About implementation of the investment project

(Extraction)

For the purpose of further development of modern infrastructure of networks of telecommunication on the basis of implementation for the benefit of the state, citizens and business of new information and communication technologies, improvement of quality and availability of the rendered services of telecommunication:

1. Implement in 2025-2034 the investment project on implementation in the Republic of Belarus of network of cellular mobile telecommunication on IMT-2020 technology for model of the single infrastructure operator, having included in structure of this network single network of cellular mobile telecommunication on LTE/LTE-Advanced technology (further - the investment project).

2. Determine the single infrastructure operator of single network *, the customer by development of the project documentation and construction of facilities of single network ** and the investor realizing the investment project, Belorusskiye oblachnye tekhnologii LLC (further - the infrastructure operator) which is granted the right to creation, operation, expansion and upgrade of single network at the expense of own and (or) raised funds, and also on rendering services with its use based on civil agreements on condition of ensuring equal access *** operators of telecommunication to single network.

* The single network is understood as the single network of cellular mobile telecommunication in the territory of the Republic of Belarus created on LTE/LTE-Advanced and IMT-2020, technologies with use of which services of cellular mobile telecommunication in LTE/LTE-Advanced technologies and IMT-2020 can be rendered.

** Objects of single network are understood as the objects of telecommunication created by construction including upgrade (technical upgrade), including the existing objects of single network of cellular mobile telecommunication on LTE/LTE-Advanced technology, with use of means of telecommunication and the radio-electronic means using LTE/LTE-Advanced and IMT-2020, technologies or by their installation in (on) the existing capital structures (buildings, constructions), their parts, other engineering objects and technology platforms.

*** Equal access is understood as creation for all operators of telecommunication of the Republic of Belarus of uniform technical, organization-legal and commercial conditions.

3. Authorize Operational analytical center in case of the President of the Republic of Belarus on the conclusion on behalf of the Republic of Belarus with the infrastructure operator of the investment agreement on implementation of the investment project (further - the investment agreement) and coordination of works on its execution.

The investment agreement is signed without carrying out its financial and economic assessment, and also without consideration of the proposal of the infrastructure operator, preparation and decision making of Operational analytical center in case of the President of the Republic of Belarus about the conclusion of the investment agreement.

4. Provide to the infrastructure operator:

4.1. payment by installments of introduction of payment for allocation of radio-frequency range monthly equal shares for a period of five years from decision date about allocation of strips of radio frequencies with the right of its early repayment;

4.2. the right to preferential allocation to the period till December 31, 2034 the rights, suitable for realization, provided according to Item 2 of this Decree, the free strips of radio-frequency range including released after their conversion.

5. Determine that:

5.1. the services of cellular mobile telecommunication rendered by operators of cellular mobile telecommunication on LTE/LTE-Advanced and IMT-2020, technologies are provided to subscribers of cellular mobile telecommunication with use of all of the base stations of single network operated by the infrastructure operator;

5.2. for the period till December 31, 2034 the gross profit of the infrastructure operator is exempted from the taxation by the income tax;

5.3. concerning objects of the single network, engineering and transport infrastructure necessary for ensuring its functioning (further - infrastructure), the environmental impact assessment is not made;

5.4. the parcels of land for construction and servicing of objects of single network and infrastructure are provided to the infrastructure operator in lease for a period of 99 years without holding the auction and collection of payment for the lease right, and also in permanent and (or) in temporary use:

without their inclusion in lists of the free (unoccupied) parcels of land and lists of the parcels of land for implementation of investment projects;

with the right of removal of objects of flora without implementation of compensation payments of cost of the deleted objects and compensation landings. The received wood is implemented in the procedure established by the legislation;

without compensation of the losses of agricultural and (or) forestry and landscape production caused by seizure of land from farmlands, lands of forest fund and (or) lands of other categories on which the woods are located for their use for the purpose of, not connected with maintaining rural and (or) forestry;

without indemnification, caused the state organizations and economic societies, shares (share in authorized fund) of which are in state-owned property (in proportion to the share in authorized fund which is in state-owned property), withdrawal or temporary occupation of the parcels of land, demolition of the real estate units located on them.

Registration of materials on withdrawal of the parcels of land is made based on the statement of the infrastructure operator along with performance of works on designing and construction of facilities of single network and infrastructure on condition of availability of the act of the choice of the location of the parcel of land (if preliminary approval of the location of the parcel of land is required). In this case occupation of the parcel of land without document certifying the right to it is not unauthorized;

5.5. on the provided parcel of land or by its provision it is allowed within the permitted engineering loadings according to the decision of the infrastructure operator to perform construction of facilities of single network and infrastructure based on the amount of the project documentation approved with territorial subdivision of architecture and the town planning of local executive and administrative organ of primary or basic territorial level of the outline sketch and determined by the infrastructure operator allowing to confirm observance of safety requirements, without:

developments of preproject (pre-investment) documentation;

receipts of allowing documentation, collection of basic data;

passings of stipulated by the legislation examinations of the project documentation;

implementation of supervision in the field of architectural, town-planning and construction activities, except for the state construction supervision.

Acceptance for operation of the objects of single network and infrastructure specified in part one of this subitem is performed according to the procedure, stipulated by the legislation in the field of architectural, town-planning and construction activities, taking into account the features established in appendix 1;
