About approval of the Procedure for carrying out mutual recognition of results of assessment of conformity by authorized bodies on assessment of conformity

For the purpose of implementation of the Agreement on procedure and conditions of the elimination of technical barriers in mutual trade with the third countries signed by state members of the Eurasian Economic Union on November 22, 2021 in the city of Moscow approved by the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Agreement on procedure and conditions of elimination of technical barriers in mutual trade with the third countries" of June 24, 2022 No. 337, according to article 24 of the Law of the Kyrgyz Republic "About technical regulation in the Kyrgyz Republic" articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve the Procedure for carrying out mutual recognition of results of assessment of conformity by authorized bodies on assessment of conformity according to appendix.

2. This resolution becomes effective after fifteen days from the date of official publication.

Procedure for carrying out mutual recognition of results of assessment of conformity by authorized bodies on assessment of conformity

Chapter 1. General provisions

1. The procedure for carrying out mutual recognition of results of assessment of conformity by authorized bodies on assessment of conformity (further - the Procedure) establishes procedure of carrying out mutual recognition of results of assessment of conformity by authorized bodies for assessment of conformity for the purpose of determination and comparability of the mandatory requirements established by technical regulations of the Eurasian Economic Union (further - the Union), concerning products released within the Union, and the requirements established by the legislation of the third country concerning products released in the territory of the third country.

2. In this Procedure the following concepts are used:

1) documents on assessment of conformity - documents which according to the Agreement on the Eurasian Economic Union (further - the Agreement on the Union), requirements of technical regulations of the Union and (or) acts of the Eurasian economic commission or the legislation of the third countries are processed by results of assessment of conformity;

2) technical barriers in mutual trade - differences of requirements in the sphere of technical regulation, including the technical regulations of the Union, standards and assessment procedures of compliance applied within the Union from requirements in the sphere technical regulations, including the normative and technical documents regulating obligatory for application in the territory of the third country of the requirement to objects of technical regulation, the standards and assessment procedures of compliance applied in the third country concerning the types of products of the same name, the creating obstacles in mutual trade of state members with the third countries;

3) the third country - the state or merging of the states which is not member of the Union;

4) authorized body on assessment of conformity - the conformity assessment body authorized on work on mutual recognition of results of assessment of conformity, included in the Unified register of conformity assessment bodies of the Union.

Other concepts used in this Procedure are applied in the values determined by the Agreement on the Union.

3. Mutual recognition between the Kyrgyz Republic and the third country of results of assessment of conformity of objects of technical regulation to mandatory requirements which are received by authorized bodies on assessment of conformity and the third country respectively (further - mutual recognition) is carried out based on the signed international treaties of the Union within the Agreement on procedure and conditions of the elimination of technical barriers in mutual trade of state members with the third countries signed by state members of the Eurasian Economic Union on November 22, 2021 in the city of Moscow (it is approved by the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Agreement on procedure and conditions of elimination of technical barriers in mutual trade with the third countries" of June 24, 2022 No. 337).

4. The procedure of mutual recognition of results of assessment of conformity is carried out by the conformity assessment bodies authorized according to Regulations on authorization of conformity assessment bodies on work to requirements of technical regulations and/or mutual recognition of results of assessment of conformity of objects of technical regulation to mandatory requirements (it is approved by the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About authorization of conformity assessment bodies and introduction of amendments to some resolutions of the Cabinet of Ministers of the Kyrgyz Republic in the sphere of assessment of conformity" of August 14, 2024 No. 469).

5. The procedure of mutual recognition of results by authorized bodies for assessment of conformity is performed only concerning products included in the list of products (groups, products types) the international treaty of the Union concerning which technical barriers are eliminated.

6. Documents for holding procedure of mutual recognition of results of assessment of conformity are submitted in the state and (or) official languages. For authenticity of the translation of the original of the text responsibility is born by the applicant.

7. The choice of authorized body on assessment of conformity for holding procedure of mutual recognition is performed by the applicant.

The circle of applicants in case of assessment of conformity is established by the technical regulation of the Union.

The authorized body on assessment of conformity has no right to carry out works on mutual recognition if the applicant on assessment of conformity does not perform activities in the territory of the Kyrgyz Republic and is not citizen of the Kyrgyz Republic.

Chapter 2. Procedure of mutual recognition by authorized bodies for assessment of conformity

8. Applicant:

1) submits the application for holding procedure of mutual recognition to authorized body in paper or electronic type with use of the information system "Single Window" according to appendix 1;

2) makes payment for work on carrying out mutual recognition;
