1. Approve the enclosed Rules of establishment of cost of researches, consulting services.

2. Declare invalid the order of the Chairman of the Agency of the Republic of Kazakhstan for public service of May 4, 2023 No. 100 "About approval of Rules of cost determination of researches, consulting services and the state task" (No. 32448) is registered in the Ministry of Justice of the Republic of Kazakhstan on May 5, 2023.

3. To provide to legal department of the Agency of the Republic of Kazakhstan for public service in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Agency of the Republic of Kazakhstan for public service.

3. To impose control of execution of this order on the chief of staff of the Agency of the Republic of Kazakhstan for public service.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of establishment of cost of researches, consulting services

Chapter 1. General provisions

1. These rules of establishment of cost of researches, consulting services (further - Rules) are developed according to Item 2 of Article 14 of the Budget code of the Republic of Kazakhstan and establish procedure for establishment of cost of researches, consulting services.

2. In these rules the following concepts are used:

1) social research - the research directed to the studying of social processes and the phenomena which is characterized by the comprehensive analysis of object of research, also receipt of reliable data for their subsequent use in the solution of the existing problems;

2) researches - the applied, basic, strategic scientific research performed by subjects of scientific and (or) scientific and technical activities within research, developmental and technological works, proper scientific methods and means for the purpose of achievement of results of scientific and (or) scientific and technical activities;

3) consulting services - services in determination and assessment of problems, the opportunities arising in the course of activities of state body or for the detailed analysis of situation; on development of effective recommendations about correction of further actions for increase in financial and managerial overall performance (within the following main types of services: management consulting, administrative and personnel consulting, finance consulting, IT consulting, legal consulting, specialized consulting, consulting in the field of defense, technical consulting services);

4) establishment of cost - the events held by the Agency of the Republic of Kazakhstan for public service for establishment of cost of researches, consulting services.

Chapter 2. Procedure for establishment of cost of researches, consulting services

3. The cost of researches, consulting services includes:

1) direct expenses:

expenses on compensation of the workers performing researches, consulting services, but no more average monthly nominal wage in the corresponding industry (professional, scientific and technical activity) on the republic, according to the latest published official statistical data for the last 12 months (the salary, the social tax, social contributions to the State Social Insurance Fund, contributions of employers to Fund of social medical insurance, compulsory pension contributions of employers);

traveling expenses (journey, accommodation and daily allowance);

the printing expenses necessary it is direct for researches, consulting services;

information services (platform for carrying out video conferencing, platform for holding online polls, programs of statistic analysis of data, access to information bases to libraries);

transportation expenses;

communication services (expenses on mail service, Internet, telephony);

translation services;

acquisition of the materials which are directly used for carrying out research, rendering consulting service;

expenses on conducting check on determination of degree of originality of results (check on plagiarism) researches;

2) conditional fixed expenses:

expenses on fee of the involved external experts (subcontractors);

expenses on stock acquisition (cost determination of the goods and materials necessary for researches, consulting services;

3) the value added tax determined according to the requirements provided by the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code) which shall be determined from total cost of services. Control of correctness of charge of the value added tax by the customer is exercised in the arithmetic way, responsibility for conducting tax accounting is born by the potential contractor.

4. Information on collection of cost of projects goes the customer to at least three potential contractors within thirty calendar days after approval by the customer of subjects of researches, consulting services.

5. Each expenditure item when carrying out research, rendering consulting service is created by the customer with use of the database of goods prices, works, services established by the legislation of the Republic of Kazakhstan on public procurements as reference point when calculating for expense types for each budget program. At the same time, is guided by the price which is not exceeding the actual average price for the commodity unit, works, services provided in the database of the prices. In case of absence in the database of the prices the documents proving the planned expenses (copies of agreements, price lists) are used.

6. In case of impossibility of accomplishment of separate tasks, the main contractor has the right to attraction of third parties and physical persons for carrying out researches, consulting services which is performed on the basis of the conclusion of the civil transaction with third parties and physical persons.

7. The cost of researches, consulting services is established according to Rules of planning of the budget (the order of the Ministry of Finance of RK of April 29, 2025 No. 208), and calculation of cost of researches, consulting services according to appendix to these rules.
