About information system of exchange of information about foreign citizens and persons without citizenship

For the purpose of the organization of information exchange of data electronically between the Republic of Belarus and the Russian Federation I decide:

1. Create till April 1, 2025 information system of exchange of data on crossing of border at the check points issued, cancelled, recognized invalid and the withdrawn entry visas, departure, stay and transit (transit), and also about the identity documents issued, cancelled, recognized invalid and withdrawn, the foreign citizens and persons without citizenship staying or living in the territory of the State Parties of the Agreement on creation of the Union State of December 8, 1999 (further - the Agreement on creation of the Union State), documents for visit of the international cultural and (or) sporting events (further - information system of exchange of data).

2. Determine that:

2.1. functioning of information system of exchange of data is aimed at providing efficiency of realization of state policy in the sphere of migration registration and control of stay of the foreign citizens and stateless persons who are temporarily staying, temporarily or constantly living in the territory of the State Parties of the Agreement on creation of the Union State (further - foreigners), by means of collection, storage and electronic submission of data:

about crossing by foreigners of border at check points;

about the permissions issued, cancelled, recognized invalid and withdrawn to foreigners on entrance, departure, stay and transit (transit);

about the identity documents of foreigners issued, cancelled, recognized invalid and withdrawn;

about documents for visit of the international cultural and (or) sporting events held in the territory of the Republic of Belarus with the organization of visa-free entry into the Republic of Belarus of foreigners;

2.2. subjects of the information relations connected with creation and functioning of information system of exchange of data (further - subjects of information relations), are:

The Ministry of Internal Affairs (further - the Ministry of Internal Affairs);

The Ministry of Foreign Affairs (further - the MFA);

The state boundary committee (further - State frontier committee);

Committee for State Security (further - KGB);

State Control Committee;

Operational analytical center in case of the President of the Republic of Belarus;

the republican unitary enterprise "National Center of Electronic Services" (further - NTsEU);

the official booking operator who is the legal entity and enabling by means of the technical capabilities the realization of tickets for visit of the international cultural and (or) sporting events held in the territory of the Republic of Belarus with the organization of visa-free entry into the Republic of Belarus of foreigners (further - the booking operator);

2.3. users of information system of exchange of data by means of use of the information systems are the Ministry of Internal Affairs, the MFA, State frontier committee, KGB, the State Control Committee, Operational analytical center in case of the President of the Republic of Belarus, the booking operator;

2.4. MINISTRY OF INTERNAL AFFAIRS:

is the owner of information system of exchange of data;

performs methodological management and coordination of activities of subjects of the information relations for use of information system of exchange of data;

determines the directions of development of information system of exchange of data and takes measures for their realization;

initiates development and (or) change of technical and operational requirements to information system of exchange of data, structure, format of data and storage duration of information within information exchange in coordination with subjects of information relations, except for the booking operator;

2.5. NTSEU:

is operator of information system of exchange of data;

performs provision of information and communication infrastructure for placement of information system of exchange of data;

performs operation and technical support of information system of exchange of data;

performs operation of the means of cryptographic information security applied by transfer (obtaining) of information with use of information system of exchange of data;

provides in the course of functioning of information system of exchange of data fulfillment of requirements of the legislation on information, informatization and information security, including about personal data;

2.6. the republican unitary enterprise of telecommunication Beltelekom performs rendering services (performance of works) in provision in use of channels of telecommunication for the purpose of cross-border exchange of data between the State Parties of the Agreement on creation of the Union State;

2.7. the research and production republican unitary enterprise "Research Institution of Technical Information Security" performs delivery of means of cryptographic information security and rendering services (performance of works) in their installation for the purpose of cross-border exchange of data between the State Parties of the Agreement on creation of the Union State;

2.8. the cost of services (works) rendered (carried out) according to subitem 2.5 of this Item is established by Council of Ministers of the Republic of Belarus;

2.9. services (work), the goods specified in subitems 2.6 and 2.7 of this Item appear (are carried out), delivered on rates (prices) using the limiting standard rates of profitability used for determination of the amount of the profit which is subject to inclusion in rate (price) in the amount of no more than five percent;

2.10. procedure for functioning of information system of exchange of data, including the rights of its users, requirements to structure and procedure for processing of data, including personal data of foreigners, are determined by Council of Ministers of the Republic of Belarus;

2.11. information exchange regarding entering of information into information system of exchange of data and (or) receipts of information from this system is performed by its users by means of the nation-wide automated information system (further - OAIS), except for KGB, the State Control Committee and Operational analytical center in case of the President of the Republic of Belarus which perform such interaction via direct secure channels of data transmission.

Transfer and receipt of information by users of information system of exchange of data with use of OAIS are performed on a grant basis;

2.12. financing of expenses on providing:

functioning and developments of information system of exchange of data, acquisitions of the Ministry of Internal Affairs of services (works), the goods specified in subitems 2.5-2.7 of this Item it is performed at the expense of the means provided by the Ministry of Internal Affairs in the republican budget on content of law-enforcement bodies, and also other sources which are not forbidden by the legislation;

interactions of information systems of the Ministry of Internal Affairs, the MFA, State frontier committee with information system of exchange of data by means of OAIS is performed at the expense of the means provided in the republican budget on their content and also other sources which are not forbidden by the legislation;
