About measures for the effective organization of the state control in the field of construction and housing and communal services

For the purpose of strengthening of the state control and the prevention of conflict of interest in the field of construction and housing and communal services, ensuring efficient state quality control of building and construction works and compliance of their project documentation, and also management of apartment dwelling stock, use of heat supply, rendering services of drinking water supply and sewering and their use I decide:

I. Purposes

1. Determine main objectives of enhancement of the state control in the field of construction and housing and communal services:

(a) forming of Inspectorate for control in the field of construction and housing and communal services (further - Inspection) as independent republican executive body, and also the prevention of conflict of interest;

(b) complete digitalization of functions of control in the field of construction, managements of apartment houses, and also drinking water supply and sewering until the end of the current year;

(c) forming of the mechanisms of the control system performed by private sector till July 1, 2025.

II. Enhancement of mechanisms of control

2. Determine that since May 1, 2025:

(a) in case of the conclusion of the contract (the public offer) between the entrepreneur and territorial inspectorates for control in the field of construction and housing and communal services (further - territorial inspections) short-term actions of the state control of construction on construction objects of subjects of entrepreneurship are performed within terms of the contract and are not registered in the information system "Single State Control";

(b) Intervention in financial and economic activities of business entities irrespective of their sources of financing is strictly forbidden to inspection in the course of implementation of the state control of observance of rules of management and content of apartment houses.

3. Implement since September 1, 2025 for each object under construction the passport with QR code. At the same time to create possibility of obtaining through the passport with QR code of information on subjects of town planning, construction terms, about town-planning documentation (conceptual designs) and the approved experimental testimonies.

4. Establish procedure according to which:

(a) modification of structural components and load bearing walls of apartment houses, their demolition and implementation of the works which are negatively influencing seismic stability of the building with violation of town-planning regulations in case of reconstruction and re-planning of rooms in apartment houses, and also cellars is forbidden;

(b) since July 1, 2025 the procedure for carrying out technological audit of all objects of system of drinking water supply and sewering without fail on contract basis is entered.

5. Since July 1, 2025:

(a) in territorial inspections step by step to create the Center of online maintenance of construction objects;

(b) as experiment in 2025 on again under construction objects in the Kashkadarya region to establish video cameras at the expense of means of the Government budget;

(c) when implementing the state control in the field of construction and housing and communal services to use mobile video cameras (bodi-cameras) and special tablets;

(d) directly to transfer the data obtained from mobile video cameras (bodi-cameras), special tablets and video cameras to the Center of online maintenance of construction objects;

(e) to simplify procedure for consideration of acceptance of administrative measures concerning persons which violated requirements of acts of the legislation on town planning in the information system "E-mamuriy ish".

6. Till September 1, 2025 to integrate the following data into the electronic platform "The State Control in Construction" of the National information system "Transparent Construction":

(a) data in integration information system of the inventory and registration of the real estate of UZKAD of the Agency according to the inventory about the total used area of apartment houses and the parcels of land adjoining to them, and also about owners of apartments, cadastral numbers and cadastral drawings;

(b) data in billing system of JSC Uzsuvtajminot on addresses and number of consumers, about indicators of counters of water, amounts of the spent water and about debts, about sewering, about the new covered consumers and other information.

III. Forming of mechanisms of system of private control

7. Establish procedure according to which since July 1, 2025:

(a) control of works on construction and reconstruction of individual apartment houses, non-residential buildings and constructions of small amount is conducted by private sector (further - control of private construction);

(b) control of private construction is exercised by the project organization having the license for activities for development of architectural and town-planning documentation and which developed architectural part of the design estimates of construction object (further - the designer), on contract basis;

(c) after completion of works on construction (reconstruction) on objects of control of private construction by the designer the conclusion in the National information system "Transparent Construction" is created and it is represented to the customer;

(d) issue of the permission to operate of object where works on construction (reconstruction) are complete, is performed by departments of construction and housing and communal services of the respective area (city) (in the city of Tashkent - district departments of construction);

(e) in case of not monitoring procedure of private construction or in the absence of the positive conclusion of the designer who controlled acceptance of objects in operation is forbidden.

8. Objects of control of private construction are:

(a) individual apartment houses it is not higher than two floors (without the first floor) not higher than 12 meters high from earth surface and (or) with a total area no more than 500 square meters (without subsidiary economic structures);

(b) non-residential buildings, constructions and structures of lung like (design) in construction amount no more than 300 cubic meters.

IV. Institutional reforms

9. To transfer inspectorate for control in the field of construction and housing and communal services under the Ministry of Construction and Housing and Communal Services to subordination of the Cabinet of Ministers.

10. Approve:

(a) Priority activities of Inspectorate for control in the field of construction and housing and communal services under the Cabinet of Ministers according to appendix No. 1;

(b) Organizational structure of Inspectorate for control in the field of construction and housing and communal services under the Cabinet of Ministers according to appendix No. 2.
