About approval of Methodology of calculation of rates for the services provided by Public institution "Inventory of real estate", the List of services and the size of rates for them

Based on part (3) article 13 of the Law No. 1543/1998 on the inventory of real estate (repeated publication: The official monitor of the Republic of Moldova, 2021, Art. No. 88-89, 79), with subsequent changes, parts (4) article 32 of the Law No. 98/2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), with subsequent changes, DECIDES: the Government

1. Approve:

1.1. Methodology of calculation of rates for the services provided by Public institution "Inventory of real estate" according to appendix No. 1;

1.2. The list of services which are within the exclusive competence of Public institution "Inventory of real estate", and the size of rates for them, according to appendix No. 2.

2. The list of the services provided by Public institution "Inventory of real estate" which do not enter its exclusive competence and the size of rates for them affirm Public institution "Inventory of real estate" after coordination with the Agency of geodesy, cartography and the inventory.

3. On issue of the rates for the services provided by Public institution "Inventory of real estate", statements from information resources of Public institution "Inventory of real estate" on paper or in the form of the electronic document to persons with the heavy, expressed or average limited opportunities provided in item 4 of appendix No. 3 to Methodology of calculation and also pensioners - receivers of old-age pension according to the Law No. 156/1998 on the public pension system to perform fee at the expense of the means of the government budget which are annually provided for the Agency of geodesy, cartography and the inventory.

4. In the Order of the Government No. 966/2020 about services, the state services provided by the Agency (Official monitor of the Republic of Moldova, 2020 No. 372-382, of the Art. 1145), with subsequent changes, to make the following changes:

4.1. 3) of Item 3 of the resolution to declare the subitem invalid;

4.2. in the table in appendix No. 4 to appendix No. 1 to the resolution to exclude the Section "Cadastral Services";

4.3. in appendix No. 2 to the resolution:

4.3.1. in the table:

4.3.1.1. exclude the Section 5 "Cadastral Services";

4.3.1.2. 6.1.4 to exclude line item;

4.4. to declare the Section 4 of appendix No. 3 to the resolution invalid.

5. This resolution becomes effective after 2 months from the date of publication in the Official monitor of the Republic of Moldova.

Methodology of calculation of rates for the services provided by Public institution "Inventory of real estate"

I. General provisions

1. The purpose of this Methodology is establishment of single method of calculation and adjustment of rates for the services provided by Public institution "Inventory of real estate".

2. For the purposes of this Methodology the following concepts are used:

2.1. rate - the amount levied for provision of one service;

2.2. the raising coefficient - the numerical coefficient of increase in rate established depending on service provision options;

2.3. service provision options - various options of determination of rates for service depending on the term of its provision;

2.4. time regulation - the size of costs of working hours established for accomplishment of action by one worker or employee group of the corresponding qualification in certain organizational specifications.

3. This Methodology establishes:

3.1. structure and procedure of payments of rates;

3.2. structure and method of cost determination and the expenses included

in calculation of rate;

3.3. procedure for adjustment of rates for the provided services.

4. At the heart of the mechanism used to calculation and regulation of rates the following principles lie:

4.1. guarantee of fair and non-discriminatory conditions of provision of services;

4.2. provision of services to receivers on real cost;

4.3. covering of costs and maintenance costs of Public institution "Inventory of real estate" for ensuring its continuous and sustainable development.

5. This Methodology is applied when calculating rates for services which are within the exclusive competence of Public institution "Inventory of real estate" and are specified in appendix No. 1.

II. Structure of rate for the provided services

6. The rate (T) for the provided services based on provisions of this Methodology includes:
