The mutual declaration of heads of states of the Organization for democracy and economic development - GUAM concerning settlement of the conflicts

of May 23, 2006

Heads of states of the Azerbaijan Republic, Georgia, Republic of Moldova and Ukraine,

being guided by the purposes and the principles established in Articles of organization of the United Nations, the commonly accepted regulations and the principles of international law, provisions of fundamental documents of Organization for Security and Cooperation in Europe, the Yalta Charter, the Chisinau and Kiev Declarations GUAM

proceeding from commitment to democratic values and the aspiration to continue promotion on the way of the European and Euro-Atlantic integration,

noting the increasing role in the all-European integration processes of regional cooperation on the basis of mutual respect of the sovereign rights of the states,

emphasizing that such cooperation promotes promotion of democracy, strengthening of the regional and international security and deepening of commercial and commercial intercourses,

confirming need of respect for sovereignty, territorial integrity and international and acknowledged borders of the states as one of bases of maintenance of the international security,

confirming also need of development of democracy and respect of the rights and fundamental freedoms of the person, including persons belonging to ethnic or ethnic minorities for the purpose of providing the world and safety, strengthening of spirit of tolerance, approval of values of variety of cultures and joint peaceful accommodation of different ethnoses within international and acknowledged borders of the states,

recognizing that not settled conflicts and illegal military presence in the territory of the Azerbaijan Republic, Georgia and the Republic of Moldova undermine sovereignty, territorial integrity and political independence of these states, complicate implementation of full-scale democratic transformations and achievement of sustainable development, threaten regional security, negatively influence the all-European integration processes and represent themselves challenge to all international community,

expressing deep concern in connection with the increasing safety hazards proceeding from conflict zones, including the international terrorism, aggressive separatism, extremism, organized crime, and the related other dangerous phenomena,

being deeply concerned by the proceeding human sufferings owing to the conflicts and their destructive effects,

paying the attention of the international community to need of the states which postponed the conflict in the help with recovery of the infrastructure destroyed as a result of military operations,

confirming that root causes of the conflicts are multidimensional in character and, therefore, require the comprehensive, integrated and step-by-step approach to their settlement,

recognizing need of intensification of efforts on settlement of the conflicts and calling the states and the international and regional agreements and organizations and further to promote, within the competence, to settlement processes of the conflicts on space GUAM,

1. Declare that settlement of the conflicts in the territories of the states Guam is feasible only on the basis of respect for sovereignty, territorial integrity and inviolability of international and acknowledged borders of these states and is one of priority tasks of cooperation within GUAM.

2. Emphasize that the territory of the state cannot be object of acquisition or the military occupation which is result of threat of force or its applications in defiance of the relevant provisions of international law. No territorial acquisitions and the self-proclaimed educations created in their result can be acknowledged legal under no circumstances.

3. Remind in this regard of the obligation of the states not to interpose in the matter of any other state and not to render on it military, political, economic or any other pressure.

4. Note hopelessness and malignancy of separatism and disintegration, incompatibility of use of force, practice of ethnic cleanings and territorial captures with universal and European values, the principles and ideals of the world, democracy, stability and regional cooperation.

5. Emphasize in this context importance of consolidation of efforts of the states Guam and the international community in settlement of the conflicts in their territories by reintegration of the uncontrollable territories into the states which part they are of return of displaced persons to places of permanent residence and ensuring joint peaceful accommodation of different ethnic groups within international and acknowledged borders of the states, development of civil society, recovery of the destroyed infrastructure in these territories, and also uses of communications for benefit of all parties.

6. Highlight importance of demilitarization of conflict zones and safety in these zones by means of the multinational peacekeeping forces deployed there under the auspices of the UN or OSCE for creation of conditions for return of the population and joint peaceful accommodation of ethnic communities.

7. Consider that the status of self-government for the communities constituting the population of the uncontrollable territories which will provide necessary conditions for effective realization of their rights to equal participation in administration of state affairs including through forming of legitimate regional authorities at all levels, it can be determined only within legal and democratic process.

8. Welcome efforts of the international community and emphasize importance of support to the states Guam in development and implementation of comprehensive and consecutive strategy for settlement of the conflicts on the basis of the above principles, including the short-term and long-term measures directed to achievement and ensuring lasting peace, safety and sustainable development.

9. Charge to Council of Foreign Ministers to develop specific measures and steps for the purpose of realization of provisions of this declaration.
