About aquaculture

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) aquaculture - the activities connected with cultivation and (or) content, cultivation of objects of aquaculture;

2) aquaculture objects - fishes, water mollusks and Crustacea who get divorced and contain, grown up by subjects of aquaculture;

3) juveniles of objects of aquaculture - the impregnated caviar, larvae, fingerlings, yearlings and the two-year-olds of objects of aquaculture intended for their cultivation and (or) content, cultivation, and also stocking of reservoirs;

4) fish-breeding and biological reasons in the field of aquaculture (further - biological reasons) - complex of the scientifically based recommendations developed as a result of researches and scientific data, assessment of current status and potential of fishery reservoirs and (or) sites, fish ponds, fish-breeding pools and also use of the technologies connected with cultivation and (or) content, cultivation of objects of aquaculture;

5) authorized body in the field of aquaculture (further - authorized body) - the central executive body performing management and cross-industry coordination in the field of aquaculture;

6) subjects of aquaculture - the physical and (or) legal entities performing the activities connected with cultivation and (or) content, cultivation of objects of aquaculture;

7) information system of aquaculture - the information system of authorized body intended for monitoring and the analysis of development of aquaculture, maintaining the register of subjects of aquaculture and traceability of objects of aquaculture, including the products of its conversion, and also for collection and forming supplied and the information, ensuring digitalization in the field of aquaculture;

8) fish breeding - the direction of aquaculture connected with cultivation and (or) content, cultivation of fishes;

9) the fish-breeding pool - the reservoir and (or) design which are unsteadily connected with the earth, intended for cultivation and (or) content, cultivation of objects of aquaculture;

10) fish-breeding objects - the non-capital constructions (mobile complex, structures of container execution taken under one roof or separate) built on the water preserving strip, intended for finding of technicians, oborudovaniye for incubation of caviar, podrashchivaniye of juveniles of objects of aquaculture, storage of products of aquaculture, forages, fishing gears, special devices (cages), and also protection of objects of aquaculture;

11) fish pond - artificially framed technology reservoir intended for cultivation and (or) content, cultivation of objects of aquaculture which is filled with water by means of water management and (or) hydrotechnical constructions or other devices;

12) installation of the closed water supply - installation with system of circulation of water on the closed cycle using mechanical and biological cleansing and other components for the purpose of effective use of water for maintaining aquaculture.

Article 2. The legislation of the Republic of Kazakhstan in the field of aquaculture

1. The legislation of the Republic of Kazakhstan in the field of aquaculture is based on the Constitution of the Republic of Kazakhstan and consists of this Law and other regulatory legal acts of the Republic of Kazakhstan.

2. The international agreements ratified by the Republic of Kazakhstan have priority before this Law. The procedure and conditions of action in the territory of the Republic of Kazakhstan of international treaties which participant is the Republic of Kazakhstan are determined by the legislation of the Republic of Kazakhstan.

Article 3. Purposes and tasks of this Law

1. The purposes of this Law are:

1) sustainable development of aquaculture by creation new and (or) expansions of the operating productions;

2) growth in volumes of cultivation of competitive objects of aquaculture;

3) safety of objects of aquaculture for life and health of the person and the environment.

2. Tasks of this Law are:

1) enhancement of the investment climate and development of the export potential of objects of aquaculture and products of its conversion;

2) support of implementation of the innovation and (or) industrial technologies and processes in the field of aquaculture for increase in efficiency of activities of subjects of aquaculture;

3) development of science, preparation and advanced training of workers in the field of aquaculture;

4) saturation of the domestic market by domestic production of aquaculture;

5) the state stimulation in the field of aquaculture;

6) ensuring development of production of organic products of aquaculture according to the Law of the Republic of Kazakhstan "About production and turnover of organic products".

Article 4. The principles of legislative regulation in the field of aquaculture

The principles of legislative regulation in the field of aquaculture are:

1) rational use of fishery reservoirs and (or) sites for the purpose of non-admission of harm to water biological resources and the circle of their dwelling;
