About approval of the Procedure for leave of material values of the state reserves and recognition voided some Resolutions of the Cabinet of Ministers of Ukraine

According to Article 13 and part five of article 15 of the Law of Ukraine "About the state reserves" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for leave of material values of the state reserves which are applied.

2. Determine that:

before origin at the administrator of electronic trading system of technical capability of receipt of data by electronic information exchange of the state electronic information resources users add to the statement for participation in auction electronic copies of the documents provided by paragraphs the fourth - the ninth Item 22 of the Procedure approved by this resolution with observance of requirements of the resolution of the Cabinet of Ministers of Ukraine of January 17, 2018 No. 55 "Some questions of documentation of management activity" (The Official Bulletin of Ukraine, 2018, No. 23, the Art. 770);

prior to functioning of the Unified register of the state reserves rezervant (residents) create and submit reports on leave of material values in connection with their refreshening to the State agency on management of reserves in paper or electronic form with observance of requirements of Item 12 of the Procedure for maintaining the Unified register of the state reserves and provisions of the access to it approved by the resolution of the Cabinet of Ministers of Ukraine of September 26, 2024 No. 1120 (The Official Bulletin of Ukraine, 2024, No. 90, the Art. 5803), and resolutions of the Cabinet of Ministers of Ukraine of January 17, 2018 No. 55 "Some questions of documentation of management activity".

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

Procedure for leave of material values of the state reserves

1. This Procedure determines the procedure of leave of material values of the state reserves (further - material values) by their realization, voluntary conveyance to certain receiver (consumer) or sales at the auction held in electronic trading system.

2. In this Procedure terms are used in the following value:

1) auction - the method of sale of lot in electronic trading system to the buyer who offered top price consisting in repeating of process of advance in price in three rounds in real time;

2) auction for method of step-by-step decrease in the starting price and the subsequent submission of price offers - the method of sale of lot in electronic trading system providing automatic step-by-step decrease in the starting price of lot with the subsequent possibility of additional submission of price offers;

3) free transfer - leave of material values of the state material reserve to the ministries determined by the Cabinet of Ministers of Ukraine, another central and to local executive bodies, Council of Ministers of the Autonomous Republic of Crimea for satisfaction of strategic needs of Ukraine or needs of Ukraine during the special period;

4) remuneration of the operator of an electronic trading platform - the sum of money which shall be paid to the operator of an electronic trading platform, through which the highest price proposal is submitted, and is calculated from the auction of the guarantee fee paid by the winner for each acquired lot;

5) the guarantee fee - method of ensuring accomplishment by the participant of obligations on participation in auction according to which the user grants the sum for acquisition of participant status of auction by money transfer into the account of the operator of an electronic trading platform;
