Some questions of the state registration of genetically modified organisms

According to Article part five 21, of Article part seven paragraph two 22, of Article part six paragraph two 23, "About state regulation of genetic and engineering activities and the state control of placement in the market of genetically modified organisms and products" the Cabinet of Ministers of Ukraine decides parts five of article 24 of the Law of Ukraine:

1. Approve enclosed:

Procedure for the state registration (re-registration) for genetically modified organisms;

Procedure for suspension of the state registration of genetically modified organisms;

Procedure for consideration of objection concerning the request for the state registration of genetically modified organisms;

the commitment form on the state registration of genetically modified organisms;

the application form about the state registration of genetically modified organisms;

requirements to the request for the state registration of genetically modified organisms.

2. Determine that the State register of genetically modified organisms of grades of agricultural plants in open system stops the functioning from the date of entry into force of this resolution. The owner of register information is the Ministry of Agricultural Policy and Food. The public and owners are informed on legal effects of the termination of the specified register by promulgation of information on the official website of the Ministry of Agricultural Policy and Food.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

4. This resolution becomes effective along with the Law of Ukraine of August 23, 2023 No. 3339-IX "About state regulation of genetic and engineering activities and the state control of placement in the market of genetically modified organisms and products".

Procedure for the state registration (re-registration) for genetically modified organisms

1. This Procedure determines the procedure of the state registration and re-registration of genetically modified organisms, in particular procedures:

giving and consideration of the request for the state registration of genetically modified organisms (further - the request) for the state registration of genetically modified organisms or continuation of such registration by re-registration;

decision making about the state registration (re-registration) of genetically modified organism or about refusal in the state registration (re-registration) of genetically modified organism.

2. In this Procedure the term "the owner of the state registration of genetically modified organism (further-the owner)" means physical person, the physical person - the entrepreneur or the legal entity concerning whom based on the decision on the state registration (re-registration) of genetically modified organisms data on genetically modified organisms are entered in the State register of genetically modified organisms (further - the state register).

Other terms are used in the value given in the Laws of Ukraine "About state regulation of genetic and engineering activities and the state control of placement in the market of genetically modified organisms and products", "About access to public information" and "About ministerial procedure".

3. Administrative productions on the cases provided by this Procedure are performed according to the Law of Ukraine "About ministerial procedure" taking into account the features established By the law Ukraine "About state regulation of genetic and engineering activities and the state control of placement in the market of genetically modified organisms and products" (further - the Law) and this Procedure.

4. For the state registration (re-registration) of genetically modified organisms person who intends to perform such registration (further - the applicant) submits to Minagropolitiki the application which includes the documents provided by part one of article 21 of the law according to the commitment form on the state registration of genetically modified organisms approved by the resolution of the Cabinet of Ministers of Ukraine of May 21, 2025 No. 584 "Some questions of the state registration of genetically modified organisms".

The request is drawn up in writing according to requirements to the request for the state registration of the genetically modified organisms approved by the resolution of the Cabinet of Ministers of Ukraine of May 21, 2025 No. 584 "Some questions of the state registration of genetically modified organisms".

Data on account details for transfer of means for services in the state registration (re-registration) of genetically modified organisms will be promulgated on the official website of Minagropolitiki.

The petition in any form of determination of the certain information containing in the request confidential with the corresponding reasons can be attached to the request by the applicant. Minagropolitiki within five working days considers such petition and makes the decision on reference of information to confidential according to the Law of Ukraine "On access to public information" taking into account requirements of the Law.

Minagropolitiki gives the applicant about the made decision on reference information to confidential within seven working days before date of promulgation of the summary (the short description) of the registration file (except confidential information) on the official website.

Responsibility for accuracy of the information, provided in the request, the applicant bears.

5. The documents (their copy) submitted or received by person can be given or received:

in paper form - means of mail service;

electronically - technical means of electronic communications.

The copies of documents provided by the applicant in paper form shall be certified by the sign manual of the applicant or person authorized by him.

The documents (their copy) filed by the applicant electronically shall conform to requirements of the Law of Ukraine "About electronic documents and electronic document management".

On the documents (their copy) submitted by the applicant electronically the qualified digital signature, the advanced digital signature which is based on the qualified digital signature certificate and/or electronic seal is imposed.
