About perpetuating of memory of the victims of genocide of the Soviet people in the period of the Great Patriotic War of 1941 - 1945

In view of the deliberate, in advance planned by political, economic and military authorities of Nazi Germany nature of the war crimes and crimes against humanity committed concerning the Soviet people in days of the Great Patriotic War of 1941 - 1945 established by sentence of the International military tribunal in Nuremberg and other judgments proceeding from idea that respect for memory of the victims of these crimes, and also honoring of strength of mind of the Soviet people which showed unity and firmness in fight against Nazis and their helpers is holy duty of all citizens, considering need of international cooperation, for the purpose of maintenance of the universal peace and consent, non-admissions of manifestations of Nazism in any form this Federal Law is adopted.

Chapter 1. General provisions

Article 1. Perpetuating of memory of the victims of genocide of the Soviet people

1. Memory of the victims of genocide of the Soviet people which died in the period of the Great Patriotic War of 1941 - 1945 is subject to perpetuating.

2. For the purpose of this Federal Law genocide of the Soviet people the actions of Nazis and their helpers in the period of the Great Patriotic War of 1941 - 1945 directed to complete or partial extermination of the national, ethnic and racial groups inhabiting the territory of the USSR by murder of members of these groups, causings severe harm to their health, violent hindrance to child-bearing, forced transfer of children, forced relocation or other creation of the vital conditions expected physical extermination of members of these groups are recognized.

Article 2. Forms of perpetuating of memory of the victims of genocide of the Soviet people

1. The main forms of perpetuating of memory of the victims of genocide of the Soviet people are:

1) burial and reburial of remains of the victims of genocide of the Soviet people, preserving and improvement of burials of remains of the victims of genocide of the Soviet people, installation of the memorial constructions and objects immortalizing memory of the victims of genocide of the Soviet people;

2) carrying out the search work directed to identification of unknown burials of remains of the victims of genocide of the Soviet people, establishment and preserving names of the victims of genocide of the Soviet people;

3) construction of memorable signs, creation of the museums, and also separate exposures and exhibitions, including in the museums of the educational organizations;

4) the publication in mass media, book editions and placement on the Internet of materials about genocide of the Soviet people;

5) creation of the works of art and literature devoted to memory of the victims of genocide of the Soviet people;

6) carrying out scientific research and distribution of information on results of scientific research;

7) inclusion in federal main general education programs (including in federal working programs of education), the main general education programs, the main professional educational programs of the materials developed based on the historical sources and devoted to memory of the victims of genocide of the Soviet people;

8) recognition inadmissible public justification of genocide of the Soviet people and Nazi ideology, implementation of actions for counteraction to their promotion.

2. According to the decision of public authorities and local government bodies, public national associations, public associations perpetuating of memory of the victims of genocide of the Soviet people can be performed in other forms.

Chapter 2. Burials of remains of the victims of genocide of the Soviet people

Article 3. Burials of remains of the victims of genocide of the Soviet people

Burials of remains of the victims of genocide of the Soviet people are places of burial of the civilian population and the prisoners of war who died as a result of genocide of the Soviet people with the gravestones which are on them, monuments, elements of barrier and other memorial constructions and objects. Mass and individual graves at general cemeteries and out of cemeteries, columbaria and ballot boxes with ashes of the victims of genocide of the Soviet people belong to burials of remains of the victims of genocide of the Soviet people.

Article 4. Procedure for burial (reburial) for remains of the victims of genocide of the Soviet people

Burial (reburial) of remains of the victims of genocide of the Soviet people will be organized and carry out authorized bodies of the government of subjects of the Russian Federation.

Article 5. Procedure for reference of places of burial to burials of remains of the victims of genocide of the Soviet people

1. Reference of places of burial to burials of remains of the victims of genocide of the Soviet people is determined by the national operator by perpetuating of memory of the victims of genocide of the Soviet people according to the procedure, established by federal executive body, the representative for perpetuating of memory of the victims of genocide of the Soviet people.

2. The national operator on perpetuating of memory of the victims of genocide of the Soviet people informs on reference of the place of burial to burial of remains of the victims of genocide of the Soviet people authorized body of the government of the subject of the Russian Federation in the territory of which the place of burial, within ten working days from the date of decision making about reference of the place of burial to burial of remains of the victims of genocide of the Soviet people is revealed.

Article 6. State accounting, content and improvement of burials of remains of the victims of genocide of the Soviet people

1. Burials of remains of the victims of genocide of the Soviet people are subject to the state accounting within six months from the date of completion of works on their burial (reburial). In the territories of subjects of the Russian Federation account of such burials is kept by local government bodies.

2. On each burial of remains of the victims of genocide of the Soviet people the memorable sign is established and the passport is constituted. The procedure for the state accounting and certification of burials of remains of the victims of genocide of the Soviet people is established by federal executive body, the representative for perpetuating of memory of the victims of genocide of the Soviet people.

3. The maintenance responsibility in proper condition of burials of remains of the victims of genocide of the Soviet people in the territory of the subject of the Russian Federation is conferred on local government bodies.

4. On burial of remains of the victims of genocide of the Soviet people the texts and designations containing information on such burial shall be established (further - information texts and designations).
