About approval of technique of cost determination of services in advisory support of projects of public-private partnership, including concessionary projects

According to the subitem 67) of Item 15 of the Regulations on the Ministry of national economy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 24, 2014 No. 1011, I ORDER:

1. Approve the enclosed Technique of cost determination of services in advisory support of projects of public-private partnership, including concessionary projects.

2. To provide to department of investment policy and development of the financial sector of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation within five working days from the date of signing of this order its direction for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan and on Internet resource of the Ministry of national economy of the Republic of Kazakhstan after its first official publication.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication, except for Item 6 of appendix of this order which becomes effective since January 1, 2026.

Technique of cost determination of services in advisory support of projects of public-private partnership, including concessionary projects

Chapter 1. General provisions

1. This Technique of cost determination of services in advisory support of projects of public-private partnership (further – PPP), including concessionary projects (further – the Technique) is developed for the purpose of ensuring rational use of budgetary funds according to the budget programs for advisory support of projects of PPP and has advisory nature.

2. The cost of services in advisory support of projects of PPP including concessionary projects (further – services), is determined by the central and local executive bodies according to this Technique.

3. Services in advisory support of projects of PPP include:

1) in case of determination of the private partner by tender method in case of the state initiative:

development of the tender documentation, including:

development of competitive conditions;

development of information leaf on the project or development of the feasibility statement (further – the feasibility study);

holding actions for search and involvement of potential investors, including holding the public presentations, road show, conferences, advertizing campaigns (if necessary);

project development of the agreement of PPP;

modification and amendments in the approved tender documentation (adjustment);

carrying out participation in negotiations on the agreement of PPP, including under the direct agreement with creditors of the private partner (if necessary);

2) in case of determination of the private partner by tender method in case of private initiative:

development of the tender documentation, including:

development of competitive conditions;

development of the technical and technological Section feasibility study for the projects providing construction of new objects, change (reconstruction, expansion, modernization, upgrade, capital repairs) of the existing objects (buildings, constructions and their complexes, communications);

holding actions for search and involvement of potential investors, including holding the public presentations, road show, conferences, advertizing campaigns (if necessary);

participation in negotiations on the agreement of PPP, including under the direct agreement with creditors of the private partner (if necessary);

3) in case of determination of the private partner by method of direct negotiations:

participation in negotiations on the agreement of PPP, including under the direct agreement with creditors of the private partner (if necessary).

Chapter 2. Calculation of cost of services in advisory support of projects of PPP

4. Depending on specifics of the project of PPP for calculation of cost of specific service correction coefficients to the cost of services in advisory support of projects of public-private partnership according to appendix 1 to this Technique by multiplication of the amount of the corresponding coefficients by the cost of 1 person hour and normative labor costs are used:

P = with * l * (k1 + k 2) + exp,

where: P – the cost of service in advisory support of projects of PPP excluding tax on value added;

with – the cost of 1 man-hour excluding tax on value added;

l – basic normative labor costs per unit of service, according to appendix 2;

k – correction coefficients to the cost of services;

exp – expenses on binding of the design estimates, the standard project, the prototype project solution, project of repeated application (if necessary).

Man-hour cost on republican projects constitutes the 6th 358, (((six thousand three hundred fifty eight tenges fifty seven tiyn) tenge excluding tax on value added.

Man-hour cost on local projects affirms the corresponding legal act of local executive body determining the legal entity on rendering advisory maintenance.

5. Calculation of working costs for preparation of the project documentation, and also expenses for binding of the design estimates of the standard project, prototype project solution, project of repeated application is performed according to the order of the Chairman of Committee on cases of construction and housing and communal services of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan of December 1, 2022 No. 223-HK "About approval of regulating documents on pricing in construction".

6. Accredited legal entities are involved in services in advisory support of projects of PPP. Proceeding from specifics of projects of PPP services of the third parties are attracted by the service provider (if necessary).
