Based on Art. 14-1 of h (3), Art. 14-2 - 14-4 Laws No. 235/2011 of on activities for accreditation and assessment of conformity, Art. 13 of h (1) the item h) the Law No. 420/2006 of on technical regulation, item 50 of the Technical regulation on the minimum requirements to deliveries of construction products approved by the Order of the Government No. 913/2016 of, and the item of 9 subitems 11) of Regulations about the organization and functioning of the Ministry of infrastructure and regional development, approved by the Order of the Government No. 690/2017 of, PRIKAZYVAYU:

1. Approve the Procedure of recognition of conformity assessment bodies for the purpose of notification it (is applied).

2. I impose control of execution of this order on myself.

3. This order becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

The procedure of recognition of conformity assessment bodies for the purpose of notification

I. General provisions

1. This Procedure establishes requirements for recognition for the purpose of notification of conformity assessment bodies by the Ministry of infrastructure and regional development (further - MIRR).

2. MYRRH recognizes conformity assessment bodies (further - OOS) which carry out the specific tasks on assessment of conformity shifted by the harmonized legislation of Community and/or regulations of their application, its competences which are in limits.

3. MYRRH recognizes OOS for which respect for the requirements/criteria established in applicable technical regulations for the purpose of notification is confirmed by accreditation by the National center for accreditation of MOLDAC (further - MOLDAC).

4. For the analysis of statements for provision, expansion, reducing, suspension or withdrawal of recognition, MIRR creates the Commission on the recommendation of recognition of OOS (further - the Commission) which performs the activities based on provisions of this Procedure and Regulations of the organization and the functioning provided in appendix No. 1 to this Procedure.

5. Members of the commission, at each meeting, surely, sign the Declaration on impartiality and confidentiality provided in appendix No. 2 to this Procedure.

6. The regulations and structure of the Commission affirm MIRR.

II. Recognition and expansion of area of recognition

7. For the purpose of recognition or expansion of area of recognition for activities in the regulated OOS area sends to MOLDAC along with the request for accreditation/reaccreditation request for recognition or expansion of area of recognition.

8. MOLDAC within 5 working days after accreditation provision (issue of the decision) sends to MIRR document package which includes:

8.1. the original of the request for provision or, in case of need, on expansion of area of recognition which shall contain the following information:

8.1.1. registration number / date;

8.1.2. full name of OOC;

8.1.3. complete address, postal index, phone, e-mail;

8.1.4. name and surname of the official representative of OOS;

8.1.5. the reference standard on which OOS requests recognition;

8.1.6. technical regulations and other regulations for the purpose of recognition;

8.1.7. list of personnel;

8.1.8. list of the equipment;

8.1.9. list of subcontract activities;

8.2. the valuation report for the purposes of recognition or expansion of area of recognition constituted by MOLDAC after provision of accreditation or expansion of area of accreditation;

8.3. decision of MOLDAC on accreditation or expansion of area of accreditation;

8.4. the certificate of accreditation, confirmatory that OOS conforms to the requirements provided by the technical regulation which represents object of recognition, including appendices/appendices to it, the issued MOLDAC (copies);

8.5. the name and code of products or the groups of products which are subject to assessment and also the applicable regulation;

8.6. the name of Assessment procedure of compliance of products which are subject to assessment.

9. Consideration of the documents submitted for recognition or expansion of area of recognition, creation of the minutes of the Commission and the publication of the order is carried out within 15 working days from the date of receipt of document package.

10. Based on the decision of the Commission on provision or expansion of area of recognition of MIRR issues the order on provision or expansion of area of recognition. This order is transferred to MOLDAC which, in turn, shall inform OOC.

11. In case of adoption by the Commission of the decision on refusal in provision or expansion of area of recognition of MIRR officially informs MOLDAC on refusal in provision or expansion of area of recognition with indication of at the same time causes of failure within 5 working days from the date of approval of the minutes of the Commission. MOLDAC in turn shall inform OOC.

12. The refusal in provision or expansion of area of recognition can be challenged by OOC by the direction of preliminary request within 30 days from the moment of the notification to the address MYRRH according to provisions of the Administrative code No. 116/2018 of.

13. OOS has the right to issue certificates only after the publication of the order on its recognition.

14. Recognition or expansion of area of recognition is provided on effective period of the certificate of accreditation.

15. Information on acknowledged OOS joins MOLDAC in the Register of acknowledged conformity assessment bodies available which is kept it on its official site.

III. Reducing, suspension or withdrawal of recognition

16. MYRRH by order of reduces, stops or withdraws recognition of OOS in cases, stipulated in Article 14-4, parts (4) - (6), the Law No. 235/2011 of on activities for accreditation and assessment of conformity. Reducing, suspension or withdrawal of recognition are performed at the request of acknowledged OOS or based on the decision of MOLDAC, and also in the cases established by the existing regulations.
