About measures for development of the competition and further increase in role of private sector in economy

For the purpose of ensuring execution of the Presidential decree of the Republic of Uzbekistan of August 30, 2024 with No. UP-132 "About Measures for Realization of the Tasks Determined in the Fourth Open Dialogue of the President of the Republic of Uzbekistan with Entrepreneurs", and also further development of the competition in the conditions of market economy, reducing the state participation in economy and creation of ample opportunities for private sector I decide:
I. Requirements for provision of exclusive rights.
1. Recognize as exclusive right the exclusive right provided to one or several business entities irrespective of pattern of ownership and to the state organizations on production of certain goods (rendering services, performance of works) or their realization or acquisition, and also rendering services of the single operator on the basis:
(a) permissions (right) provided by acts of the legislation according to the procedure of exception;
(b) the individual license (permission) provided out of general procedure. At the same time licenses (permission) provided on the basis of tender (tender) are not recognized quality of exclusive right.
2. Determine that the prices (rates) or their limits of the regulating coefficient, markups or marginal profitability on the goods (works and services) made, realized or acquired within exclusive rights by business entities who are granted such rights are regulated by authorized state body of price regulation by their approval.
3. Determine that since April 1, 2025 the exclusive right is granted to business entities based on the laws of the Republic of Uzbekistan, decrees and resolutions of the President of the Republic of Uzbekistan for the term which is not exceeding 3 years it is exclusive for the purpose of:
(a) providing the constitutional system, health of the population, defense capability of the Republic of Uzbekistan, state and public security, and also public order;
(b) preventions and liquidations of natural disasters, catastrophic crashes and epidemics.
II. Requirements imposed to business entities who are granted exclusive rights.
4. To the business entities included in the Register of business entities which are granted exclusive rights (further - the Register), irrespective of the size of revenue which arrived from sales of goods (works and services) last calendar year the following requirements are imposed:
(a) non-admission of infringement of the rights of consumers to acquisition of necessary amount of goods and goods of the proper quality level;
(b) not establishment of discrimination conditions in case of realization or purchase of goods;
(c) non-admission of unreasonable refusal of the conclusion of the agreement in the presence of possibility of production or realization of the corresponding goods;
(d) not collection of payment over stated price for goods to which the state price regulation, and also for not rendered services or services which shall be rendered free of charge is applied.
III. Activities on which exclusive rights are cancelled.
5. Cancel since April 1, 2025 exclusive rights on activities of the following business entities:
(a) JSC Uzbekekspertiza and its regional divisions - regarding issue of the certificate on the property imported by the companies with foreign investments for own production needs;
(b) Uzinzhiniring design institute - regarding development of the preproject and project documentation of investment projects;
(c) SUE National PR-center - regarding preparation and broadcast of producer and promotion services of the foreign companies, advertizing, reportings and other rollers of foreign broadcasting companies and other mass media allocated for promotion of tourist capacity of the Republic of Uzbekistan;
(d) Sag agro MTP LLC - regarding rendering walnut of services of mechanization to producers for holding agrotechnical actions;
(e) Public institution "Uzbek institute of standards" - regarding implementation of transfer of national standards into other languages on contractual basis.
6. Transfer to Committee on tourism of task SUE Center of Certification of Tourist Services on conducting inspection check to compliance to requirements of regulations for certification of tour operators, means of placement, ski slopes and beach services, to assignment by it of category, and also standardization of the certified services.
IV. Procedure for carrying out studying of activities on which exclusive rights are granted.
7. Since 2025 annually:
(a) till April 1 authorized state bodies in spheres on which exclusive rights are granted introduce in Committee on development of the competition and consumer protection (further - Committee on the competition) proposals on feasibility of cancellation or preserving exclusive rights of the business entities included in the Register;
(b) till May 1 together with the Ministry of Economics and finance, offers of authorized state bodies in spheres on which exclusive rights are granted are considered by Committee on the competition the Ministry of investments, industry and trade, and also Chamber of Commerce and Industry;
(c) till June 1 the Committee on the competition for adoption of the relevant resolution to the Cabinet of Ministers represents the generalized offers on feasibility of cancellation or preserving exclusive rights.
8. To committee on the competition till April 1, 2025 to carry out inventory count of the acts of the legislation providing exclusive rights, to create and publish their Register in mass media.
V. Organization, providing and control of execution of the Decree.
9. Make changes and additions to some acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan according to appendix.
10. Assign to deputy prime ministers D. A. Kuchkarov, Zh. A. Hodzhayev and A. Zh. Ramatov, and also the chairman of Committee on development of the competition and consumer protection of H. S. Turakhuzhayev the personal responsibility for the effective organization of execution of this Decree.
11. Implementation of coordination and the control of organization activity responsible for execution of this Decree to assign to the Prime Minister of the Republic of Uzbekistan A. N. Aripov.
