About approval of Rules of marking of separate types of the sweets and confectionery packed into consumer packaging, means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning separate types of the sweets and confectionery packed into consumer packaging

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of separate types of the sweets and confectionery packed into consumer packaging, means of identification.

2. Determine that participants of turnover of separate types of the sweets and confectionery determined in Item 3 of this resolution, packed into consumer packaging (further - sweets and confectionery), according to the Rules approved by this resolution:

a) give to the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), the statement for registration in information system of monitoring since September 1, 2025, but no later than 7 calendar days from the date of emergence of need of implementation by the participant of turnover of sweets and confectionery of the activities connected with input in turnover and (or) turnover, and (or) conclusion from turnover of sweets and confectionery concerning which the input prohibition in turnover, and (or) turnover, and (or) conclusion from turnover of sweets and confectionery not marked is established by means of identification (except for participants of turnover of the sweets and confectionery falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation").

At the same time the participants of turnover of sweets and confectionery falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" perform registration in information system of monitoring within 30 calendar days from the date of emergence of need of implementation of the activities connected with input in turnover by them and (or) turnover, and (or) conclusion from turnover of sweets and confectionery;

b) provide no later than 15 calendar days from the date of registration in information system of monitoring readiness of own software and hardware for information exchange with information system of monitoring and send to the operator of information system of monitoring the request for passing of testing of information exchange electronically;

c) for work on ensuring readiness of own software and hardware for information exchange with information system of monitoring and passing of testing of information exchange electronically after registration in information system of monitoring send to the operator of information system of monitoring electronically the request for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring;

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning the transactions connected with marking of sweets and confectionery, their input in turnover, turnover and conclusion from turnover according to the Rules approved by this resolution no later than 15 calendar days from the date of readiness of own software and hardware for information exchange with information system of monitoring and the direction of the request according to the subitem "b" of this Item.

3. Determine that the participants of turnover of sweets and confectionery performing input in turnover of sweets and confectionery put funds of identification for sweets and confectionery and represent to information system of monitoring of the data on drawing means of identification and input in turnover of sweets and confectionery according to the Rules approved by this resolution:

a) since March 1, 2026 - concerning sweets and confectionery:

belonging to codes of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union (further - the commodity nomenclature) 1704 (except for chewing gum, white chocolate, caramel and dragee) and to codes of the All-Russian Product Classifier by types of economic activity (further - the qualifier) 10.82.23.140, 10.82.23.150, 10.82.23.160, 10.82.23.170, 10.82.23.180, 10.82.23.210, 10.82.23.220, 10.82.23.230, 10.82.23.250, 10.86.10 (except for 10.86.10.200, 10.86.10.500, 10.86.10.600);

belonging to codes of the commodity nomenclature 1806 (except for 1806 10, 1806 90 700 0) regarding chocolate, nut and other pastes and to codes of the qualifier 10.82.11.000, 10.82.22. 190, 10.82.23.290, 10.86.10 (except for 10.86.10.200, 10.86.10.500, 10.86.10.600);

belonging to codes of the commodity nomenclature 1905 (except for 1905 10 000 0, 1905 40, 1905 90 100 0, 1905 90 300 0, 1905 90 550 0, 1905 90 600 0, 1905 90 900 0) and to codes of the qualifier 10.71.1, 10.72. 1, 10.86.10 (except for 10.86.10.200, 10.86.10.500, 10.86.10.600), 10.89.19.220;

belonging to codes of the commodity nomenclature 2106 (except for 2106 90 980 1 and 2106 90 980 2 regarding chewing gum) and to qualifier 10.86.10 codes (except for 10.86.10.200, 10.86.10.500, 10.86.10.600);

b) since May 1, 2026 - concerning sweets and confectionery:

belonging to code of the commodity nomenclature 1704 and code of the qualifier 10.89.19.220;

belonging to codes of the commodity nomenclature 1905 90 300 0, 1905 90 600 0 and to codes of the qualifier 10.71.1, 10.72. 1, 10.86.10 (except for 10.86.10.200, 10.86.10.500, 10.86.10.600);

c) since July 1, 2026 - concerning sweets and confectionery:

belonging to codes of the commodity nomenclature 1704 regarding chewing gum, white chocolate, caramel and to dragee and codes of the qualifier 10.82.23.110, 10.82.23. 120, 10.82.23.130, 10.82.23.240, 10.82.23.290, 10.86.10 (except for 10.86.10.200, 10.86.10.500, 10.86.10.600), 10.89.19.170;

belonging to codes of the commodity nomenclature 1806 (except for 1806 10, cocoa powder, chocolate, nut and other pastes), 2106 90 980 1 and 2106 90 980 2 regarding chewing gum and to codes of the qualifier 01.11. 94, 01.11. 95, 10.39.22.110, 10.82.21.120, 10.82.22.110, 10.82.22.121, 10.82.22.122, 10.82.22.130, 10.82.22.140, 10.82.22.190, 10.82.23.120, 10.82.23.130, 10.82.23.240, 10.82.23.290, 10.82.24, 10.86.10 (except for 10.86.10.200, 10.86.10.500, 10.86.10.600), 10.89.19.170.

4. The participants of turnover of sweets and confectionery performing input in turnover of the sweets and confectionery determined in Item 3 of this resolution in group packaging of sweets and confectionery or set of sweets and confectionery (further respectively - group packaging, set) put funds of identification for group packaging or set and represent to information system of monitoring of the data on drawing means of identification and input in turnover of sweets and confectionery in group packaging or set according to the Rules approved by this resolution since July 1, 2027.

5. Participants of turnover of sweets and confectionery represent to information system of monitoring according to the Rules approved by this resolution, data on conclusion from turnover of sweets and confectionery (as in case of conclusion from turnover when implementing calculations using the control and cash equipment, and different ways) and (or) about turnover of sweets and confectionery according to the Rules approved by this resolution since July 1, 2027.

6. The participants of turnover of sweets and confectionery falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" having the right to represent the data specified in the Section VIII of the Rules approved by this resolution within 30 calendar days:

from the date of shipment (transfer or acceptance) sweets and confectionery by transfer (acceptance) of sweets and confectionery within the transactions providing transition of the property right to sweets and confectionery and also within commission agreements, and (or) agency agreements, and (or) works agreements, and (or) agreements of the order;

from the date of conclusion of sweets and confectionery from turnover in case of conclusion of sweets and confectionery from turnover;

from the date of return of sweets and confectionery to turnover in case of return of sweets and confectionery with the intact means of identification;

from the date of modification of the data provided by Sections III, IV and VIII of the Rules approved by this resolution, according to the procedure, provided by the Section IX of the Rules approved by this resolution (if changes were made to such data).

7. Participants of turnover of sweets and confectionery have the right to put funds of identification for sweets and confectionery, group packaging or set and to represent to information system of monitoring of the data on drawing means of identification, input in turnover, about turnover and about conclusion from turnover of sweets and confectionery, including in group packaging or set, according to the Rules approved by this resolution since September 1, 2025.

8. Determine that in the territory of the Russian Federation input in turnover of sweets and confectionery without drawing on them, group packaging or set of means of identification and representation in information system of monitoring of data on marking of sweets and confectionery, group packagings or sets is allowed by means of identification before the corresponding dates established by Items 3 and 4 of this resolution from which drawing funds of identification for sweets and confectionery, group packaging or set and representation in information system of monitoring of data on drawing on such sweets and confectionery, group packaging or set of means of identification and their input in turnover becomes obligatory.

Within one month after approach of the corresponding dates established by Items 3 and 4 of this resolution from which drawing funds of identification for sweets and confectionery, group packaging or set becomes obligatory release by customs authorities of earlier corresponding dates placed under customs procedures of release for internal consumption or reimport of the unmarked sweets and confectionery, group packagings or sets, acquired established by Items 3 and 4 of this resolution is allowed.

In the presence as of the corresponding dates, the stipulated in Item 3 presents of the resolution from which drawing funds of identification for sweets and confectionery becomes obligatory in the territory of the Russian Federation of the unrealized sweets and confectionery made in the territory of the Russian Federation or imported on the territory of the Russian Federation before the corresponding date realization of such sweets and confectionery not marked is allowed by means of identification before the termination of expiration date of these sweets and confectionery.

9. Registration in the information system used for the purpose of carrying out experiment on marking by means of identification of separate types of the sweets and confectionery packed into consumer packaging according to the order of the Government of the Russian Federation of February 22, 2025 No. 203 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of separate types of the sweets and confectionery packed into consumer packaging" (further - experiment), legal entities and individual entrepreneurs who as of August 31, 2025 were participants of experiment is equated to registration in information system of monitoring according to the subitem "an" of Item 2 of this resolution.

If the data provided within the experiment by participants of turnover of sweets and confectionery to the information system used for the purpose of carrying out experiment do not meet the requirements of the Rules approved by this resolution, participants of turnover of sweets and confectionery represent to information system of monitoring missing and (or) urgent data before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for such sweets and confectionery becomes obligatory.

10. Determine that the operator of information system of monitoring provides:

a) provision to participants of turnover of sweets and confectionery of remote access to the issue registration devices placed in infrastructure of information system of monitoring on the conditions provided by the Rules approved by this resolution no later than 30 calendar days from the date of obtaining from participants of turnover of the sweets and confectionery registered in information system of monitoring, requests for provision of remote access to the issue registration device electronically;

b) the organization of testing of information exchange of software and hardware of participants of turnover of sweets and confectionery and information system of monitoring no later than 30 calendar days from the date of obtaining from participants of turnover of the sweets and confectionery registered in information system of monitoring, notifications of the readiness to information exchange with information system of monitoring.

11. Operation of this resolution does not extend to sweets and confectionery on which according to the Rules approved by this resolution, and international treaties of the Russian Federation requirements to obligatory marking by means of identification do not extend.

12. Determine that with approach of the corresponding dates, the stipulated in Item 3 presents of the resolution from which drawing funds of identification for the corresponding types of sweets and confectionery becomes obligatory provision to the participant of turnover of sweets and confectionery of the codes of marking necessary for forming of the means of identification put including on group packaging or set, is performed by the operator of information system of monitoring on paid basis according to the Rules approved by this resolution.

According to the decision of the participant of turnover of sweets and confectionery provision to it marking codes, including on group packaging or set, means of identification, necessary for forming, can be performed by the operator of information system of monitoring before the corresponding dates, the stipulated in Item 3 presents of the resolution from which drawing funds of identification for sweets and confectionery becomes obligatory. Such codes of marking are provided by the operator of information system of monitoring free of charge. At the same time the participant of turnover of sweets and confectionery who received marking codes free of charge provides their transformation to means of identification and submits in information system of monitoring the report on drawing means of identification, including on group packaging or set, and data on input in turnover of sweets and confectionery, including in group packagings or sets, before the corresponding dates, the stipulated in Item 3 presents of the resolution from which drawing funds of identification for sweets and confectionery becomes obligatory. The operator of information system of monitoring enters into information system of monitoring information on drawing means of identification specified by the participant of turnover of sweets and confectionery in the report on drawing means of identification after receipt of the specified report. Such service is recognized the information system of monitoring rendered by the operator at the time of entering of information system of monitoring by the operator into information system of monitoring of information on drawing means of the identification specified by the participant of turnover of sweets and confectionery in the report on drawing means of identification.

If the participant of turnover of sweets and confectionery who received marking codes free of charge did not provide their transformation to means of identification and did not submit in information system of monitoring the report on drawing means of identification and data on input in turnover of sweets and confectionery, including in group packaging or set, before the corresponding dates, the stipulated in Item 3 presents of the resolution from which drawing funds of identification for sweets and confectionery becomes obligatory, such codes of marking are paid by the participant of turnover of sweets and confectionery or cancelled according to the Rules approved by this resolution.

13. This resolution becomes effective since September 1, 2025.
