About youth and children's public organizations

(as amended on 26-11-2015)

This Law determines features of the organizational and legal basis of education and activities of youth and children's public organizations and the state guarantees of ensuring their activities.

Article 1. Legislation of Ukraine on youth and children's public organizations
Article 2. Determination of terms

In this Law terms are used in such value:

youth public organizations - consolidation of citizens age from 14 to 35 years which purpose is implementation of the activities directed to satisfaction and protection of the legitimate social, economic, creative, spiritual and other common interests;

children's public organizations - consolidation of citizens age from 6 to 18 years which purpose is implementation of the activities directed to realization and protection of the rights and freedoms, creative capability, satisfaction of own interests which do not contradict the legislation, and social formation as full-fledged members of society.

Article 3. Principles of education and activities of youth and children's public organizations

Youth and children's public organizations are formed and operate on bases of voluntariness, equality of their members, self-government, legality and publicity, in particular:

youth and children's public organizations shall bring to permission of the public of the data on the activities in forms which do not contradict the legislation;

information which contains in charters on structure of governing bodies, about sources of material and other receipts, and also connected with activities of youth and children's public organizations, is not confidential or other information which is protected by the law.

Article 4. Founders of youth and children's public organizations and their unions

Citizens of Ukraine, and also foreigners and stateless persons who stay in Ukraine on legal causes which reached 14-year age can be founders of youth and children's public organizations.

Founders of the unions of youth and children's public organizations are youth and children's public organizations.

Article 5. Membership in youth and children's public organizations

Membership in youth and children's public organizations can be individual and collective.

Membership in youth and children's public organizations can be fixed and unstable.

Citizens of Ukraine, and also foreigners and stateless persons which stay in Ukraine on legal causes can be individual members of youth and children's public organizations.

Persons aged from 14 up to 35 years, individual members of children's public organizations - persons aged from 6 up to 18 years can be individual members of youth public organizations. The introduction of minors is performed by age up to 10 years in children's public organizations in the written consent of parents, adoptive parents, guardians or custodians. Senior citizens can be members of youth and children's public organizations under condition if their quantity in these organizations does not exceed third of total quantity of members; as a part of elected bodies of youth and children's public organizations the number of senior citizens cannot but exceeds 10 percent of members of elected bodies.

Staff of other youth and children's public organizations can be collective members of youth and children's public organizations.

Collective members of the youth and children's organizations can participate in activities of such organizations in the cases provided by their charters.

Article 6. Status of youth and children's public organizations

The status of youth and children's public organizations and their unions is determined in connection therewith by the Law and the Law of Ukraine "About consolidation of citizens".

In the activities the Ukrainian national committee of the youth organizations is guided by the legislation of Ukraine and own charter.

The entry of the Ukrainian national committee of the youth organizations into the international youth organizations (associations, the unions and so forth) is not the basis for its registration as international.

Article 7. Rights of youth and children's public organizations

Youth and children's public organizations, their unions have the rights granted to them by the Law of Ukraine "About consolidation of citizens", this Law, other legal acts.

Youth and children's public organizations and their unions cannot form and enter the electoral blocs.

Youth public organizations can enter the selective coalitions.

The membership fees and donations received from legal entities or physical persons which go for implementation of authorized activities of youth and children's public organizations and their unions are not the taxation object.

Article 8. Participation of youth and children's public organizations in preparation and decision making concerning state policy concerning children and youth

Youth and children's public organizations are involved by executive bodies and local government bodies in development and discussion of drafts of decisions concerning state policy concerning children and youth.

Public authorities and local government bodies - initiators of development of the state target program post drafts of concepts of the state target programs which concern children and youth on the official web site, and also consider offers to them from youth and children's public organizations according to the procedure, determined by the law

Article 9. Forms of the state support of youth and children's public organizations

The state support of youth and children's public organizations is performed in such forms:

provision to youth and children's public organizations of information on state policy concerning children and youth;

provision of the methodical and organizational help with questions of social formation and development of youth and children;

assistance to creation of the companies, organizations and organizations which provide services to youth and children or help employment of youth.

Youth and children's public organizations are exempted from payment for state registration and the registration fee of their symbolics.

The state performs support and in other forms which do not contradict the legislation of Ukraine.

Article 10. Financial support of activities of youth and children's public organizations

Executive bodies and local government bodies give financial support of activities of youth and children's public organizations and their unions within the powers determined by the law.

Executive bodies and local government bodies involve in accordance with the established procedure youth and children's public organizations and their unions in accomplishment of orders for the state and local requirements.
