About approval of rates of assay collection and the Payment procedure of assay collection

For the purpose of implementation of Chapter 25 of the Code of the Kyrgyz Republic about non-tax income, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve:

1) rates of assay collection according to appendix 1;

2) the Payment procedure of assay collection according to appendix 2.

2. Declare invalid the order of the Government of the Kyrgyz Republic "About approval of rates of assay collection and the Payment procedure of assay collection" of January 28, 2019 No. 29.

3. This resolution becomes effective after fifteen days from the date of official publication.

Payment procedure of assay collection

Chapter 1. General provisions

1. The payment procedure of assay collection (further - the Procedure) determines the procedure of collection of assay collection for approbation, the analysis and branding of jewelry.

2. Assay collection is levied by the authorized body performing state policy in the sphere of production, use, the address, accounting and storage of precious metals, gemstones and products from them and also accomplishment of transactions with the specified values in the territory of the Kyrgyz Republic (further - authorized body). Assay collection is paid according to the established rates approved by the Cabinet of Ministers of the Kyrgyz Republic.

3. In case of determination of structure of products by authorized body from unknown alloy assay collection is levied:

- for products of yellow color - as for gold products;

- for products of white color - as for silver products;

- for products of gray color - as for platinum products.

4. In case of approbation and branding of products which details are made of various alloys of gold of silver, platinum or palladium, assay collection is levied in double size of the rate established for that metal on which the main assay brand is imposed.

5. In case of presentation by physical persons or legal entities of products weighing from 10 to 50 grams, rates of assay collection increase in double size, weighing more than 50 grams - in quadruple size.

6. For urgency of approbation and branding for physical persons or legal entities of rate of assay collection increase in double size.

7. If the product shown for approbation, the analysis and branding cannot be branded because of absence in the declared test, assay collection to the owner of product does not return.

8. When the products from precious metals which are handed over for approbation, the analysis and branding unclaimed within 6 (six) months, such products are subject to delivery in the State storage of values according to the legislation of the Kyrgyz Republic on precious metals and gemstones.

9. For the purpose of charge of assay collection, in the presence of data only in weight amount (grams, kilograms), for determination of quantity in pieces of jewelry and other products from the precious metals imported (including earlier imported) from the countries which are not entering into EEU which were not provided on the state control, approbation and branding during the term established by the legislation the following weight of one product is established:

- 5,7 of grams - for gold;

- 17,3 of grams - for silver.

The requirement of this Item extends, including, on the jewelry and other products which are earlier imported on the territory of the Kyrgyz Republic and not provided on the state control, approbation and branding.

Chapter 2. Payment due dates of assay collection

10. The payment due date of assay collection is established:

1) the ranking officer of authorized body depending on amount of the handed-over jewelry and other products from precious metals taking into account the performed works on:

- approbation and branding;

- carrying out the analysis on content of precious metals;

2) within 10 (ten) working days from the moment of charge of assay collection on the jewelry and other products imported from the third countries and not provided on the state control which are subject to approbation, branding and the analysis according to Item 9 of this Procedure.
