About approval of the Exhaustive list of questions concerning observance of requirements of the legislation on road transport which is checked during conducting raid check by officials of Public service of Ukraine on safety on transport

According to the paragraph the second Item 5 of the Procedure for the conducting raid checks (checks on the road) approved by the resolution of the Cabinet of Ministers of Ukraine of November 08, 2006 No. 1567 (in edition of the resolution of the Cabinet of Ministers of Ukraine of February 07, 2025 to No. 141), I ORDER:

1. Approve the Exhaustive list of questions on observance of requirements of the legislation on road transport which is checked during conducting raid check by officials of Public service of Ukraine on safety on the enclosed transport.

2. To provide to department of technical regulation on transport submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. To provide to the sector of external communications promulgation of this order on the official website of the Ministry of development of communities and the territories of Ukraine.

4. This order becomes effective from the date of entry into force of the resolution of the Cabinet of Ministers of Ukraine of February 07, 2025 No. 141 "About modification of the procedures approved by resolutions of the Cabinet of Ministers of Ukraine of November 8, 2006 No. 1567 and of May 19, 2023 No. 513, and recognition voided some resolutions of the Cabinet of Ministers of Ukraine", but not earlier than day of its official publication.

5. To impose control over the implementation of this order on the deputy minister Sergey Derkacha.

The exhaustive list of questions concerning observance of requirements of the legislation on road transport which is checked during conducting raid check by officials of Public service of Ukraine on safety on transport

I. Domestic transports of passengers

1. Regular passenger traffic

1. Availability and provision by the driver for verification of documents based on which transportation is carried out:

1) car driver license of the corresponding category;

2) registration documents on the vehicle;

3) scheme of route;

4) schedule;

5) the table of fare (except city transportations);

6) the original of endurance from the authority for the move of passengers on interregional routes public;

7) protocol of check of technical condition of the vehicle;

8) agreement of compulsory insurance of civil responsibility;

9) under control of bus on route up to 50 kilometers long inclusive:

the individual control book of the driver or the copy of the schedule of working in shifts of drivers, either the driver's card, or information from the operating and confided tachograph (the filled registration leaves of work-rest schedule of drivers - takhokarta in the quantity established by the European agreement on work of crews of the vehicles which are carrying out the international motor transportations to which Ukraine is annexed according to the Law of Ukraine of September 07, 2005 No. 2819-IV "About accession of Ukraine to the European agreement on work of crews of the vehicles which are carrying out the international motor transportations (EUTR)" (further - EUTR)) or in case of the vehicle equipment the digital tachograph - information on work and rest of the driver which is printed out on paper;

10) under control of bus on route more than 50 kilometers long:

card of the driver or information from the operating and confided tachograph (the filled registration leaves of work-rest schedule of drivers - takhokarta in the quantity established by EUTR), or the form of confirmation of activities, or in case of the vehicle equipment the digital tachograph - information on work and rest of the driver (drivers) which is printed out on paper.

2. Observance by the driver(s) of the bus of certain route and schedule of movement of the bus.

3. Observance of the requirement for the direction in flight to bus routes more than 500 km long of two drivers.

4. Observance by the driver(s) of work-rest schedule.

5. Equipment of the wheel vehicle fire extinguisher.

6. Availability by bus of cliches according to the requirements provided by the Rules of provision of services of passenger road transport approved by the resolution of the Cabinet of Ministers of Ukraine of February 18, 1997 No. 176 (in edition of the resolution of the Cabinet of Ministers of Ukraine of September 26, 2007 No. 1184) (further - Rules of provision of services of passenger road transport).

7. Placement in inside of the bus of such information:

1) the statement from Rules of provision of services of passenger road transport regarding the rights and obligations of the driver and passenger, and on city the route-statement from Instructions for use urban passenger road transport;

2) designation of entrance and exit;

3) data on the size of penalty for stowaway journey and transportation of unpaid baggage;

4) the information about automobile carrier, about the signed insurance contract of responsibility (date of the conclusion, number), the insurer (the name, the location, contact information for the address), the size of insurance sum;

5) general passenger capacity with indication of separately number of places for sitting of passengers;

6) designation of the locations of emergency exits (with indication of method of their opening), the fire extinguisher, the first-aid kit and the button of the emergency stop;

7) text "Not smoke", "The place for passengers with children and persons with disability" with their simultaneous duplication by the international symbol of availability and sign of baby carriage (on city and suburban routes);

8) numbering of places when implementing long-distance and international carriages;

9) designation of places for persons with disability the relief pictogram.

8. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.

9. Availability of the corresponding license for economic activity on provision of services on transportation of passengers.

10. Accomplishment of conditions of the authority for the move of passengers on interregional routes public.

11. In transit organized groups of children by bus:

1) confirmation of years of service of management by bus at least 5 years;

2) availability of two drivers on the route which is going out of the settlement and which extent constitutes more than 250 kilometers;

3) coordination of route and schedule of movement with the customer and relevant division of National police of Ukraine.

2. Regular special passenger traffic

1. Availability and provision by the driver for verification of documents based on which transportation is carried out:

1) car driver license of the corresponding category;

2) registration documents on the vehicle;

3) copy of the passport of route marked "In";

4) copy of the contract with the customer of services and passport of route;

5) protocol of check of technical condition of the vehicle;

6) agreement of compulsory insurance of civil responsibility;

7) under control of bus on route up to 50 kilometers long inclusive:

8) under control of bus on route more than 50 kilometers long:

2. Observance by the bus driver of the approved schedule and traffic route.

3. Observance by the driver of work-rest schedule.

4. Equipment of the wheel vehicle fire extinguisher.

5. Availability by bus of cliches according to the requirements provided by Rules of provision of services of passenger road transport.

1) car driver license of the corresponding category;

2) registration documents on the vehicle;

3) contract with the customer of transport services;

4) the document certifying payment of transport services;

5) the copy of the agreement of obligatory personal accidents insurance on transport;

6) protocol of check of technical condition of the vehicle;

7) agreement of compulsory insurance of civil responsibility;

8) under control of bus on route up to 50 kilometers long inclusive:

the individual control book of the driver or the copy of the schedule of working in shifts of drivers, either card of the driver or information from the operating and confided tachograph (the filled registration leaves of work-rest schedule of drivers-takhokarty in the quantity established by EUTR), or in case of the vehicle equipment the digital tachograph - information on work and rest of the driver (drivers) which is printed out on paper;

9) under control of bus on route more than 50 kilometers long:

4. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.

5. Availability of the corresponding license for economic activity on provision of services on transportation of passengers.

5. Transportation of passengers by cars to order

1. Availability and provision by the driver for verification of documents based on which transportation is carried out:

1) car driver license of the corresponding category;

2) registration certificate of the vehicle;

3) copy of the contract with the customer of service;

4) protocol of check of technical condition of the vehicle;

5) agreement of compulsory insurance of civil responsibility.

2. Compliance of the number of passengers transported in the vehicle, its passenger capacity.

3. Availability of the corresponding license for economic activity on provision of services on transportation of passengers.

4. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.

6. Transportation of passengers by automobile self-employed carrier

1. Availability and provision by automobile self-employed carrier for verification of documents based on which transportation is carried out:

1) car driver license of the corresponding category;

2) registration certificate of the vehicle;

3) service book;

4) medical certificate;

5) protocol of check of technical condition of the vehicle.

2. Agreement of compulsory insurance of civil responsibility.

3. Availability of the corresponding license for economic activity on provision of services on transportation of passengers.

4. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.

7. Transportation of passengers by buses and cars for own needs

1. Availability and provision by the driver for verification of documents based on which transportation is carried out:

1) car driver license of the corresponding category;

2) registration documents on the bus;

3) the passenger manifest who are transported, certified by the signature of carrier;

4) protocol of check of technical condition of the vehicle;

5) agreement of compulsory insurance of civil responsibility.

2. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.

II. Freight transportation. Transportation of goods in the internal message

1. Availability and provision by the driver for verification of documents based on which transportation is carried out:

1) car driver license of the corresponding category;

2) registration documents on the vehicle;

3) commodity-transport delivery note or other determined by the legislation the document on freight;

4) protocol of check of technical condition of the vehicle;

5) agreement of compulsory insurance of civil responsibility;

6) for cargo vehicles with complete mass of more 3,5 of tons:

7) for cargo vehicles with complete weight to 3,5 of tons inclusive:

8) the sanitary book of the driver (freight forwarder) occupied with transportation of foodstuff with results of medical examination;

9) in case of transportation of dangerous goods:

the certificate on assumption of vehicles to transportation of certain dangerous goods;

the certificate on training of the transport drivers transporting dangerous goods;

the written instruction in case of accident or emergency situation according to the European Agreement on the international road delivery of dangerous goods to which Ukraine is annexed according to the Law of Ukraine of March 02, 2000 No. 1511-III "About accession of Ukraine to the European Agreement on the international road delivery of dangerous goods (DOPOG)".

2. Observance by the driver of requirements of work and rest.

3. Equipment of the wheel vehicle fire extinguisher.

4. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.

5. Proper fixture of freights (belts, links, extensions, cables, expansion crossbeams, anchor laths (beams), grids, etc.) according to:

DSTU EN 12195-1:2018 (EN 12195-1:2010; AC: 2014, IDT) "Devices of fixture of freight on wheel vehicles. Safety. Part 1. Calculation of forces of fixture";

DSTU EN 12195-2:2018 (EN 12195-2: 2000, IDT) "Devices of fixture of freight on wheel vehicles. Safety. Part 2. fixing coupling belts from chemical fibers";

DSTU EN 12195-3:2018 (EN 12195-3: 2001, IDT) "Devices of fixture of freight on wheel vehicles. Safety. Part 3. Fixing chains";

DSTU EN 12640:2018 (EN 12640: 2000, IDT) "Fixture of freight on wheel vehicles. Fixture points on cargo vehicles. Minimum requirements and testing";

DSTU EN 12641-1:2018 (EN 12641-1: 2005, IDT) "Demountable bodies and commercial vehicles. Tents. Part 1. Minimum requirements";

DSTU EN 12642:2018 (EN 12642: 2016, IDT) "Fixture of freight on wheel vehicles. Design of bodies of commercial wheel vehicles. Minimum requirements".

6. Observance of requirements to transportations of quickly spoiling freights, loose goods without container, explosive, flammable, caustic and toxic agents.

7. Availability of the corresponding license for economic activity on provision of services on transportation of dangerous goods.

8. Observance of requirements of dimensional and/or weight restrictions.

III. International carriages of passengers and freights

1. International carriages of passengers by residents of Ukraine

1. Availability at the transport driver of resident of Ukraine of documents based on which transportation is carried out:

1) permissions of the foreign countries on which territory it will be transported;

2) registration certificate of the vehicle;

3) the passenger manifest (in case of irregular and pendular transportations);

4) scheme of route;

5) registration leaves of work-rest schedule of the driver - takhokarta, and in case of the vehicle equipment the digital tachograph, listing on paper information on work and rest of the driver.

2. Observance of the requirement of installation and use on the vehicle of the survey meter (tachograph).

3. Observance by the driver(s) of work-rest schedule.

4. And more than 20 places for sitting of passengers (have implementation of transportations by buses which correspond to conditions of transportations and parameters of comfort in case of accomplishment of regular, irregular and pendular (shuttle) passenger international motor transportations which perform residents of Ukraine) (this requirement does not extend if transportation is carried out based on the Agreement on the international irregular carriages of passengers by buses to which Ukraine is annexed according to the Law of Ukraine of October 16, 2012 No. 5444-VI "About accession of Ukraine to the Agreement on the international irregular carriages of passengers by buses (the Agreement of INTERBUS)" (further - the Agreement of INTERBUS) according to which "buses" means vehicles which thanks to the design and the equipment are adapted for transportation more than nine people, including the driver, and are intended for such purposes).

5. Availability of stipulated by the legislation documentation and insurance contracts according to requirements of international treaties and legislations of foreign states.

6. Observance of requirements on:

implementation of control of vehicles by drivers which performed 21 years and which the last three years work as drivers of buses;

the direction in flight to bus routes more than 500 km long of two drivers.

7. Availability of the control document (INTERBUS magazine) according to the agreement of INTERBUS - in case of accomplishment of transportation based on this agreement.

8. Availability of the corresponding license for economic activity on provision of services on transportation of passengers.

9. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.

2. International carriages of passengers by nonresidents

1. Availability and provision by the driver for verification of documents based on which transportation is carried out:

1) permission of Ukraine;

2) registration certificate of the vehicle;

3) the passenger manifest (in case of irregular and pendular transportations);

4) registration leaves of work-rest schedule of the driver(s) - takhokarta, and in case of the vehicle equipment the digital tachograph - listing on paper information on work and rest of the driver(s).

2. Observance of the requirement of installation and use on the vehicle of the survey meter (tachograph).

3. Observance by the driver(s) of work-rest schedule.

4. Permission of the central executive body providing realization of state policy on safety issues on the land transport (in case of transportation of passengers between the Items located in the territory of Ukraine, the vehicles belonging to foreign carriers).

5. Confirmation of implementation by carrier of control of the state of health of the driver(s), technical, sanitary and ecological condition of the bus before departure on route.

6. Availability of the control document (INTERBUS magazine) according to the agreement of INTERBUS - in case of accomplishment of transportation based on this agreement.

7. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.

3. International carriages of freights by residents of Ukraine

1. Availability and provision by the driver for verification of documents based on which transportation is carried out:

1) permissions of the foreign countries on which territory freight transportation will be performed;

2) permission concerning coordination of conditions and modes of transportation - in case of excess of weight and/or dimensional restrictions, or the document on introduction of fare of heavy (large-size) vehicles - if excess of weight (dimensional) restrictions over determined by the legislation of Ukraine constitutes less than five percent;

3) registration certificate of the vehicle;

4) documents on freight;

5) registration leaves of work-rest schedule of drivers-takhokarty, and in case of the vehicle equipment the digital tachograph listing on paper information on work and rest of drivers;

6) the verified copy or extraction from the license for implementation of the international motor transportations of freights in paper form - in case of accomplishment of transportation within the Agreement between Ukraine and the European Union on freight transportation by road transport which is approved by the Presidential decree of Ukraine of September 16, 2022 No. 654 "About approval of the Agreement between Ukraine and the European Union about freight transportation by road transport" (dalee-Soglasheniye between Ukraine and the European Union about freight transportation by road transport);

7) supporting documents (agreement or shipping request; bills of lading or commodity-transport delivery notes, either cargo customs declarations, or books of MDP) - in case of the trip without freight performed by the vehicle the territory of Ukraine which carries out transportation within the Agreement between Ukraine and the European Union on freight transportation by road transport;

8) the visible and accurately identified sticker on windshield of the vehicles performing motor transportations on the sample determined in appendix and to the Agreement between Ukraine and the European Union about freight transportation by road transport - in case of accomplishment of transportation within this Agreement.

2. Observance of the requirement of installation and use on the vehicle of the survey meter (tachograph).

3. Observance by the driver(s) of work-rest schedule according to EUTR.

4. Availability of stipulated by the legislation documentation and insurance contracts according to requirements of international treaties and legislations of foreign states.

5. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.

6. Availability of the corresponding license for economic activity on provision of services on transportation of dangerous goods.

7. Availability of the certificate on compliance of vehicles to regulations of special vehicles for transportation of perishable foodstuff (the original or photocopy) or plates - certificates on compliance, issued according to the Agreement on international carriages of perishable foodstuff and about special means transport which are intended for these transportations which Ukraine joined according to the Presidential decree of Ukraine of April 02, 2007 No. 262 "About accession of Ukraine to the Agreement on international carriages of perishable foodstuff and about special vehicles which are intended for these transportations (UPSh)" (further - UPSh).

4. International carriages of freights by nonresidents

1. Availability at the transport driver of the nonresident of documents based on which transportation is carried out:

1) permission of Ukraine;

3) registration certificate of the vehicle;

4) documents on freight;

5) the certificate of conformity of the vehicle to requirements of the legislation of Ukraine concerning traffic safety and ecological safety if other is not provided by international treaties of Ukraine;

6) permission of the European conference of Ministers of Transport;

7) the verified copy of the license for implementation of the international motor transportations of freights in paper form - for the carriers registered in the EU (in case of accomplishment of transportation within the Agreement between Ukraine and the European Union on freight transportation by road transport), and carriers of the Kingdom of Norway;

8) supporting documents (agreement or shipping request; bills of lading or commodity-transport delivery notes, either cargo customs declarations, or books of MDP) - in case of trip without freight on the territory of Ukraine the vehicle registered in the EU, and which is carrying out transportation within the Agreement between Ukraine and the European Union on freight transportation by road transport;

9) the visible and accurately identified sticker on windshield of the vehicles performing motor transportations on the sample determined in appendix I to the Agreement between Ukraine and the European Union about freight transportation by road transport - in case of accomplishment of transportation within this agreement;

10) installation and use of the control device - the tachograph;

11) registration leaves of work-rest schedule of drivers - takhokarta, and in case of the vehicle equipment the digital tachograph - listing on paper information on work and rest of drivers.

2. Observance by the driver(s) of work-rest schedule according to EUTR.

3. Permission of the central executive body providing realization of state policy on safety issues on the land transport (in case of accomplishment of transportation of goods between the Items located in the territory of Ukraine, the vehicles belonging to foreign carriers).

4. Accomplishment of instructions on elimination of violations of requirements of the legislation of Ukraine on road transport.
