Based on subitem 1.19 of Item 1 of Article 118, of subitem 1.4 of Item 1 of Article 228 and subitem 1.9 of Item 1 of article 239 of the Tax Code of the Republic of Belarus, the paragraph of the ninth of article 9 of the Law of the Republic of Belarus of July 13, 2012 No. 419-Z "About public procurements of goods (works, services)", paragraphs of the fourth, eighth and ninth Item 19 of the Presidential decree of the Republic of Belarus of August 28, 2006 No. 542 "About sanatorium treatment and improvement of the population", and also in pursuance of Item 2 of the Presidential decree of the Republic of Belarus of March 11, 2025 "About change of presidential decrees of the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES: No. 104

1. Determine that carrying out by the Republican center for improvement and sanatorium treatment of the population of open tender on purchase of medical and improving services (further - tender) is performed according to the procedure, established by the legislation on public procurements, taking into account the following features:

1.1. the right of the participant to submit the proposal on can be provided in competitive documents:

part of amount of subject of public procurement (further - part of amount of subject);

part of amount of lot of subject of public procurement (further - part of amount of lot) if the subject of public procurement is broken into lots;

1.2. the commission on public procurements has the right to choose one or several winner participants as regards subject amount (part of amount of lot) from among provided the offer according to competitive documents on part of amount of subject (part of amount of lot);

1.3. The republican center for improvement and sanatorium treatment of the population signs the contract of public procurement with each participant chosen by the commission on public procurements by the winner participant;

1.4. tender is recognized cancelled as regards subject amount (part of amount of lot) concerning which any offer was not provided or if all arrived offers are rejected as a result of their assessment and comparison or if the winner participant by this part of amount of subject (part of amount of lot) evaded from the conclusion of the agreement of public procurement.

2. Make changes to resolutions of Council of Ministers of the Republic of Belarus according to appendix.

3. This resolution becomes effective after its official publication.

Action of Item 1 of this resolution does not extend to the procedures of public procurements begun before entry into force of this resolution.

3. In the resolution of Council of Ministers of the Republic of Belarus of July 15, 2024 No. 509 "About the organization of improvement of children in the educational and improving centers, educational and improving and sports camps":

"1.2. improvement of children in the educational and improving centers and camps will be organized based on permits in forms according to appendices 1 and 2 respectively.
