1. Approve the enclosed Rules of implementation of paid types of activity on sales of goods (works, services) by public institution in the sphere of sortoispytaniye, use of money by it from sales of goods (works, services) remaining at its order according to appendix 1 to this order.

2. Recognize invalid some orders of the Minister of Agriculture of the Republic of Kazakhstan according to the list according to appendix 2 to this order.

3. To provide to department of agriculture of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

About approval of Rules of implementation of paid types of activity on sales of goods (works, services) by public institution in the sphere of sortoispytaniye, use of money by it from sales of goods (works, services) remaining at its order

1. These rules of implementation of paid types of activity on sales of goods (works, services) by public institution in the sphere of sortoispytaniye, use of money by it from sales of goods (works, services) remaining at its order (further – Rules), are developed according to Item 5 of Article 102 of the Budget code of the Republic of Kazakhstan (further – the Budget code) and determine procedure of paid types of activity by sales of goods (works, services) by public institution in the sphere of sortoispytaniye, use of money by it from sales of goods (works, services) remaining at its order.

2. In these rules the following basic concepts are used:

1) the receiver of paid services – the physical person or legal entity receiving paid services according to these rules;

2) sortoispytaniye – examination and testing of selection achievement for patentability and the economic usefulness which are carried out according to the Rules of carrying out sortoispytaniye of agricultural plants approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of July 2, 2015 No. 4-2/602 (it is registered in the Register of state registration of regulatory legal acts No. 11879).

3. Paid types of activity on sales of goods (works, services) by public institution in the sphere of sortoispytaniye are performed according to article 25 of the Law of the Republic of Kazakhstan "About protection of selection achievements" and article 23-4 of the Law of the Republic of Kazakhstan "About seed farming".

4. Paid types of activity on sales of goods (works, services) by public institution in the sphere of sortoispytaniye are provided to the receiver of paid services based on the statement in form according to appendix 1 to these rules, and also in case of receipt from the expert organization of the copy of the request for patent grant on selection achievement (further – the request for patent grant).

5. The application is considered by the executive in charge of public institution in the sphere of sortoispytaniye within 10 (ten) working days from the date of registration of a statement.

By results of consideration of the application the executive in charge of public institution in the sphere of sortoispytaniye directs to the receiver of paid services to the e-mail address the notification on adoption of the statement (further – the notification) in form according to appendix 2 to these rules.

If the statement contains incomplete data, to the receiver of paid services the notification on refusal in adoption of the statement in form according to appendix 3 to these rules goes.

6. Within 10 (ten) working days from the date of issue of the notification or receipt of the request for patent grant between public institution in the sphere of sortoispytaniye and the receiver of paid services the contract for rendering paid types of activity on sales of goods (works, services) in the sphere of sortoispytaniye is signed (further – the agreement). The contract between the parties is signed according to the civil legislation of the Republic of Kazakhstan.

7. The goods prices (works, services) made and (or) realized by public institution in the sphere of sortoispytaniye are established according to the order of the Minister of Agriculture of the Republic of Kazakhstan of January 31, 2020 No. 30 "About price fixation on the goods (works, services) made and (or) realized by public institutions in the sphere of sortoispytaniye" (it is registered in the Register of state registration of regulatory legal acts No. 19995).

The prices from sales of products received as a result of sortoispytaniye of agricultural plants are determined according to the market prices which developed in the region at the time of realization.

The list of necessary documents, the price list of goods prices (work, service) are placed on Internet resource of public institution.

8. Fee is performed by means of cash through cash desks of public institution in the sphere of sortoispytaniye using cash registers with function of fixing and (or) data transmission and issue of the control check (the Webkassa 2.0) hardware and software or on clearing settlement by transfer to the current account of public institution in the sphere of sortoispytaniye "The control account of cash of paid services".
