.
