About approval of the Regulations on import to the Republic of Moldova and realization of hop and products from hop

Based on part (1) article 21 of the Law No. 306/2018 on safety of foodstuff (The official monitor of the Republic of Moldova, Art. No. 59-65, 120), with subsequent changes, DECIDES: the Government

1. Approve Regulations on import to the Republic of Moldova and realization of hop and products from hop it (is applied).

2. The order of the Government No. 1020/2016 about approval of Requirements to import and realization of hop and products from hop (2016, Art. No. 293-305, 1105) to declare the official monitor of the Republic of Moldova invalid.

3. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

4. This resolution becomes effective after 6 months from the date of publication in the Official monitor of the Republic of Moldova.

This Provision:

- partially shifts (shifts Article 1, Items a) - b) Articles 2, Items a) - i) Articles 3, the paragraph (1) and Items a) - f) the paragraph (2) Article 7 and appendix I) the Delegated Regulations of the Commission (UE) 2024/602 of December 14, 2023 supplementing Regulations (UE) No. 1308/2013 of the European parliament and Council concerning standards of realization in the sector of hop and canceling Regulations of the Commission (EU) No. 1850/2006, CELEX: 32024R0602, published in the Official magazine of the European Union by L 2024/602 of February 16, 2024.

Chapter I. Scope

1. This Provision establishes rules of packaging, labeling, realization, import to the country and quality control of hop and products from hop (further – products).

2. This Provision is applied to the products falling under goods items 1210 and 130213000 of the Combined commodity nomenclature approved by the Law No. 172/2014.

Chapter II. Determinations

3. For the purposes of this provision concepts which mean the following are used:

1) the certificate on equivalence – the official document equivalent to the certificate issued by the European Union on the hop and products from hop which confirms information on quantity and quality of hop and products from hop issued by the state which is not the member of the European Union;

2) the certificate – the official document equivalent to the certificate on equivalence which confirms information on quantity and quality of hop and products from hop, issued by the member state of the European Union according to the European Union law;

3) hop with seeds – the hop realized with content of seeds more than 2% to the mass of hop after drying;

4) hop without seeds – the hop realized with content of seeds no more than 2% to the mass of hop after drying;

5) the raw hop – the hop which underwent only preliminary drying and preliminary packaging;

6) the processed hop – the hop which underwent final drying and final packaging;

7) hop production site – production zones or regions which list is constituted by the corresponding state members;

8) shipment (batch) – certain quantity of the products having identical characteristics, shipped by at the same time same sender to the same receiver;

9) cones of hop or hop – inflorescences (female individuals) of climber hop (Humulus lupulus); these inflorescences of chartreuse color, oval form, with one peduncule, and their maximum length usually fluctuates from 2 to 5 cm;

10) hop powder – the product received by hop crushing, containing all its natural components;
