About approval of procedure for receipt of information necessary for registration of representation for issue of the residence permit to foreigners and stateless persons

According to part of the eighteenth article 5 of the Law of Ukraine "About legal status of foreigners and stateless persons" the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for receipt of information necessary for registration of representation for issue of the residence permit to foreigners and stateless persons which is applied.

Procedure for receipt of information necessary for registration of representation for issue of the residence permit to foreigners and stateless persons

1. This Procedure determines the mechanism of receipt of information necessary for preparation of representation of the Ministry of Defence or the Ministry of Internal Affairs provided by part of the eighteenth article 5 of the Law of Ukraine "About legal status of foreigners and stateless persons" (further - representation), that the foreigner or the stateless person in the period of warlike situation in Ukraine render/rendered shooting, tactical, radio engineering, explosive, medical and other care to divisions of Armed Forces, National guard, including divisions of territorial defense, voluntary forming of territorial communities, being directly in areas of conducting combat operations, and together with such divisions accept/participated in accomplishment of fighting or office tasks within at least six months (further - the help).

2. For registration of representation of the Ministry of Defence and the Ministry of Internal Affairs will organize preparation of information on provision by the foreigner or the person without citizenship (further - the applicant) the help based on their address or the address of their representative.

The address of the applicant shall contain the following information:

surname, own name, middle name (in the presence), including in English;

birth date;

details of the identity document of the applicant;

data on nationality;

residence (place of stay);

phone number (in the presence);

e-mail address (in the presence);

information on help given by the applicant;

the other information important for disclosure of essence of the address.

In case of the addressing of the representative of the applicant the address are applied:

identity document of the representative of the applicant;

the document confirming powers of the person as the applicant's representative.

3. The Ministry of Defence or the Ministry of Internal Affairs within three working days after receipt of the address, the stipulated in Item 2 presents of the Procedure, sends to National police inquiry for the purpose of receipt of data on information availability concerning the applicant in databanks of information system of International Criminal Police Organization - the Interpol.

The national police not later than within two weeks after receipt of request sends information concerning the applicant to body which directed it.

4. The Ministry of Defence or the Ministry of Internal Affairs within three working days after receipt of the address, the stipulated in Item 2 presents of the Procedure, sends inquiry to the relevant divisions of Armed Forces, National guard, divisions of territorial defense or voluntary forming of territorial communities (further - divisions) for the purpose of receipt of information on factual determination of belonging of the applicant to persons from among foreigners or stateless persons which in the period of warlike situation in Ukraine render/gave help.

5. The commander of division after receipt of request, the stipulated in Item 4 presents of the Procedure, draws up the information reference according to appendix which shall contain the following data:

surname, own name and middle name (in the presence) the applicant who was rendering/giving help to division;

full name of division;

the period during which the applicant renders/gave help to division;

the description of the help (including fighting or office tasks with indication of places of their accomplishment).

The data stated in information to the reference shall be supported by the relevant documents which are at the disposal of the commander of division (orders, orders, telegrams, acts and other documents).

6. The commander of division bears legal accountability for entering into the information reference of obviously false information.

7. In case of absence in division of information about the applicant the commander of division informs on this Ministry of Defence or the Ministry of Internal Affairs electronically.

8. The information reference or information specified in Item 7 of this Procedure within 30 days from the date of receipt of request goes division to the Ministry of Defence or the Ministry of Internal Affairs with use of electronic document management system with imposing of the qualified digital signature of the commander of division.

9. The information reference received by the Ministry of Defence or the Ministry of Internal Affairs is the basis for representation registration.

10. Representation together with information of National police, the stipulated in Item 3 presents of the Procedure, and the information reference goes the Ministry of Defence or the Ministry of Internal Affairs electronically with use of system of electronic interaction of executive bodies to GMS with imposing of the qualified digital signature of the authorized person of the Ministry of Defence or the Ministry of Internal Affairs with the simultaneous notification to the applicant (his representative).
