Section I. General provisions

Article 1. Purposes and tasks of the law

This law is directed to protection of the rights and interests, and also determines state policy in the field of social support of the citizens of the Russian Federation who appeared in zone of influence of the adverse factors which arose owing to catastrophic crash on the Chernobyl NPP on April 26, 1986, or taking part in mitigation of consequences of this catastrophic crash.

Article 2. Legislation of the Russian Federation on the Chernobyl catastrophic crash

The relations connected with the Chernobyl catastrophic crash are regulated by this Law, the current legislation of the Russian Federation regarding the regulations which are not contradicting this Law and other acts of the legislation of the Russian Federation issued according to them.

Article 3. The right of the citizens of the Russian Federation who were affected by radiation owing to catastrophic crash on the Chernobyl NPP to indemnification and measures of social support

Are guaranteed to citizens of the Russian Federation established by this Law indemnification, caused to their health and property owing to catastrophic crash on the Chernobyl NPP, indemnification for risk owing to accommodation and work in the territory which underwent to the radioactive pollution exceeding admissible levels as a result of the Chernobyl catastrophic crash and also provision of measures of social support.

In the presence the citizen of the Russian Federation has rights to indemnification and measures of social support provided by this Law, for the different bases to it harm is compensated and the measures of social support provided on all available bases are provided. At the same time identical harm is compensated, and identical measures of social support are provided to the citizen of the Russian Federation only on one of the bases at its choice.

If the citizen has the right to indemnification and measures of social support for this Law and at the same time to the same indemnification and measures of social support for other regulatory legal act, indemnification and measures of social support irrespective of the basis on which they are established, presented or under this Law, or on other regulatory legal act at the choice of the citizen if the legislation of the Russian Federation does not provide other.

Article 4. Concept of social support of the citizens who were affected by radiation owing to catastrophic crash on the Chernobyl NPP

Social support of the citizens who were affected by radiation owing to catastrophic crash on the Chernobyl NPP - the system of measures providing social guarantees to the citizens who were affected by radiation owing to catastrophic crash on the Chernobyl NPP, established by this Law and other Federal Laws.

The measures of social support provided by the paragraph the fourth Item 4, Items 6, 8 - 10 and 13 parts one of Article 18, Items 5 - 7 parts two of Article 19, the paragraph the fourth item 4 of part two of article 20 of this Law, are provided on condition of permanent residence (work) of citizens (except for children irrespective of the place of their birth whose parents (one of parents) just before the child's birth constantly lived (worked) in zones of settling out, accommodation with the right to settling out and accommodation with the preferential social and economic status and provided that the child after the birth constantly lives in these zones) just before provision of the specified measures:

1) in settling out zone - at least 1 year;

2) in accommodation zone with the right to settling out - at least 3 years;

3) in accommodation zone with the preferential social and economic status - at least 4 years.

The measures of social support provided by Items 2 and 3 of part one of article 25 of this Law are provided on condition of permanent residence of children and teenagers aged up to 18 years in zones of settling out, accommodation with the right to settling out, including before their resettlement from these zones (except for children irrespective of the place of their birth whose parents (one of parents) just before the child's birth constantly lived (worked) in these zones and provided that the child after the birth constantly lives in these zones, children of the first generation of the citizens specified in Items 1 - 3 and 6 parts one of article 13 of this Law which were born after radiation exposure owing to the Chernobyl catastrophic crash of one of parents, and also children of the second and the subsequent generations of the specified citizens, if parents (one of parents) of such children have diseases owing to the Chernobyl catastrophic crash or the caused genetic effects of radiation exposure), just before provision of the specified measures:

1) in settling out zone - at least 1 year;

2) in accommodation zone with the right to settling out - at least 3 years.

Provision of monthly money payment according to article 27.1 of this Law to the citizens specified in Items 7 - 9 parts one of article 13 of this Law, to the children and teenagers aged up to 18 years who are constantly living in zones of settling out, accommodation with the right to settling out including before their resettlement from these zones, and also to the children and teenagers aged up to 18 years who are constantly living in accommodation zone with the preferential social and economic status (except for children irrespective of the place of their birth whose parents (one of parents) just before the child's birth constantly lived (worked) in zones of settling out, accommodation with the right to settling out and accommodation with the preferential social and economic status and provided that the child after the birth constantly lives in these zones, children of the first generation of the citizens specified in Items 1 - 3 and 6 parts one of article 13 of this Law, one of parents, and also children of the second and the subsequent generations of the specified citizens who was born after radiation exposure owing to the Chernobyl catastrophic crash, if parents (one of parents) of such children have diseases owing to the Chernobyl catastrophic crash or the caused genetic effects of radiation exposure), it is performed on condition of their permanent residence (work) just before provision of the specified money payment:

1) in settling out zone - at least 1 year;

2) in accommodation zone with the right to settling out - at least 3 years;

3) in accommodation zone with the preferential social and economic status - at least 4 years.

The monthly payment specified in Item 7 parts one of article 18 of this Law is performed on condition of permanent residence (work) of citizens just before birth date of the child to whom payment is appointed:

1) in settling out zone - at least 1 year;

2) in accommodation zone with the right to settling out - at least 3 years;

3) in accommodation zone with the preferential social and economic status - at least 4 years.

In case of review according to part three of article 7 of this Law of borders of zones of radioactive pollution owing to catastrophic crash on the Chernobyl NPP, or moving of citizens on the permanent residence in zones of settling out, accommodation with the right to settling out and accommodation with the preferential social and economic status from the specified zones, or the changes of place of employment within the specified zones of measure of social support and payment provided by parts two, third and fourth this Article are provided taking into account time of the permanent residence (work) in the specified zones estimated in the following procedure:

1) every year accommodation (work) in accommodation zone with the preferential social and economic status it is considered in three months of accommodation (work) in settling out zone;

2) every year accommodation (work) in accommodation zone with the right to settling out it is considered in four months of accommodation (work) in settling out zone;

3) every year accommodation (work) in accommodation zone with the preferential social and economic status it is considered in nine months of accommodation (work) in accommodation zone with the right to settling out.

The measures of social support provided by this Law are provided according to the procedure, established by the Government of the Russian Federation. In need of the purposes of uniform application of this Law and other regulatory legal acts of the Russian Federation concerning realization of the rights of citizens to measures of social support the corresponding explanations by the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of work and social protection of the population in coordination with the federal executive body performing functions on development and realization of state policy, normative legal regulation in the field of civil defense, protection of the population and the territories from emergency situations of natural and technogenic nature and the federal executive body performing functions on development of state policy and normative legal regulation in the field of budget activities can be published.

Article 5. Financing of the Law

The indemnification and measures of social support of the citizens who were affected by radiation owing to catastrophic crash on the Chernobyl NPP provided by this Law are payment commitments of the Russian Federation. The procedure for financing of payment commitments of the Russian Federation is established by the Government of the Russian Federation.

The part two voided

The amount of payments established by this Law is subject to indexation since February 1 of the current year proceeding from index of growth of consumer prices for previous year once a year. The coefficient of indexation is determined by the Government of the Russian Federation.
