About approval of Rules of rendering communication services for the purposes of television broadcasting and (or) broadcasting

According to article 44 of the Federal law "About Communication" and article 1 of the Law of the Russian Federation "About consumer protection" the Government of the Russian Federation decides:

1. Approve the enclosed Rules of rendering communication services for the purposes of television broadcasting and (or) broadcasting.

2. Recognize invalid acts of the Government of the Russian Federation according to the list according to appendix.

3. This resolution becomes effective since September 1, 2025.

4. The rules approved by this resolution are effective till September 1, 2031.

Rules of rendering communication services for the purposes of television broadcasting and (or) broadcasting

I. General provisions

1. These rules govern the relations between the subscriber or the speaker and the telecom operator rendering communication services for the purposes of TV and radio broadcasting when rendering communication services for the purposes of TV and radio broadcasting (further - service of communication for the purposes of TV and radio broadcasting) in case of the conclusion of the paid service provision agreement of communication (further - the agreement).

2. The concepts used in these rules mean the following:

"subscriber" - the user communication services for the purposes of TV and radio broadcasting with which the agreement in case of allocation for these purposes of unique code of identification is signed;

"subscriber line" - the communication line connecting communication network means of communication for distribution of TV channels and (or) radio channels (further - TV and radio broadcasting communication network) through subscriber distributive system with the user equipment (the terminal equipment);

"subscriber distributive system" - set of the physical chains and technical means (including amplifiers through passage, routers, splitters, subscriber sockets and other switching elements) located in the subscriber through which the user equipment (the terminal equipment) is connected to TV and radio broadcasting communication network means of communication;

"speaker" - the Russian legal entity performing in accordance with the established procedure activities for television broadcasting and (or) broadcasting;

"zone of servicing of the telecom operator" - the territory within which in case of on-air land and (or) satellite broadcasting the possibility of acceptance of signal of the TV channel and (or) radio channel meeting technical standards or the territory specified in the license for rendering communication services for the purposes of cable broadcasting within which the corresponding communication services are rendered is provided;

"obligatory public TV channels and (or) radio channels" - the TV channels and (or) radio channels specified in part one of article 32.1 of the Law of the Russian Federation "About mass media" which are subject to distribution in all circles of broadcasting without collection of payment from subscribers for the right of viewing, listening;

"the operator of obligatory public TV channels and (or) radio channels" - the telecom operator which based on the agreement with the subscriber renders communication services for the purposes of television broadcasting and (or) broadcasting (except for communication services for the purposes of wire broadcasting) and according to the Federal Law "About Communication" shall perform broadcast of obligatory public TV channels and (or) radio channels which list is determined by the legislation of the Russian Federation on mass media, without the conclusion of the agreement with the speaker of such TV channels and (or) radio channels;

"telecom operator" - the legal entity or the individual entrepreneur rendering communication services based on the corresponding license for activities on rendering communication services for the purposes of cable and (or) on-air broadcasting;

"the user communication services" - the person ordering and (or) using communication services;

"the user equipment (the terminal equipment)" the technical means for transfer and (or) acceptance of signals of telecommunication on communication lines connected to subscriber lines and which are in use of subscribers or intended for such purposes;

"provision to the subscriber of access to TV and radio broadcasting communication network" - set of actions of the telecom operator rendering communication services for the purposes of TV and radio broadcasting on forming of subscriber line and connection with its help of the user equipment (the terminal equipment) to means of communication or communication lines of communication network of TV and radio broadcasting;
