About prevention of neglect and offenses of minors

Based on Article part ten 20, of paragraph one of Article 21, of parts one and the eighteenth article 22 of the Law of the Republic of Belarus of May 31, 2003 No. 200-Z "About bases of system of prevention of neglect and offenses of minors" and subitem 9.4 of Item 9 of the Regulations on the Ministry of Internal Affairs of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 4, 2007 No. 611, the Ministry of Internal Affairs of the Republic of Belarus DECIDES:

1. Establish the list of the objects and substances capable to do harm to health of the minors which are in the receiver distributor for minors according to appendix.

2. Approve:

The instruction about procedure for the organization of activities of law-enforcement bodies for prevention of neglect and offenses of minors (is attached);

The instruction about procedure for the organization of activities of the receiver distributor for minors (is attached).

3. Recognize invalid:

the resolution of the Ministry of Internal Affairs of the Republic of Belarus of June 8, 2017 No. 155 "About questions of prevention of neglect and offenses of minors";

the resolution of the Ministry of Internal Affairs of the Republic of Belarus of August 11, 2022 No. 202 "About change of the resolution of the Ministry of Internal Affairs of the Republic of Belarus of June 8, 2017 No. 155".

4. This resolution becomes effective after its official publication.

Appendix

to the Resolution of the Ministry of Internal Affairs of the Republic of Belarus of December 11, 2024 No. 400

The list of the objects and substances capable to do harm to health of the minors which are in the receiver distributor for minors

1. Cold, fire, gas and other weapon, ammunition, objects which striking action is based on use of combustible substances.

2. The models and prototypes imitating appearance of weapon, ammunition and objects which striking action is based on use of combustible substances, the apparatuses structurally similar to weapon and ammunition.

3. Explosives and products, flammable liquids and solid substances.

4. Pyrotechnic substances and products.

5. Radioactive, toxic and toxic agents.

6. The pricking, cutting, cutting objects, and also other objects which can be used for damnification of life and (or) to health of minors, staff of law-enforcement bodies and other citizens.

7. Drugs, psychotropic substances, their precursors and analogs, the toxic or other stupefying substances.

8. Alcoholic, low alcohol beverages or beer, tobacco products, electronic systems of smoking, liquid for electronic systems of smoking and system for tobacco consumption.

The instruction about procedure for the organization of activities of law-enforcement bodies for prevention of neglect and offenses of minors

Chapter 1. General provisions

1. This Instruction determines procedure for the organization of activities of territorial authorities of internal affairs (further, unless otherwise specified, – Department of Internal Affairs) by prevention of neglect and offenses of minors, procedure for carrying out personal inspection of the minor, examination of its things, and also procedure for transfer of the objects and substances withdrawn from the minor capable to do harm to his health, his parents (adoptive parents, adopters), guardians or custodians (further, unless otherwise specified, – legal representatives) or to representatives of the state organizations of health care, social and pedagogical organizations, special educational facilities (further, unless otherwise specified, – SVU).

2. For the purposes of this Instruction terms in the values established by the Law of the Republic of Belarus "About bases of system of prevention of neglect and offenses of minors" are used (further, unless otherwise specified, – the Law).

Chapter 2. Procedure for carrying out individual scheduled maintenance concerning the minor and his parents (adopters, adoptive parents) who are not performing or inadequate image of the acting as on education and content of the minor

3. Individual scheduled maintenance (further, unless otherwise specified, – the International Party of Russia) concerning the minors specified in paragraph nine of article 21 of the Law, their parents (adoptive parents, adopters) who do not perform or inadequate image fulfill duties on education and content of minors, carry out inspectorates for cases of minors (further, unless otherwise specified, – IDN) in interaction with other divisions of Department of Internal Affairs.

4. The International Party of Russia concerning minors and their parents (adoptive parents, adopters) who do not perform or inadequate image fulfill duties on education and content of minors, IDN at the place of residence (the place of stay) of the minor is carried out.

The International Party of Russia concerning the minors containing in the receiver distributor for minors (further, unless otherwise specified, – PRN), is carried out by employees of PRN.

The International Party of Russia concerning the minors containing in SVU is carried out by IDN in the place findings of these organizations.

5. Within two working days from the moment of establishment of the minor specified in paragraphs the sixth or nineteenth to part one of article 5 of the Law and (or) parents (adoptive parents, adopters) who do not perform or inadequate image fulfill duties on education and content of the minor, the chief of Department of Internal Affairs issues the decree on carrying out the International Party of Russia concerning the minor in form according to appendix 1 and (or) the resolution on carrying out the International Party of Russia concerning parents (adoptive parents, adopters) who are not performing or inadequate image of the acting as on education and content of the minor, in form according to appendix 2 (further, unless otherwise specified, – the resolution on carrying out the International Party of Russia).

6. In day of pronouncement of the resolution on carrying out the International Party of Russia concerning the minor:

6.1. case of the International Party of Russia is opened;

6.2. information goes in:

organization of education in the place of training of the minor;

the state organization of health care for the residence (the place of stay) of the minor, consumption to which drugs, psychotropic substances, their analogs, the toxic or other stupefying substances, the use of alcoholic, low alcohol beverages or beer are established according to the legislation;

the commission for minors (further – KDN) at the place of residence (the place of stay) of the minor who is not studying and not working.

7. IDN no later than two working days from the moment of pronouncement of the resolution on carrying out the International Party of Russia:

7.1. invites in Department of Internal Affairs of the minor and his legal representatives. The invitation is performed in writing, by means of telephone communication, the SMS message, the global computer Internet, including e-mail, and also other means of communication providing fixation of challenge;

7.2. informs the minor and his legal representatives of the resolution on carrying out the International Party of Russia, explains terms, the bases of carrying out and the termination of the International Party of Russia provided by articles 6 and 7 of the Law, power of IDN, right of the minor, his legal representatives. Each of legal representatives of the minor, except as specified their accommodation separately gets acquainted with the resolution on carrying out the International Party of Russia concerning the minor;

7.3. performs photography of the minor, and if necessary – detailed photography of its special signs;

7.4. explains to the minor condemned with delay of execution of the punishment, or with conditional non-use of punishment either without assignment of punishment, or using enforcement powers of educational nature (further, unless otherwise specified, – the convict), and to his legal representatives the rights and obligations taking into account determined by court condemned measures of criminal liability and consequence in law of failure to carry out by it of the obligations assigned to it;
