About approval of the Regulations on procedure for release and issue of the state hypothecation certificates for provision of government subsidies on construction, reconstruction of individual apartment houses to persons injured with the natural disasters which occurred in the territory of the Kyrgyz Republic

1. Approve the enclosed Regulations on procedure for release and issue of the state hypothecation certificates for provision of government subsidies on construction, reconstruction of individual apartment houses to persons injured with the natural disasters which occurred in the territory of the Kyrgyz Republic.

2. To the Ministry of Finance of the Kyrgyz Republic:

- release the state hypothecation certificates according to the created list of families, victims of natural disasters till January 1, 2017 (inclusive) provided by Department of construction engineering construction under the State agency of architecture, construction and housing and communal services under the Government of the Kyrgyz Republic

- provide repayment of the state hypothecation certificates by provision of government subsidies on construction of individual apartment houses, joint financing of the device of the base, framework (bearing walls) and roof, repayment of interest rates of commercial banks for the request of Department of construction engineering construction under the State agency of architecture, construction and housing and communal services under the Government of the Kyrgyz Republic;

3. To the territorial commissions on Civil protection:

- create lists of families, victims of natural disasters till January 1, 2017 (inclusive) and to submit for approval to the Ministry of emergency situations of the Kyrgyz Republic;

- since January 1, 2017 to stop the subsequent forming of lists of families, victims of natural disasters.

3-1. To the ministry of emergency situations of the Kyrgyz Republic till January 15, 2017 to transfer approved lists to the State agency on management of budget credits under the Ministry of Finance of the Kyrgyz Republic.

3-2. To department of construction engineering construction under the State agency of architecture, construction and housing and communal services under the Government of the Kyrgyz Republic:

- draw up with the State fund of development of economy under the Ministry of Finance of the Kyrgyz Republic the agreement on concession of the rights of requirements for credit and mortgage documentation on the long-term preferential loans issued according to the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for release and issue of the state hypothecation certificates for provision of government subsidies on construction, reconstruction of individual apartment houses to persons injured with the natural disasters which occurred in the territory of the Kyrgyz Republic" of May 8, 2007 No. 155 and providing return according to Regulations on procedure for provision of non-interest long-term preferential loans on construction and recovery of individual apartment houses for citizens of the Kyrgyz Republic, the injured events which took place in June, 2010 in the territory of the city of Osh, the Osh and Jalal-Abad regions the approved order of the Government of the Kyrgyz Republic of September 1, 2010 No. 182;

- provide in accordance with the established procedure transfer of credit and mortgage documentation in the State agency on management of budget credits under the Ministry of Finance of the Kyrgyz Republic and notify debtors on change of the creditor and the settlement account after the conclusion of the above-named agreement.

3-3. Under the Ministry of Finance of the Kyrgyz Republic based on the submitted credit and mortgage documentation to provide to the state fund of development of economy return of the allocated budget advances in accordance with the established procedure.

4. Publish this resolution in mass media.

I. General provisions

1. This Provision establishes procedure for release and issue of the state hypothecation certificates for provision of government subsidies on construction, reconstruction of individual apartment houses to persons injured with the natural disasters which occurred in the territory of the Kyrgyz Republic according to the laws of the Kyrgyz Republic on the republican budget of the Kyrgyz Republic for the corresponding year, "About individual housing construction in the Kyrgyz Republic", "About pledge", the order of the Government of the Kyrgyz Republic" of February 6, 2007 No. 37 "About measures for mitigation of consequences of the earthquakes which occurred on December 26, 2006 in the territory of the Naryn and Issyk kul regions, on January 8, 2007 in the territory of Batken Province and modification of some decisions of the Government of the Kyrgyz Republic" and other regulatory legal acts of the Kyrgyz Republic.

II. Concepts and terms

2. In this Provision the following concepts and terms are used:
