The State Parties of this agreement which are hereinafter referred to as with the Parties

being guided by provisions of Articles of organization of the Agreement on collective security (further - the Organization), Agreements on collective security of May 15, 1992 and other documents accepted in its development

proceeding from need of acceptance of further practical measures on ensuring comprehensive preparation of the railroads of the Parties for steady and smooth functioning and implementation of transportation of loads for needs of economy, to ensuring military and humanitarian transportations, decrease in efficiency of impact of the expected opponent on the railroads and objects of rail transport, to recovery in the shortest possible time of the interrupted train service in peace and wartime,

agreed as follows:

Article 1

The parties create single system of technical cover of the main (priority) railway directions on network of the railroads of state members of the Organization and confirm intention to accelerate process of rapprochement of national legal systems of the Parties for the purpose of creation of conditions of equal responsibility and equal opportunities of the Parties concerning creation of single system of technical cover and rail line restoration.

Article 2

For the purposes of this agreement the applied terms mean:

"technical cover of the railroads of the Parties" - complex of the engineering, technical and organizational actions performed in peace and wartime for comprehensive preparation of objects, constructions and devices of the operated network of the railroads, recovery and operational forces and means (military units of railway troops, the Ministries of Defence, special forming and the recovery organizations of bodies of the Parties knowing questions of rail transport) for performance of works on mitigation of consequences of impact of the opponent on railway system of the Parties;

"Unified plan of technical cover of the main (priority) railway directions on network of the railroads of state members of the Organization" - the document in which the covered network of the railroads of the Parties, structure of forces and the funds raised to accomplishment of tasks on the organization of technical cover and rail line restoration are determined;

"rail line restoration" - complex of the interconnected actions and works which are carried out on the destroyed railway objects and constructions for recovery of the interrupted train service;

"special forming" - not militarized recovery organizations created in system of the transport ministries and departments of firmly established states approved with the Ministry of Defence and intended for recovery, content, technical cover and rail road construction in special conditions;

"authorized bodies" - the state bodies determined by national legal systems of the Parties under which authority questions of state regulation of technical cover of the railroads are;

"staff of military units of railway troops" the military personnel passing military service as a part of military units, the organizations and organizations of railway troops and also the civil personnel working in military units, the organizations and organizations of railway troops;

"staff of special forming" - the civil personnel working in special forming which are involved in technical cover and rail line restoration of the Parties, and assigned to these special forming;

"command of connection of railway troops" - command of the railway troops intended for the organization of accomplishment of actions of technical cover and rail line restoration in the territories of the Parties and temporarily directed to the territories of other State Parties of the Agreement;

"sending party" - the state which directs military units of railway troops and/or special forming to the territory another (others) the Party (Parties);

"host party" - the state in the territory of which for accomplishment of objectives military units of railway troops and/or special forming another (others) the Party (Parties) temporarily are placed or through the territory of which is performed transit of military units of railway troops and/or special forming another (others) the Party (Parties);

"personal estate of military units of railway troops, special forming" - the personal estate which is property of the sending party: regular (organic) military and technical property, all types of arms and ammunition to it, the equipment, transport, special and other material means necessary for functioning of military units of railway troops and/or special forming;

"real estate (real estate objects)" - the parcels of land and barracks located on them, premises, utility constructions, access railway tracks, polygons, stationary control centers, communication centers, stationary means of radio engineering and navigation providing, the building and construction of arsenals, storage bases, warehouses and other immovable infrastructure facilities which are property of the host party and being from its consent in temporary use of military units of railway troops and/or special forming of other Parties;

"the main (priority) railway directions" the railway directions intended for the fastest solution of questions of transport service of the Parties on which the complex of actions of technical cover and recovery in case of their destruction is carried out first of all;

"construction and recovery materials" - the materials and designs intended for construction and recovery of the railway directions;

"the proving materials" - auxiliary materials for acceptance in the shortest possible time of reasoned decision on recovery of object in case of its destruction serving for assessment of probable nature and amounts of destructions of constructions and devices of the railroads, development of possible options of recovery of movement in the shortest possible time, determinations of approximate amounts of recovery work and the need for forces and means, preparation of basic data for calculation of regulations of accumulating in mobilization reserve of the railroads of materials, designs, the equipment, inventory property, machines, mechanisms and equipments for the purpose of recovery and their rational placement on network of roads.

Article 3

The parties shall create single system of technical cover of the main (priority) railway directions of network of the railroads of state members of the Organization till 2005, having assigned coordination of planning and implementation of actions of technical cover and rail line restoration, accomplishment of this agreement and implementation of decisions of Council of collective security of the Organization (further - Council) about use of railway troops and special forming of the Parties to the Ministry of Defence of the Russian Federation (Command of Zheleznodorodny troops).
