About social protection of the citizens who were injured owing to catastrophic crash on the Chernobyl nuclear power plant
The purpose of this Law is protection of the rights and interests of persons which were injured in zone of influence of the adverse factors which arose owing to catastrophic crash on the Chernobyl nuclear power plant on April 26, 1986, or taking part in mitigation of consequences of this catastrophic crash and also children whose parents were affected by radiation exposure and genetic impact.
In this Law the following basic concepts are used:
- the state support of the citizens who were injured owing to catastrophic crash on the Chernobyl nuclear power plant (daleepostradavshy citizens) - system of the social, economic, legal, medical and organizational and technical measures guaranteed by the state compensating negative consequences of impact of radiation and providing to injured citizens health protection, proper conditions of activity;
- exclusion zone - hereinafter being referred to as in 1986 - 1987 as the 30th kilometer zone, and since 1988 - injured zone of the territory of the Russian Federation, Ukraine and Belarus from which in 1986 according to regulations of radiation safety the population was evacuated;
- radiation dose - dose of the absorbed energy of ionizing radiation by organism taking into account unequal sensitivity of different bodies and fabrics;
- radiation sickness - the disease arising from impact in case of radiation on radiation human body in the doses exceeding maximum permissible;
- evacuation of the population - temporary evacuation of the population from danger areas to safe places.
The legislation of the Republic of Tajikistan on social protection of the citizens who were injured owing to catastrophic crash on the Chernobyl nuclear power plant is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also international legal acts recognized by Tajikistan.
Treat category of the citizens who were injured owing to catastrophic crash on the Chernobyl nuclear power plant:
a) the persons who were living during catastrophic crash on the Chernobyl nuclear power plant in exclusion zone, visited business trip, the military personnel and the personal commanding and ordinary structure of law-enforcement bodies serving in this zone and also the persons evacuated or which left voluntarily or moved in 1986 and in the years ahead to the Republic of Tajikistan from exclusion zone including the children who are during evacuation in mother's womb;
b) the citizens who were taking part in mitigation of consequences of catastrophic crash on the Chernobyl nuclear power plant including:
- the citizens who are temporarily sent, taking part in works on mitigation of consequences of catastrophic crash on the Chernobyl nuclear power plant within exclusion zone and (or) occupied during this period at other works;
- the military personnel including entering rescue parts and divisions and the persons liable for call-up called on the special charges and involved in performance of works connected with mitigation of consequences of catastrophic crash on the Chernobyl nuclear power plant, irrespective of the place of dislocation and the related performance of works and also face of the commanding and ordinary structure of law-enforcement bodies, serving in 1986-1991 in exclusion zone and (or) occupied at other works on the Chernobyl nuclear power plant;
c) the persons specified in the Items "and" and "b" of this Article, who received radiation or the patients with other diseases connected with catastrophic crash consequences on the Chernobyl nuclear power plant or works on elimination of consequences of catastrophic crash;
d) the persons specified in the Items "and" and "b" of this Article, who sustained injuries owing to catastrophic crash on the Chernobyl nuclear power plant or works on elimination of consequences of catastrophic crash;
e) the children who were born from one of injured parents and also the teenagers who were born with the diseases connected according to the conclusions of competent medical authorities with the remote heritable diseases found owing to catastrophic crash on the Chernobyl nuclear power plant;
e) the families which were left without supporter who was injured owing to catastrophic crash on the Chernobyl nuclear power plant.
The state support of social protection of injured citizens is performed on the basis of the following measures:
- compensation in the procedure for compensation of the harm done to health of certain citizens established by the legislation of the Republic of Tajikistan;
- accounting of injured persons and maintaining the state medical dozaizmeritelny registers;
- development and realization of mechanisms of determination of the causes of illness and disability connected with catastrophic crash consequences;
- development and realization of evidence-based method of calculation of individual doses of radiation of citizens from the moment of catastrophic crash;
- determination of the status of persons which were affected by catastrophic crash on the Chernobyl nuclear power plant and also development and implementation of measures for their social protection depending on the established categories of victims;
- creation of the preferential mechanism of activities of the public medical, sanatorium institutions which are directly providing the solution of tasks on health protection of victims;
- creation of special funds for the purpose of additional financing of social protection of injured citizens;
- implementation of other privileges, stipulated by the legislation Republic of Tajikistan.
Victims, citizens have the right to health protection in the public medical institutions according to the legislation of the Republic of Tajikistan.
Participants of mitigation of consequences of catastrophic crash on the Chernobyl nuclear power plant to whose health harm is not done undergo annual free physical examination in the public medical institutions.
