1. Approve the enclosed Rules of interaction of state bodies and terms of provision of the register of functions of the central and (or) local executive bodies transferred to competitive environment, attracting parafiscal payments in authorized body in the field of tax policy.

2. To provide to development department of system of public administration of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation within five working days from the date of signing of this order its direction for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan and on Internet resource of the Ministry of national economy of the Republic of Kazakhstan after official publication.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of interaction of state bodies and terms of provision of the register of functions of the central and (or) local executive bodies transferred to competitive environment, attracting parafiscal payments in authorized body in the field of tax policy

Chapter 1. General provisions

1. These rules of interaction of state bodies and terms of provision of the register of functions of the central and (or) local executive bodies attracting parafiscal payments in authorized body in the field of tax policy (further - Rules) are developed according to Item 2 of Article 55 of the Budget code of the Republic of Kazakhstan and determine order of interaction of the state bodies and terms of provision of the register of functions of the central and (or) local executive bodies transferred to competitive environment, attracting parafiscal payments in authorized body in the field of tax policy.

2. In these rules the following basic concepts are used:

1) authorized body in the sphere of development of system of public administration (further - authorized body) - the central executive body performing management and cross-industry coordination on transfer of function of the central and (or) local executive bodies in competitive environment;

2) the register of functions of state bodies - the classified list of functions of the central state and local executive bodies;

3) parafiscal payments - the obligatory target payments established by the laws of the Republic of Kazakhstan which are paid by physical persons and legal entities for benefit of the separate legal entities rendering services as a result of transfer of function of the central and (or) local executive body to competitive environment, and pursuing the socially significant aims;

4) the register of functions of the central and (or) local executive bodies transferred to competitive environment, attracting parafiscal payments (further - the register) - the list of functions created by authorized body based on the data provided by the central and (or) local executive bodies;

5) authorized body in the field of tax policy - the central executive body performing management and cross-industry coordination in the sphere of tax policy.

Chapter 2. Order of interaction of the state bodies and terms of provision of the register of functions of the central and (or) local executive bodies transferred to competitive environment, attracting parafiscal payments in authorized body in the field of tax policy

3. For forming of the register the authorized body annually to 20 sends on the (twentieth) of January inquiry to the central and local executive bodies for provision of the list of the functions transferred in competitive environment attracting parafiscal payments, in the accounting period, constituted on the basis of the register of functions of state bodies.

4. The central and local executive bodies no later than 10 (ten) working days from the date of receipt of request provide information on the register of functions of the central and (or) local executive bodies transferred to competitive environment, attracting parafiscal payments on form according to appendix to these rules.

5. By results of consideration of the provided information in case of establishment of its incompleteness the authorized body to 15 submits on the (fifteenth) of February recommendations in the central and (or) local executive body of need of completion of the provided information.

6. The central and (or) local executive body from the date of receipt of recommendations within 10 (ten) working days finishes information and repeatedly sends it to authorized body.

7. The authorized body annually not later 10 on the (tenth) of March on the basis of the acquired information creates the register and sends it to Department of tax and customs policy of the Ministry of national economy of the Republic of Kazakhstan which keeps the register of parafiscal payments and performs the analysis regarding their preserving, abolition or transfer to the budget.

8. The register is not created in the absence of functions of the central and local executive bodies which are subject to transfer to competitive environment, attracting parafiscal payments.
