About use of the tariff privilege in 2025

For the purpose of implementation of the Decision of Council of the Eurasian economic commission of November 29, 2024 "About modification of some decisions of the Commission of the Customs union concerning separate types of meat of cattle" the Council of Ministers of the Republic of Belarus DECIDES: No. 107

1. Approve Regulations on procedure for use in 2025 of the tariff privilege for import to the Republic of Belarus of amounts of meat of cattle it (is applied).

2. Provide to the Ministry of Agriculture and Food coordination of activities of regional executive committees and the Minsk Gorispolkom concerning use of the tariff privilege according to this resolution.

3. This resolution becomes effective after its official publication.

Regulations on procedure for use in 2025 of the tariff privilege for import to the Republic of Belarus of amounts of meat of cattle

1. This Provision determines procedure for use of the tariff privilege for import to the Republic of Belarus of amounts of meat of cattle *, the Eurasian economic commission provided by the Decision of Council of November 29, 2024 No. 107 (further - amounts of meat of cattle).

* For the purposes of this provision meat of cattle is understood as the meat classified according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union the codes specified in the paragraph the second to part one of subitem 7.1.75 of Item 7 of the Decision of the Commission of the Customs union of November 27, 2009 No. 130 "On single customs and tariff regulation of the Eurasian Economic Union".

2. Ministry of Agriculture and Food:

2.1. determines (by areas and Minsk) amounts of meat of cattle taking into account the analysis of indicators of production of meat products in the territory of the areas and Minsk which are available for legal entities of production capacities and raw material resources and till April 11, 2025 brings these amounts to the attention of regional executive committees and the Minsk Gorispolkom;

2.2. based on offers of the regional executive committees and the Minsk Gorispolkom provided according to Item 3 this provision till May 5, 2025 distributes amounts of meat of cattle between the legal entities who told till April 18, 2025 to regional executive committees and the Minsk Gorispolkom the need for use of these amounts for release of self-produced meat products.

In case of non-use by the legal entity of the amount of meat of cattle distributed to it this amount is redistributed by the Ministry of Agriculture and Food based on offers of the regional executive committees and the Minsk Gorispolkom created according to requests of legal entities according to the production capacities and raw material resources which are available for them;

2.3. in case of decision making of Council of the Eurasian economic commission about growth in volumes of meat of cattle distributes these amounts according to the production capacities and raw material resources which are available for legal entities based on offers of the regional executive committees and the Minsk Gorispolkom created according to requests of legal entities;

2.4. sends to the Ministry of anti-monopoly regulation and trade no later than the next day after distribution (redistribution) of amounts of meat of cattle information on distribution (redistribution) of these amounts between legal entities.

Information specified in part one of this subitem goes in electronic form and shall contain the following data:

full name of the legal entity, accounting number of the payer;

codes and names of goods according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union;

the distributed (redistributed) amounts of meat of cattle.

3. Regional executive committees and the Minsk Gorispolkom till April 25, 2025 represent to the Ministry of Agriculture and Food of the offer on distribution between legal entities (with indication of accounting numbers of payers) amounts of meat of cattle according to their requests for use of these amounts for release of self-produced meat products, and also taking into account:

the actual amounts of release of self-produced meat products in previous year;

production capacities and raw material resources.

4. Within the amounts of meat of cattle distributed by the Ministry of Agriculture and Food regional executive committees and the Minsk Gorispolkom issue to the legal entities registered in the Republic of Belarus, who are producers of meat products and included in the register of production facilities on which activities for obtaining, conversion (processing) of not processed food (food) staples of animal origin, for their addresses confirmation about reference of imported goods to the goods specified in the paragraph the second to part one of subitem 7.1.75 of Item 7 of the Decision of the Commission of the Customs union of November 27, 2009 No. 130, subject to submission to customs authority are performed.

The confirmation specified in part one of this Item is drawn up in any form, issued free of charge within 15 calendar days from the date of the address of the interested person determined in part one of this Item and shall contain the following data:

5. Ministry of anti-monopoly regulation and trade:

5.1. performs issue of licenses for import of meat of cattle according to the procedure, similar established by Rules of issue of the licenses and import permits and (or) commodity import included in the single inventory to which measures of non-tariff regulation in trade with the third countries approved by the Decision of Council of the Eurasian economic commission of November 24, 2023 No. 125 are applied;

5.2. quarterly to the 10th following reporting informs the Ministry of Agriculture and Food on the granted licenses.

6. The State Customs Committee monthly to the 25th following reporting represents in electronic form on agreed form to the Ministry of Agriculture and Food and the Ministry of Foreign Affairs data on the room under customs procedure of release for internal consumption in 2025 of amounts of meat of cattle within the tariff privilege.
