About inland water transport

The purpose of this Law is creation of the legal basis of realization of single state policy in the field of inland water transport aimed at providing public conveyances, baggage and loads with water transport, and also its operation.
1. This Law governs the public relations in the field of inland water transport arising between state bodies, physical persons and legal entities when implementing navigation, operation of different courts on waterways including small size vessels on all reservoirs of the republic in the fishery, tourist and other economic targets which are not relating to waterways and also determines their rights, obligations and responsibility.
2. Operation of this Law extends on all physical persons and legal entity performing activities in the field of inland water transport, irrespective of forms of their property.
3. The regulations established by this Law extend on:
1) waterways, water areas of lakes and water storage basins of the Kyrgyz Republic and constructions located on them;
2) ports, piers, moorings, bases parking and objects of water transport located on water objects of the Kyrgyz Republic;
3) vessels and floating objects operated on waterways and water objects of the Kyrgyz Republic;
4) the small size vessels and any swimming means operated on any water objects of the Kyrgyz Republic for fishery, tourist and other economic targets.
Operation of this Law also extends to any military and auxiliary, sports vessels and swimming means irrespective of forms of their property and accessory.
The legislation of the Kyrgyz Republic on water transport is based on the Constitution of the Kyrgyz Republic and consists of this Law, other regulatory legal acts adopted according to this Law, and which became effective in the procedure for international treaties established by the legislation which participant is the Kyrgyz Republic.
In this Law the following concepts are used:
1) the hinged motor - the propeller installation which is absolutely isolated from the vessel located behind vessel stern mainly intended for installation in quality of propulsion unit on small ships: yawls, recreational boats, tourist courts, scooters;
2) baggage - the property which is handed over to carrier by the passenger which is delivered by carrier in destination;
3) traveling works - dredging, vypravitelny, trawl, dnoochistitelny, prospecting and other works on the device and content of aids to navigation on waterways;
4) the passenger - the person consisting in contractual relations with carrier and specified in the ticket or other document confirming its right to journey;
5) shore - strip of sushi along bank line of water objects deep into for installation of navigation marks and the equipment with observance of ecological and technical requirements;
6) administration of the pool of inland waterways and water transport - the organization in the form of public institution performing content of inland waterways, the aid to navigation, and also the state port and mooring and ship control in the territory of the Kyrgyz Republic;
7) the captain - the authorized representative of the shipowner who is edinonachalnik and the head of ship crew;
8) the vessel - the self-propelled or non-self-propelled floating construction used for the purpose of navigation, floating and dnoochistitelny dredges, the ferry boat, the floating crane and other technical constructions of this sort used as translation aids on water;
9) navigation is the activities connected with management of the courts performing swimming on waterways;
10) the ship book - the book in which registration of courts is performed;
11) the mooring - the hydraulic engineering construction having devices for safe approach of courts and intended for the safe parking of courts, their loading, unloading and servicing, and also landing and disembarkation of passengers;
12) pier - specially equipped place for mooring (parking) of river crafts at the coast on inland waterways in bays of lakes. The pier intends for landing and disembarkation of passengers and overload transactions during navigation;
13) boat team - persons performing the works on the vessel having special preparation, qualification and the relevant documents on the holding the post right;
14) the shipowner (further - the owner of the vessel) - the legal entity or physical person, operating the vessel on its own behalf irrespective of whether he is owner of the vessel or uses it legally;
15) the handicraft engine - the engine made with use of manual work, which does not have the appropriate certificate or the document;
16) the register of courts - the general list of the different courts registered in the open state ship register on type, assignment, load-carrying capacity and capacity, classification and the accessories which are on permanent or temporary basis in the territory of the Kyrgyz Republic;
17) the ship course is the water surface on waterways arranged with the navigation marks specifying its borders within which free navigation of vessels of certain sizes is allowed;
18) navigation - the activities connected with use of courts for carriage of goods, passengers and their baggage, towage, implementation of searches, fisheries, construction, hydrotechnical, underwater and technical and other works, salvage operations, the state control and supervision, holding actions for protection of water objects, protection them from pollution, scientific research;
19) classification - form of the assessment of conformity to requirements of the technical regulation of EEU performed by body of classification of small size vessels;
20) inland water transport of the Kyrgyz Republic (further - water transport) - mode of transport which is used for public conveyance and loads, and also the entertaining and walking purposes (vessels and small size vessels);
21) waterways of the Kyrgyz Republic (further - waterways) - the natural or artificially created means of communication designated by navigation marks and used for the purpose of navigation;
22) sailing directions is Section of navigation where navigational hazards, waterway aids to navigation which subject is studying of waterways in relation to needs of navigation are studied;
23) the state ship register - the document in which all vessels which are in the territory of the Kyrgyz Republic, floating crafts, floating objects and the rights to them are registered;
24) the state monitoring body - the authorized state body performing functions of control and supervision in the field of water transport, determined by the Cabinet of Ministers of the Kyrgyz Republic;
25) navigation - period of time during which waterways are open and safe for navigation, operation of different courts and swimming means;
26) the aid to navigation - system of the special alarm and technical means and tools intended for ensuring safe navigation, vessel position determination, and also control of its movement;
