About approval of the Regulations on carrying out organ transplantation and/or tissues of the person

For the purpose of streamlining of the questions connected with organ transplantation and/or tissues of the person in the Kyrgyz Republic, realization of part of 1 Article 125, of parts 4, of the 9th Article 126, speak rapidly 2 Articles 127, of part 3 of article 129 of the Law of the Kyrgyz Republic "About protection of public health in the Kyrgyz Republic", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve Regulations on carrying out organ transplantation and/or tissues of the person according to appendix.

2. To the Ministry of Health of the Kyrgyz Republic to bring the decisions into accord with this resolution.

3. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

4. This resolution becomes effective after ten days from the date of official publication.

Regulations on carrying out organ transplantation and/or tissues of the person

Chapter 1. General provisions

1. This Provision determines the organization and procedure for organ transplantation and/or tissues of the person from the lifetime donor to the recipient and is developed according to the Law of the Kyrgyz Republic "About protection of public health in the Kyrgyz Republic".

2. Basic concepts and terms:

1) the lifetime donor - capable physical person is aged more senior 18 years which are with the recipient in genetic linkage according to Item 16 of this provision and recognized as consultation of specialists doctors healthy which provide part of the fabrics or body (except marrow) for change to the recipient;

2) the recipient - the patient to whom transplantation of body or fabrics from the lifetime donor is made;

3) the potential recipient - the patient who needs organ transplantation and/or fabrics;

4) the potential donor - capable physical person is aged more senior 18 years which are with the recipient in genetic linkage according to Item 16 of this provision and recognized as consultation of specialists doctors healthy, showed voluntary willingness to be lifetime donor of bodies and/or fabrics;

5) transplantation - replacement of the fabrics or bodies which are absent or damaged by pathological process, own fabrics or bodies or taken from other organism.

Chapter 2. Medical and sanitary help with organ transplantation and/or fabrics

3. The medical and sanitary help with organ transplantation and/or fabrics is in the form of specialized medical care - replacement of the fabrics or bodies which are absent or damaged by pathological process, own fabrics or bodies or taken from other organism.

4. The medical and sanitary help with organ transplantation and/or fabrics appears the specialists doctors who were trained concerning organ transplantation and/or tissues of the person in interaction with other specialists doctors in the stationary conditions providing the round-the-clock medical observation and treatment.

Chapter 3. The list of bodies and/or tissues of the person, employees for transplantation

5. The list of objects for transplantation in the Kyrgyz Republic which can extend in process of development of system of transplantology:

1) kidneys;

2) liver;

3) haematopoietic stem cells (marrow).

Chapter 4. Conditions and procedure for organ transplantation and/or tissues of the person at the lifetime donor

6. Transplantation can be made only if other medical means and methods were inefficient and cannot guarantee preserving life of the patient or recovery of his health, and is performed based on the medical certificate issued according to this Provision.

7. When carrying out organ transplantation and/or fabrics, specialists doctors of the organization of health care for transplantation shall give the complete information about possible complications of health of the potential recipient in connection with the forthcoming intervention on organ transplantation (part of body) and/or fabrics (part of fabric) about what the potential recipient signs the informed voluntary consent in standard form according to appendix 1 to this Provision.

8. Organs transplantation (part of body) and/or fabrics (part of fabric) are carried out based on the clinical protocols / managements, regulations and standards approved by authorized body in health sector.

9. In case of organ transplantation (part of body) and/or fabrics (part of fabric) it is forbidden:

1) forced withdrawal at the person and compulsion of the person to provision of the body (part of body) and/or fabrics (part of fabric);

2) purchase and sale of bodies (part of body) and/or tissues (part of fabric) of the person, except for medicines and transfer materials for which preparation fabric components are used;

3) removal of organs (part of body) and/or fabrics (part of fabric) at the lifetime donor who is the minor or incapacitated person (except as specified bone marrow transplantations).

Chapter 5. Removal of organs and/or fabrics at the lifetime donor, organ transplantation and fabrics to the recipient

10. Removal of organs (part of body) and/or fabrics (part of fabric) at the lifetime donor for transplantation to the recipient is allowed in case of observance of the following conditions:

1) if the lifetime donor is warned about possible deterioration in his health in connection with the forthcoming surgery on removal of organs and/or fabrics. At the same time the lifetime donor signs the informed consent about possible complications of his health, in connection with the forthcoming intervention on organ transplantation and/or fabrics in standard form according to appendix 2 to this Provision;

2) if the lifetime donor underwent comprehensive physical examination and there is conclusion of consultation of specialists doctors about possibility of withdrawal at it of bodies and/or fabrics for transplantation;

3) if the genetic linkage between the lifetime donor and the recipient according to Item 16 of this provision is established (except as specified bone marrow transplantations).
